Regulations of Nanjing Municipality on the Administration of Urban Housing Safety

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the relevant laws and regulations of the state and the actual situation of this Municipality in order to strengthen the management of housing safety, ensure the safety of housing use and safeguard public interests. Article 2 These Regulations shall apply to the safety management of houses on state-owned land within the administrative area of this Municipality, including the safety management of maintenance and renovation during the use of houses, the safety appraisal management of houses and the prevention and control of termites in houses.

If there are other provisions in laws and regulations on the housing safety management of the army, religious groups and cultural relics protection units, those provisions shall prevail. Article 3 The municipal real estate administrative department is responsible for the housing safety management in this Municipality, and its subordinate housing safety management agencies and termite control management agencies are specifically responsible for the corresponding daily management work. The district and county real estate administrative departments shall be responsible for the housing safety management in their respective jurisdictions in accordance with the division of responsibilities.

Construction, planning, construction, city appearance, public security, fire protection, price, production safety, quality and technical supervision and other relevant departments shall, according to their respective responsibilities, coordinate the implementation of these regulations. Article 4 The real estate administrative department shall establish and improve various systems for the safe use of houses according to law, publicize the knowledge of safe use of houses, strengthen the supervision and inspection of the safe use of houses, and promptly stop and investigate acts that endanger the safety of houses. Chapter II Safety Management of House Use Article 5 The owner and user of a house shall ensure the overall structural safety of the house, and use the house reasonably according to the designed structure and purpose of the house, and shall not affect the safety of adjacent houses. Sixth housing owners or users shall not engage in the following acts without the permission of the municipal real estate administrative department:

(a) the demolition and transformation of bearing beams, columns, plates and infrastructure;

(2) Dismantling the load-bearing wall or excavating wall cabinets, doors and windows on the load-bearing wall;

(three) more than the design standard to increase the load;

(four) digging holes or expanding holes in the floor structure layer;

(five) to increase the use space of the house and reduce the floor elevation of the house;

(six) the demolition of shopping malls, hotels, restaurants, theaters, stadiums and other large buildings with overall seismic and fire prevention functions.

Where the acts mentioned in the preceding paragraph should be licensed by other administrative departments according to law, such provisions shall prevail. Article 7 To apply for a permit, the following materials shall be submitted to the district or county real estate administrative department where the house is located:

(1) An application for permission;

(two) the identity certificate of the owner or user of the house;

(three) the registration certificate of the ownership of the house, and if the applicant is the user, it shall also submit the certificate that the owner of the house agrees to the structural change of the house;

(four) involving * * * parts, it shall provide proof that * * * users agree to replace;

(five) the design scheme issued by the original design unit of the house or the design unit with corresponding qualification grade. If the application for permission to demolish and change does not involve the supporting structure and foundation structure of the main building such as beams, columns and slabs, and there is no design scheme, a feasibility assessment report issued by a legally established housing safety appraisal agency may be provided.

Design units and housing safety appraisal institutions shall be responsible for the scheme issued by them. Eighth district and county real estate administrative departments shall, after receiving the application, conduct a preliminary examination of the application materials. If the application materials do not meet the requirements, it shall inform the corrected materials at one time; If the application materials meet the requirements, it shall put forward preliminary examination opinions within five days from the date of accepting the application and report to the municipal real estate administrative department for examination and approval. Ninth city real estate administrative departments shall, within fifteen days from the date of receiving the materials submitted by the district and county, make a decision on whether to grant the license. In line with the conditions, the issuance of "housing structure change approval"; If it does not meet the requirements, it shall inform the applicant in writing and explain the reasons. Tenth real estate administrative departments should supervise the licensed house demolition and renovation activities, and stop them in time when they find hidden dangers, order them to make corrections and take remedial measures.

The applicant shall carry out the construction in strict accordance with the approved scheme. Eleventh units selling houses shall inform the buyers in writing of the main structure, load-bearing structure, seismic and fire-proof structure and design service life, and hand over the building materials to the pre-property management enterprises in accordance with the regulations.

The prophase property management enterprise shall properly keep the building materials, and inform the house owner or user of the behaviors and precautions that need to be licensed according to law in the use of the house. After the establishment of the owners' committee or the replacement of the property management enterprise, the building materials shall be handed over according to law.

When the house is transferred or leased again, the transferor or lessor shall inform the transferee or lessee in writing of the main structure, load-bearing structure, earthquake-resistant fire-proof structure and design service life of the house.

The owner or user of the house has the right to inquire about the main structure, load-bearing structure, earthquake-resistant fire-proof structure and design service life of the house from the selling unit, property management enterprise, transferor (lessor) or urban construction archives institution before the renovation of the house, and the inquired person has the obligation to cooperate with the inquiry. Twelfth housing property units should carry out safety inspection and maintenance of houses and their ancillary facilities, do a good job in housing safety inspection records, and establish housing safety management files.

Property management enterprises or residents' committees shall discourage illegal use and decoration of houses and report to the local real estate administrative departments in a timely manner.

If the house has a curtain wall, its owner or user shall regularly inspect and maintain the curtain wall in accordance with state regulations, and report the inspection and maintenance results to the district or county real estate administrative department where the house is located for the record.
