I. Scope of application of the Regulations

The "Regulations" apply to the management of motor vehicle parking in the urban residential property management area of Liaoning Province. The following three situations do not apply to the Regulations:

1, non-residential use, such as office buildings, shopping malls and other underground and surrounding areas for motor vehicle parking;

2. Areas without property management services;

3. Management of non-motor vehicles such as bicycles and electric bicycles.

Second, providing parking spaces for community owners has become the obligation of relevant units.

Article 74 of the Property Law stipulates that parking spaces and garages planned for parking cars within a building division should first meet the needs of owners. However, with the increasing number of private cars in residential quarters, the parking spaces planned for parking can't meet the needs of owners in residential quarters, and the problem of parking is puzzling owners and property management service enterprises. In order to solve this problem, Articles 3 and 4 of the Regulations make it clear that the public security organs have the obligation to assist and guide the owners' assembly and the property service enterprises to set up temporary and night parking spaces for the owners of residential areas, and the property service enterprises will implement management.

Three, "motor vehicle parking management statute" is the basis for the implementation of management of property service enterprises.

Management regulations are different from property service contracts. It is formulated by the construction unit or the owners' congress according to the Property Law and the Property Management Regulations, and entrusted to the property service enterprise for management. The entrusted expenses shall be borne by the owners who need parking spaces.

Four, the entrusted property service enterprises have the following obligations:

1. Arrange a certain number of vehicle administrators. Vehicle administrators should fulfill their duties, make patrol records and hand-over records, and it is strictly forbidden to leave their posts without authorization; Civilized duty, enthusiastic service, timely command vehicle parking, and maintain vehicle parking order.

2. Draw a parking line for special parking spaces to keep the roads unobstructed and the site clean and sanitary. Command motor vehicles with special parking spaces to park in designated parking spaces.

3. Command car owners and outsiders who have no special parking spaces to park their vehicles in temporary parking spaces.

4, command vehicles parked in the residential property management area, shall not cause obstacles to the passage of other vehicles and the use of other parking spaces.

5, it is forbidden to command vehicles parked in the fire escape.

6, in the process of daily inspections found that the owners have disorderly stop misplacing behavior, property services companies and administrators should promptly discourage. If dissuasion is ineffective, it shall immediately report to the owners' committee, community committee and relevant administrative departments.

Owners in the property management area have the obligation to take care of all special equipment and public facilities such as fire fighting, water supply, power supply and communication in the parking space. The "Regulations" made it clear for the first time that property management enterprises should be liable for the management faults caused by motor vehicles in residential property management areas. This clause provides a legal basis for the owner to claim rights. But the owner should pay attention to the following two points when claiming this right:

1. There must be evidence to prove that the property management enterprise has not fulfilled the six management obligations listed in Item 4 of this article, and at the same time, it should combine the obligations of 24-hour access control, night patrol, video surveillance and so on that the property management enterprise should undertake as stipulated in the property service contract. , that is, management fault.

Interim Measures for the Administration of Vehicle Parking in Chengdu Residential Property Management Area

Article 1 These Measures are formulated in accordance with the Regulations of the State Council Municipality on Property Management and other relevant laws and regulations in order to regulate the parking order in residential property management areas and protect the legitimate rights and interests of both parties in vehicle parking management.

Article 2 These Measures shall apply to the parking and management of motor vehicles and non-motor vehicles within the residential property management area of this Municipality.

Article 3 Motor vehicle parking facilities within the residential property management area shall be managed according to the following principles:

(a) motor vehicle parking facilities (including ground parking garage, underground parking garage, three-dimensional parking garage, etc.). ) by the construction unit according to the planning requirements, provided to the owners and users in the property management area; If it has not been sold, it shall be rented out and shall not be idle.

(two) no unit or individual may use the site enjoyed by the owners according to law to sell the parking spaces for parking vehicles. If the construction unit owns the ownership of the parking lot and garage, if the parking space is transferred, the transferee shall be the owner of the property management area; The owner of the rented parking space enjoys the preemptive right of the parking space. The construction unit shall not sell or lease the parking space to others outside the residential property management area before meeting the parking demand of the owners in the residential property management area.

(3) If there is a parking space, it can be temporarily rented to units or individuals outside the property management area. When leasing, both parties shall stipulate in the parking space lease contract that when the owner or user in the residential property management area needs to use it, the lessor may terminate the contract and recover the leased parking space. However, the lessor shall notify the lessee in writing one month before the termination of the contract.

(four) the establishment of parking spaces in the residential property management area according to law shall comply with the provisions of the national traffic facilities safety standards, and shall not occupy fire exits or hinder the passage of pedestrians and other vehicles.

Article 4 The parking of non-motor vehicles within the residential property management area shall be managed according to the following principles:

(1) Non-motor vehicle owners and users shall park in designated places in an orderly manner.

(two) to undertake professional maintenance of municipal public facilities, housing decoration and other non-motor vehicles, should be parked in the designated position in an orderly manner.

Article 5 Where a property management enterprise provides parking management services within the residential property management area, it shall stipulate in the property service contract. If the property service contract does not stipulate parking management, the owners' meeting or the owners in the property management area shall decide the parking management plan in the residential property management area in accordance with the relevant provisions.

Article 6 A property management enterprise or other parking management unit (hereinafter referred to as the parking management unit) entrusted to provide parking management services shall meet the following conditions:

(a) comply with the relevant policies and regulations of parking management in this Municipality and the resolutions of the owners' meeting, etc. ;

(two) to fulfill the parking management agreement related to the property service contract;

(three) to formulate the management system of vehicle parking, including the responsibilities of the parking management unit, the management scheme of parking spaces and temporary passages for vehicles, and the disposal scheme of emergencies;

(four) install traffic signs on the ground and the wall to guide the vehicles to travel according to the prescribed route;

(five) there is a special person to register the vehicles entering and leaving the residential property management area, check the condition of the vehicles when entering and leaving, issue a parking certificate, and release them after leaving;

(six) to maintain the parking order of vehicles in the residential property management area and ensure that the vehicles are clean and smooth;

(seven) the parking lot is manned 24 hours a day or continuously monitored by electronic monitoring means, to discourage and stop the damage to parked vehicles, and to take effective preventive measures to prevent the loss of parked vehicles.

Seventh vehicle parking fees in accordance with the relevant provisions of the government price department.

Public security, fire fighting, emergency rescue, ambulance, sanitation, military, postal and other special motor vehicles shall not be charged when they are parked in the residential property management area.

In the residential property management area, the use of * * * facilities legally enjoyed by the owners for vehicle parking belongs to the owners' income and belongs to the owners who jointly own the property with * * *, which is mainly used to supplement the special maintenance funds, and can also be used for the activities of the owners' meeting, the owners' committee or other needs in property management according to the decision of the owners' meeting.

Article 8 Vehicle parking persons shall comply with the following provisions:

(a) abide by the resolutions of the owners' meeting, the owners' convention, the temporary convention of the owners and the parking management system in the residential property management area, and obey the command of the parking management personnel;

(two) the parking of vehicles shall not occupy the fire escape, shall not interfere with the use of fire control facilities, shall not affect the normal passage of pedestrians and other vehicles, and shall not park motor vehicles in other people's parking spaces without authorization;

(3) Paying parking fees according to regulations or agreements.

Article 9 In addition to temporarily entering and leaving the residential property management area to park vehicles, other motor vehicle parking people shall conclude a motor vehicle parking management service agreement with the parking management unit, which shall generally include the basic information of both parties' motor vehicles, the rights and obligations of both parties, the charging price, the management responsibility, the management service period and the liability for breach of contract.

Article 10 The parking lot management unit within the residential property management area shall timely maintain the parking lot, roads and related facilities and equipment to ensure the normal use.

If the parking space in the residential property management area cannot meet the needs of vehicle parking, the parking management unit shall, after obtaining the consent of the owners' congress, take measures to improve the utilization rate of parking spaces in light of the actual situation.

Eleventh vehicles are not parked in accordance with the provisions, affecting the smooth flow of roads or public safety in the residential property management area, the parking management unit can deal with it in accordance with the vehicle parking management service contract, the owners' convention, the temporary owners' convention or the resolutions of the owners' general meeting.

I. Regulations on Vehicle Management

5. All kinds of vehicles shall not be parked on the road of XXX project at will. Vehicles temporarily entering the XXX project should be parked at the designated place, and it is strictly forbidden to park at the road intersection.

6. For all vehicles parked in the parking lot, the owner must close the doors and windows and take away valuables. If the parking management personnel find that the doors and windows of the vehicle are not closed properly, they should inform the owner in time to prevent the items in the vehicle from being lost.

7. The parking lot only provides paid use of venues and parking spaces, and is not responsible for the custody of vehicles. If the vehicle is lost or damaged, the parking lot is not responsible for compensation.

8. Vehicles entering the XXX project should slow down, and the maximum speed shall not exceed the provisions of the speed limit sign of XXX project. When entering and leaving the parking lot, vehicles coming from the opposite side should come in first and then out.

9.XXX project parking lot is not allowed to learn to drive a motor vehicle, and it is forbidden to test drive and honk at will.

10. Taxis entering the XXX project are also allowed to enter and exit by the meter. Taxis are not allowed to enter the XXX project after 22: 00 pm. Foreigners should not be allowed to take taxis.

Vehicles entering the XXX project should be kept clean to ensure that the roads are not polluted; Without the permission of XXX property services, large motor vehicles with a capacity of more than 5 tons are not allowed to enter the XXX project. Vehicle parking must obey the command of management personnel, pay attention to the safety of vehicles before and after, and must not be parked on green belts and pedestrian walkways.

12. Vehicles loaded with decoration materials should stop at designated places to load and unload materials, and the traffic of XXX project shall not be affected. Vehicles loaded with decoration materials must show the owner's written certificate before leaving XXX project.

13. All vehicles entering and leaving the XXX project should use the vehicle access card. The gatepost shall record the time of vehicle entry and exit, the license plate number and the name or job number of the gatepost security guard on the card, and register the foreign vehicles on the duty record.

14. The vehicle access card in use should be properly kept, archived and not lost.

Second, parking rules.

This specification is formulated to standardize the use and management of parking lots and create a standardized shopping environment.

1, monthly car rental mainly pays various fees before the end of each month; The parking card is for personal use and cannot be lent to others.

2. The temporary parking of vehicles shall be charged first, and the vehicles shall be released after checking the invoices when they leave the site.

3. Car owners who rent a car for one month can only park their vehicles within their monthly parking spaces. Temporary parking vehicles must be parked at the designated place by the parking lot safety officer.

4. The parking lot can only be used for parking, not for vehicle maintenance, goods storage or other purposes.

5. Smoking is strictly prohibited in the parking lot, and refueling is strictly prohibited in the parking lot.

6. Vehicles loaded with inflammable, explosive, toxic or dangerous goods shall not be parked in the parking lot.

7. In the parking lot, you must follow the speed limit and the route specified in the parking lot.

8, driving in the parking lot must pay attention to safety, so as not to damage the parking lot facilities and other vehicles, if there is any damage, XXX property services have the right to claim compensation from the damaged person.

9. If the owner loses his parking card, he shall immediately notify XXX Property Services, who will issue a new parking card after charging a certain handling fee.

10, this office is not responsible for keeping the items attached to the vehicle.

Three, XXX property services handling goods management regulations

Location of loading and unloading area:

1, 1/F east loading area is used to load and unload goods for "XX family";

Management of loading and unloading areas:

1. When loading and unloading goods in the shopping mall, the goods must be loaded and unloaded in the designated loading and unloading area, and the passage shall not be blocked;

2. All loading and unloading vehicles in and out must obey the unified management of the shopping mall, and must not be parked and placed indiscriminately;

Don't leave any goods, articles, boxes, etc. Cover the above places at the entrance of the mall, stairs, platforms or any passage or elevator.

4. All goods and articles can only be loaded, unloaded and transported in special cargo loading and unloading platforms, passages and elevators at the time specified by XXX Property Services.

5. Before the furniture, equipment and devices in the store move out of the store, it is necessary to obtain the written consent of XXX Property Services in advance and move out from the designated exit with the release form issued by XXX Property Services.

6. When using the elevator to transport goods:

(1), do not overload or transport dangerous goods.

(4) If the goods are sharp objects, they should be padded to avoid scratching the elevator.

Fourth, vehicle management standards

4. Vehicles entering the parking lot are subject to the management of the property management company;

5. Vehicles or trucks loaded with more than 2.5 tons of flammable, explosive, toxic or polluting substances are not allowed to enter;

6. Vehicles entering the parking lot must slow down, the speed shall not exceed 15km/h, and no horns shall be sounded (except ambulances, police cars and fire engines);

7. All vehicles in the parking lot are included in the management scope of the property management company, and the vehicle licenses are complete and the licenses/tickets are released;

8. Vehicle management personnel are polite, enthusiastic and thoughtful;

9. The vehicle administrator is familiar with the owner's name, model, license plate number, house number and parking space;

10. The vehicle management personnel shall check the parking situation and condition of the vehicle at any time, and notify the owner within 10 minute if they find that the doors and lights are unlocked, leaking oil and water, etc.

8. Prevent unauthorized motor vehicles or parking spaces from using the garage.

9. Stop vehicles loaded with inflammable, explosive and dangerous goods from entering the parking lot, and report to the monitor or supervisor immediately when problems are found.
