Measures of Taizhou Municipality on the Collection and Management of Urban Garbage Disposal Fees

Article 1 In order to realize the reduction, recycling and harmlessness of garbage disposal, and protect and improve the ecological environment, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, the Regulations on the Administration of Urban Appearance and Environmental Sanitation, the Regulations on the Administration of Urban Appearance and Environmental Sanitation of Jiangsu Province and other laws and regulations, and in combination with the actual urban areas. Article 2 These Measures shall apply to the collection, use and management of urban garbage disposal fees in the urban areas of this Municipality.

The term "urban garbage" as mentioned in these Measures refers to the solid waste generated in the daily life of the city or providing services for daily life (excluding medical waste, industrial solid waste, hazardous waste and plant waste). Specifically, it is divided into domestic garbage, production and operation garbage and building decoration garbage. Article 3 In accordance with the principle of "whoever produces pays", a charging system shall be implemented for the treatment of urban garbage to compensate the cost of harmless centralized treatment of urban garbage.

Urban garbage disposal fees refer to the collection, transportation and disposal fees generated by transporting urban garbage from garbage transfer stations or designated garbage collection sites to garbage disposal sites for harmless centralized treatment. Fourth city garbage disposal fees for administrative fees, the city management department is responsible for the collection. Among them, the collection of urban garbage disposal fees within the scope of Hailing District is implemented by the environmental sanitation management institution of the municipal urban management department. The collection standard of urban garbage disposal fee shall be formulated separately by the municipal government. Fifth city garbage disposal fees can be entrusted to institutions with public management or social service functions. Commissioned by the collection of urban garbage disposal fees, the urban management department and the entrusted collection unit signed an entrusted collection agreement, and the urban management department paid a 5% handling fee to the entrusted collection unit, which was extracted from the urban garbage disposal fee. Article 6 State organs, enterprises, institutions, armed forces, social organizations, individual operators (hereinafter referred to as units) and residents (including permanent and temporary residents) shall pay the urban garbage disposal fees in accordance with the provisions of these Measures. Seventh urban management departments and their entrusted collection units shall not expand the collection scope and raise the collection standards of urban garbage disposal fees. No unit or individual is allowed to reduce or exempt at will. Eighth city garbage disposal fees shall be turned over to the state treasury in full and included in the budget management. The urban management department and its entrusted collection unit shall uniformly use the special bills supervised by the financial department. Ninth families of poor workers, minimum living security objects, key pension and preferential treatment objects and legally recognized public welfare units are exempt from domestic garbage disposal fees. Tenth units and residential areas that implement property management, the property service enterprises are responsible for the management of environmental sanitation and domestic garbage collection in the area, and transport the domestic garbage to the garbage transfer station or garbage collection place designated by the environmental sanitation management institution of the urban management department; Units and residential quarters that have not implemented property management shall set up domestic garbage collection places in accordance with the requirements of environmental sanitation management institutions of urban management departments.

Villagers' committees and residents' committees in agriculture-related communities are responsible for environmental sanitation cleaning and domestic garbage collection within their respective regions, and shall transport the generated domestic garbage to garbage transfer stations or garbage collection places that meet the requirements of environmental sanitation management institutions of urban management departments.

Environmental sanitation management agencies are responsible for transferring domestic garbage from garbage transfer stations or garbage collection sites to garbage disposal sites. Eleventh units and individuals should take the initiative to pay the city garbage disposal fee, not in accordance with the provisions of these measures to pay the city garbage disposal fee, the urban management department issued a collection decision, ordered to pay within a time limit. If it fails to pay within the time limit, the urban management department may impose a fine of less than 3 times and not more than 30 thousand yuan on the unit; Individuals can be fined less than 3 times and not more than 1000 yuan for urban garbage disposal.

In arrears with the urban garbage disposal fee, a late fee of 3‰ of the urban garbage disposal fee may be charged on a daily basis; Refuses to pay, the city management department shall apply to the people's court for compulsory execution. Twelfth municipal and district people's governments shall establish a credit system for the collection of urban garbage disposal fees, increase the punishment for dishonesty in the payment of urban garbage disposal fees, and incorporate it into the government credit information system at the corresponding level. Article 13 When the urban management department needs to investigate the relevant information of the units and individuals to be collected when collecting the urban garbage disposal fee, the departments and organizations such as public security, finance, administrative examination and approval, market supervision and management, urban and rural housing construction, natural resources planning, human resources and social security, civil affairs, veterans affairs, trade unions and so on shall cooperate and provide relevant information according to law. Fourteenth urban management departments and their entrusted collection units shall be levied according to law. If the relevant units and their staff members commit any of the following acts, they shall be punished by the relevant functional departments or their superior competent departments and supervisory organs according to law, and if the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) Charging fees without valid certificates;

(two) to change the scope and standard of fees without authorization;

(three) unauthorized relief of urban garbage disposal fees;

(four) interception, misappropriation of urban garbage disposal fees;

(five) other acts of abuse of power, favoritism and dereliction of duty. Article 15 These Measures shall come into force as of 202 1 1 day. The Notice of Taizhou Municipal People's Government on Printing and Distributing the Measures for the Collection of Urban Garbage Disposal Fees in Taizhou (Thai Government Regulation [2009]11No.) shall be abolished at the same time.
