Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Price Law of People's Republic of China (PRC), Regulations on Property Management, Several Provisions on Property Management of Xiamen and other laws and regulations, combined with the actual situation of this Municipality, in order to regulate the charging behavior of property services and safeguard the legitimate rights and interests of owners, property users and property service enterprises. Article 2 These Measures shall apply to the behavior of charging property services within the administrative area of this Municipality and its supervision and management. Article 3 The term "property service charges" as mentioned in these Measures refers to the acts that property service enterprises collect or collect the following fees on their behalf according to the provisions of these Measures and the property service contract:

1. Property service fee, parking space (garage) property service fee;

3. Daily special maintenance funds;

4 construction waste land clearing fees, special service fees, utilities fees and other expenses. Article 4 Property service charges shall follow the principles of legality, reasonableness, openness, honesty and credibility, and consistency between quality and price.

Property service charges should be based on market-regulated prices, supplemented by government-guided prices, distinguishing the nature and characteristics of different properties, and implementing market-regulated prices and government-guided prices respectively. The district price department shall, jointly with the construction department at the same level, be responsible for the supervision and management of property service charges within its jurisdiction in accordance with the price management authority, and accept the business guidance of the superior competent department. Chapter II Management of Property Public Service Fees Article 6 The term "property public service fees" as mentioned in these Measures refers to the fees charged by property service enterprises from owners and property users for daily management, maintenance, greening and maintenance, environmental sanitation and cleaning, public order maintenance and security assistance of houses and supporting facilities and related sites within the property management area in accordance with the property service contract. The municipal price department shall, jointly with the municipal construction department, evaluate the implementation of the published property service level standard and the government-guided price of property service fees every 2 years. In the process of evaluation, public opinions should be sought through questionnaires, symposiums and demonstration meetings. If it needs to be adjusted after assessment, it should be adjusted in time. For residential projects of the same property type in the same property management area, the standards of property service fees should be basically the same. The standard of property service fee is stipulated in the purchase contract. Tenth residential property public service fees take the form of contract system. After the establishment of the owners' congress, it can take the form of contract system and expiration fee system, and the specific fee form is agreed in the property service contract.

The contract responsibility system mentioned in the preceding paragraph refers to the way that the owners pay a fixed property service fee to the property service enterprise, and the profits and losses are borne by the property service enterprise; The contract gratuity system refers to the method of charging property services by paying the contract gratuity to the property service enterprise according to the agreed proportion or amount from the property service fees received in advance, and the rest is used for the fees agreed in the property service contract, and the balance or deficiency is enjoyed or borne by the owner. Eleventh the implementation of government-guided property public service costs are mainly composed of the following items:

1. Wages of property service personnel, union funds and employee education funds drawn according to regulations, housing accumulation fund and social insurance premiums that should be paid by property service enterprises according to law;

2. The daily operation, maintenance and annual safety inspection expenses of the parts and facilities used in the property * * *, but excluding the maintenance expenses that should be paid by the construction unit during the warranty period and the maintenance, renewal and transformation expenses that should be paid by the special maintenance funds;

Green tools purchase fee, nursery stock supplement fee, pesticide and fertilizer fee and other green maintenance fees, but not including nursery stock planting fee and early maintenance fee that should be paid by the construction unit;

4. Purchase cleaning tools, disinfection and epidemic prevention fees, septic tank cleaning fees, pipeline dredging fees, cleaning materials fees, secondary water supply tank cleaning and disinfection fees and other cleaning and sanitation fees;

5. Equipment fees, personal insurance fees for security personnel, clothing fees and other expenses for maintaining order paid by the realty service enterprise. , in which the equipment does not include the monitoring equipment included in the equipment used by * * * *;

6. Insurance fees for parts, facilities and equipment of the property and public liability insurance fees;

Office expenses such as office supplies, transportation expenses, rent, utilities, communication fees, etc. required for normal property management activities;

8. When a realty service enterprise manages multiple realty projects, the management fee shared by the realty service community is to ensure the normal operation of related realty services;

9. The depreciation of assets owned by the realty service enterprise and directly related to the realty service with a service life of more than 0 years shall be accrued by the realty service enterprise within the realty management area according to the stipulated depreciation method.

The cost of property service fees subject to market-regulated prices may be stipulated in the property service contract with reference to the provisions of the preceding paragraph.
