Where laws and regulations provide otherwise for house decoration, such provisions shall prevail.
Article 3 The term "house decoration" as mentioned in these Regulations refers to the activities of external and internal decoration of houses that have been used (including houses that have been completed and accepted but not yet used).
Article 4 The real estate administrative department of the Municipal People's Government is the competent department of urban housing decoration within its administrative area; The real estate administrative department of the county (city) people's government is responsible for the management of urban housing decoration within its jurisdiction; The real estate administrative department of the District People's Government shall, in accordance with the division of authority, be responsible for the management of urban housing decoration within its jurisdiction.
Fifth housing decoration should comply with the relevant provisions of urban planning, fire safety and environmental protection, and shall not harm the interests of the state, the public and others.
In order to ensure the integrity, seismic performance and structural safety of the house, the main body and load-bearing structure of the house shall not be changed without authorization during house decoration.
Sixth housing renovation involves changes in the main building and load-bearing structure, housing users should report to the housing management department or property management unit before construction; And entrust the original housing design unit or a design unit with corresponding qualifications to propose a design plan; No construction is allowed without a design scheme.
Seventh seriously damaged and dangerous houses need to be renovated, and they must be repaired and strengthened, and can only be renovated after they meet the safety conditions.
Eighth units engaged in the design, construction and supervision of house decoration and their professional and technical personnel shall have the corresponding qualifications stipulated by the state; Housing decoration projects involving changing the main body and load-bearing structure of housing construction must be undertaken by construction enterprises with corresponding qualification grades.
Ninth house decoration shall not damage the structural performance of waterproof layer and concrete floor, and shall not damage public facilities such as water supply and drainage, power supply, gas supply, fire protection and communication, and shall not damage other people's houses and articles.
Tenth housing renovation must be carried out in strict accordance with technical specifications, and no fraud, Jerry-building, shoddy, unqualified decoration materials shall be used.
Eleventh units and individuals engaged in building decoration construction, in the construction, should take measures to avoid or reduce the harm caused by dust, waste gas, waste water, noise and vibration to the normal life of neighboring residents. In the area where residents live, they are not allowed to engage in house decoration activities that generate noise from 12: 30 to 14: 30 or 19 to 7: 00 the next day.
Article 12 Waste generated from house decoration shall not be littered, and house users shall pile it up in the place, manner and time designated by the property management unit, the residents' committee where the house is located or the housing management department of the unit, and remove it in accordance with relevant regulations.
Thirteenth real estate administrative departments should strengthen the supervision and inspection of housing decoration activities, and promptly investigate and deal with illegal acts.
When inspectors enter the construction site to carry out inspections, they must produce administrative law enforcement certificates, and the units and individuals under inspection shall cooperate.
Fourteenth housing decoration quality warranty system. Under normal use, the minimum warranty period is two years.
Fifteenth disputes caused by quality, time limit, price, etc. The parties may apply to the real estate administrative department or other relevant departments for mediation, or apply for arbitration or bring a lawsuit according to law.
Sixteenth in violation of the provisions of this Ordinance decoration houses, real estate management units, housing residents' committees or housing management units have the right to stop; Anyone has the right to report to the real estate administrative department or other administrative departments, and the department that receives the report shall promptly investigate and deal with it according to law.
Article 17 If, in violation of the provisions of these regulations, the user of the house changes the main body and load-bearing structure of the building without authorization during the renovation, the real estate administrative department of the city or the district or county (city) where the house is located shall order it to make corrections, and shall be punished in accordance with the relevant provisions of the Regulations of the State Council Municipality on Quality Management of Construction Projects.
Eighteenth in violation of the provisions of this Ordinance, damage to the waterproof layer and concrete floor structure performance, by the housing location of the district and county (city) real estate administrative departments shall order the housing users to stop construction, repair within a time limit, and may impose a fine of more than 2000 yuan to 4000 yuan.
Article 19 Whoever violates laws and regulations such as urban planning, fire safety, construction engineering, environmental protection, public utilities, city appearance and environmental sanitation, quality and technical supervision, industrial and commercial administration, labor and social security in house decoration activities shall be punished by the relevant administrative departments according to law.
Twentieth refuse or hinder the real estate administrative departments and relevant administrative departments of the staff to perform official duties according to law, in violation of the "Regulations of the people's Republic of China on administrative penalties for public security", shall be punished by the public security organs according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-first because of the renovation of the house caused by other people's property and personal injury, should bear civil liability according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Twenty-second real estate administrative departments and their staff, who abuse their powers, neglect their duties, engage in malpractices for selfish ends in the management activities of house decoration, shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 23 These Regulations shall be promulgated by the Standing Committee of Changsha Municipal People's Congress after being approved by the Standing Committee of Hunan Provincial People's Congress, and shall come into force as of March, 200 1 year.
