First, accelerate the construction of public rental housing.

City, district and county people's governments shall accelerate the construction of public rental housing according to the housing security development plan and the annual construction plan. Industrial park management agencies shall organize the construction and raising of public rental housing, encourage social units to use existing construction land to build public rental housing, and encourage investment institutions and real estate development enterprises to build, hold and operate public rental housing.

(a) the municipal, district and county people's governments raise public rental housing through new construction, acquisition and long-term lease, and implement the construction and acquisition funds.

1. New mode. The newly-built public rental housing adopts a combination of centralized construction and supporting construction. Land for public rental housing projects built by institutions affiliated to the people's governments of cities, districts and counties shall be supplied by allocation, and construction may be organized in various ways, such as entrusted construction and project management. With the construction of public rental housing projects, by the relevant departments of the municipal, district and county people's governments to determine the proportion of construction, Xing Tao construction, repurchase price, repurchase units, completion time and other specific requirements, and in the land supply related documents to be clear.

2. Collection method. When the people's governments of cities, districts and counties meet the demand for housing allocation, the designated institutions may purchase affordable housing and price-limited commercial housing under construction but not yet allocated as public rental housing. After the use of directional resettlement houses, there is still surplus, and the designated institutions of the municipal, district and county people's governments shall purchase public rental housing at the price approved by the relevant municipal departments. Designated institutions of the municipal, district and county people's governments may also purchase newly-built ordinary commodity housing and social stock housing as public rental housing.

3. Long-term lease. The relevant departments or designated institutions of the county people's government may lease some houses with suitable price and area from directional resettlement houses and commercial houses for a long time, and rent them to public rental houses to apply for families.

4. Implement funds. Combine the construction, distribution, operation and management of low-rent housing and public rental housing, and make overall use of funds. The financial department of the people's government of the city, district or county shall use the low-rent housing security fund arranged by the net income of land transfer, the low-rent housing security fund accrued by the value-added income of housing provident fund and other funds arranged by the government budget as a whole for the construction, purchase, operation and rent subsidy of public rental housing.

In principle, the funds needed for municipal overall planning construction and acquisition of public rental housing are raised by the Beijing Investment Center for Affordable Housing Construction (hereinafter referred to as the "City Investment Center"), and the municipal finance injects capital into the City Investment Center. The public rental housing held by the people's government of the six districts of the city, the municipal finance according to the main situation of public rental housing, through the city investment center or directly allocated to the district finance to give project investment subsidies. The people's governments of other districts and counties shall solve the funds needed for the construction and acquisition of public rental housing from the special funds extracted from them. The funds needed for public rental housing and public distribution raised through long-term lease are raised by district and county finance.

In accordance with the above provisions, the central and municipal units to build or rebuild public rental housing, should be submitted to the city housing security leading group office for construction, and by its approval; Other social units apply to the district and county people's governments, and the district and county people's governments shall submit them to the housing security leading group office for the record. After the approval of the project, it will be included in the city's public rental housing construction plan, and the departments of development and reform, planning, land and housing urban and rural construction should go through the relevant examination and approval procedures according to the construction plan.

(4) The municipal land department may separately supply land for the construction of public rental housing, or require a certain proportion of public rental housing to be allocated in the bidding, auction and listing contracts for the land use right of ordinary commercial housing, and the investment institutions and real estate development enterprises will invest in the construction, holding and operation, supply land by lease or transfer, and allocate rent to families who have obtained the qualification of public rental housing filing according to the rent standards set by the government. Public rental housing built, held and operated by investment institutions and real estate development enterprises can be repurchased by institutions designated by the municipal, district and county people's governments in accordance with the standards of affordable housing, or adjusted to other types of affordable housing with the approval of the municipal government after a certain number of years.

The competent department of city planning, housing and urban and rural construction shall formulate regulations on the design of public rental housing for single workers, imported talents, young families and elderly families that meet different social needs.

(VI) Public rental housing projects included in the construction, acquisition and long-term lease plan of public rental housing in this Municipality shall enjoy tax preferences in accordance with the Notice of State Taxation Administration of The People's Republic of China, Ministry of Finance of People's Republic of China (PRC) on Supporting Relevant Tax Preferential Policies for the Construction and Operation of Public Rental Housing (Cai Shui [2010] No.88) and the implementation opinions of this Municipality. Public rental housing projects are exempt from administrative fees and government funds in the construction and operation. Municipal infrastructure investment outside the red line of public rental housing planning held by government-owned institutions shall be financed by municipal, district and county people's governments, municipal professional companies and other units through multiple channels.

Three, strengthen the application, audit and rent management.

3. People from other provinces and cities who have worked continuously and stably in Beijing for a certain number of years, have full capacity for civil conduct, have a stable income, can provide proof of temporary residence, proof of paying housing provident fund or proof of participating in social insurance during the same period, and they and their family members have no housing in this city. The specific conditions are determined by the people's governments of all districts and counties in combination with the industrial development, population, resources and environment carrying capacity and housing security capacity of the districts and counties.

Public rental housing in industrial parks is mainly used to solve the housing difficulties of imported talents and park employees. The specific application conditions shall be determined by the industrial park management organization and implemented after being approved by the district and county people's governments.

(II) Families waiting for low-rent housing, affordable housing and price-limited commercial housing can apply for public rental housing by registering with the original neighborhood office (Township People's Government), giving priority to rent allocation.

The application and review of public rental housing qualification shall be implemented in accordance with the current "three-level review and two-level publicity" system of affordable housing in this Municipality. Eligible urban household registration families in this city apply to the street office (Township People's Government) where the applicant is registered.

(III) Public rental housing held by institutions, investment institutions and real estate development enterprises owned by the municipal, district and county people's governments shall be allocated by public lottery and house selection in sequence. Social units shall, under the supervision and guidance of the municipal, district and county housing security management departments, prepare the distribution and operation management plan 60 days before the housing has the occupancy conditions, and organize the distribution.

City, district and county housing security management departments and public rental housing property units shall, in accordance with the requirements of the "full sunshine project of affordable housing", organize lottery house selection activities and be open and transparent. The lottery can invite NPC deputies, CPPCC members, political supervisors and news media to participate and accept social supervision. The process of sorting the lottery numbers shall be supervised by the notary department, and a notarial certificate shall be issued.

(5) Public rental housing built, collected and held by investment institutions and real estate development enterprises organized by the institutions affiliated to the people's governments of districts and counties shall be given priority to families who have obtained the qualification of public rental housing in the districts and counties; The remaining houses are allocated to other districts and counties by the municipal housing security management department. The specific measures for recovery, acquisition and compensation shall be formulated by the people's governments of all districts and counties, and shall be implemented after being reported to the office of the Municipal Housing Security Leading Group for the record.

Fourth, standardize lease management and post-management

(a) the principle of "market pricing, grading subsidies, and separation of rent and compensation" is applied to the rent of public rental housing. The rent of public rental housing is determined by considering the construction, operation and management costs of the project, which is slightly lower than the market rent level of the same type of housing in the same location.

The municipal competent department of housing and urban and rural construction shall entrust a professional evaluation institution with corresponding qualifications or the municipal investment center to regularly determine the market rent of the area where the public rental housing project is located. The rent standard of public rental housing shall be formulated by the property right unit and shall not be higher than the market rent in the area where the project is located, and shall be dynamically adjusted. Property units for the central and municipal units, public rental housing projects rent standards need to be audited by the municipal housing security management department and the municipal finance department before implementation; Other project rent standards need to be audited by the county-level housing security department and the financial department, and reported to the municipal housing security management department and the municipal financial department for the record.

(two) in line with the application conditions of low-cost housing, affordable housing and price-limited commercial housing, families rent public rental housing, and the application for rent subsidies put forward by the municipal, district and county housing security management departments shall be supplemented. The subsidy object and standard are determined according to the factors such as the income level of the rented family, the family population and the standard of the security area. Rent subsidy funds shall be charged in the special funds for public rental housing, and the required funds shall be borne by the municipal, district and county financial departments in proportion. Public rental housing tenants can withdraw housing provident fund and housing subsidies to pay rent.

Public rental housing rent and rent subsidies are accounted for separately. After the tenant family pays the rent, the district and county housing security management department will issue rent subsidies to the tenant family in accordance with relevant regulations.

(three) the public rental housing property unit and the lessee shall sign a lease contract. The model text of Beijing Public Rental Housing Lease Contract shall be formulated by the municipal housing and urban-rural construction department in conjunction with relevant departments. The term of the lease contract shall be agreed by both parties, generally 3 years, and the longest shall not exceed 5 years.

The rent of public rental housing can be charged monthly, quarterly and annually, but the maximum rent shall not exceed 1 year. Property units may entrust banks or other institutions to collect rents.

(4) The property right unit and the lessee may stipulate in the lease contract that if the lessee defaults on the rent or other expenses, the property right unit may deduct them in accordance with the relevant provisions of the state and notarize them by the notary office.

(five) the district and county housing security management departments audit the public rental housing and family housing every year. After family members purchase, donate, inherit or lease other houses, if the housing situation no longer meets the application conditions of public rental housing, they should withdraw from public rental housing.

After the expiration of the contract, if the lessee needs to renew the lease, it shall apply to the district and county housing security management department 3 months before the expiration of the contract. If the application conditions are still met after examination, the property right unit shall go through the formalities of renewing the lease; Do not meet the conditions of public rental housing, no longer renew the lease, the lessee shall withdraw from the housing; If the lessee's family is temporarily unable to vacate the leased house, a two-month transition period will be given after the lease contract expires, and the rent will be charged according to the measured market rent in the same area during the transition period. After the expiration of the transition period, if the tenant's family still does not withdraw from the leased house, the rent will be charged according to the standard of 2 times the rent of the public rental house specified in the lease contract, and those who refuse to withdraw will be recorded in the credit file.

(VI) Withdrawing from public * * * rental housing, the property unit shall timely issue housing to eligible waiting families and report to the county-level housing security management department for the record.

(seven) the district and county housing security management departments should strengthen the daily supervision and inspection of the use of public rental housing, strengthen the guidance, supervision and inspection of the operation and management institutions, and regularly review the qualifications of public rental housing tenants in accordance with the provisions.

Public rental housing property units shall be responsible for lease management and property services. , and equipped with special personnel to assist the housing security management department to strengthen the dynamic management of the qualifications of rented families, and assist the street offices (township people's governments) and community management departments to carry out community services.

(3) The applicant practices fraud and fails to truthfully declare the family income, housing and other information. 2. Sublet or lend the house to others.

5. Other acts in violation of relevant regulations and lease contracts.

(5) The staff of the municipal, district and county housing security management departments and sub-district offices (township people's governments) who take advantage of their positions, accept other people's property or other benefits, or abuse their powers, neglect their duties, engage in malpractices for selfish ends and other illegal acts shall be given administrative sanctions, and if the case constitutes a crime, criminal responsibility shall be investigated according to law.
