Xi measures for the administration of smoking control

Article 1 In order to reduce and eliminate the harm of tobacco smoke, safeguard public health, create a good working and living environment, and improve the level of social civilization, these measures are formulated in accordance with the Regulations on Hygiene Management in Public Places, the Regulations on Patriotic Hygiene in Shaanxi Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to smoking control within the administrative area of this Municipality. Article 3 Smoking control shall follow the principles of government leading, departmental cooperation, unit responsibility and public participation. Article 4 The municipal, district and county people's governments shall strengthen their leadership over smoking control, incorporate smoking control into the national economic and social development plan, ensure the financial investment in smoking control, and promote the construction of smoking control system.

The municipal health and family planning administrative department is the administrative department in charge of smoking control in this Municipality, and is responsible for organizing and coordinating the management of smoking control in this Municipality. The county-level health and family planning administrative departments shall be responsible for the organization and coordination of smoking control management within their respective administrative areas.

The town people's government and sub-district offices shall, in accordance with the principle of territorial management, cooperate with relevant administrative departments to do a good job in smoking control within their respective jurisdictions. Article 5 The supervisory and administrative departments related to smoking control shall be responsible for the publicity, education, daily management and supervision of smoking control according to the following division of labor, and impose penalties on acts violating these Measures:

(a) education, human resources and social security, civil affairs and other administrative departments are responsible for the control of smoking in schools, preschool education institutions, education and training institutions and social welfare institutions;

(two) the food and drug supervision and management department is responsible for the control of smoking in catering establishments and drug sales establishments;

(3) The public security organ is responsible for smoking control in the business premises of Internet service;

(four) the administrative department of culture, radio, film and television press and publication is responsible for the control of smoking in public places such as libraries, cultural centers, entertainment places and theaters;

(five) the urban management department is responsible for the control of smoking in public places within its jurisdiction;

(six) the traffic administrative department and the urban rail transit business unit shall, in accordance with their respective responsibilities, be responsible for the control of smoking in public transport and related public places;

(seven) the administrative departments of cultural relics and religion are responsible for the supervision of smoking control in cultural relics protection units, museums and other places, and the administrative departments of sports and tourism are responsible for smoking control in public sports venues and A-level tourist attractions;

(eight) the administrative department of property management and the administrative committee of the Development Zone shall, according to their respective duties, be responsible for the smoking control of public elevators in the property management area;

(nine) the administrative department of health and family planning is responsible for the control of smoking in medical and health institutions at all levels and other public places other than items 1 to 8 of this paragraph.

The administrative department or institution is responsible for the daily supervision and management of the smoking control work of the administrative organ.

Airport and railway management institutions shall, in accordance with the relevant provisions of the state, supervise and manage the smoking control work in airports, railways and related public places. Article 6 The funds needed for the supervision and management of smoking control shall be included in the financial budget by the municipal, district and county people's governments, Xixian New Area and the Development Zone Administrative Committee, and shall be guaranteed. Article 7 The legal representative or principal responsible person of state organs, enterprises, institutions, social organizations and other social organizations in this Municipality is the first responsible person in the smoking control work of this unit, and is fully responsible for the smoking control work of this unit.

The person in charge of the smoking control place shall manage the smoking control work in this place and cooperate with the relevant administrative departments to do a good job in the supervision and management of smoking control in this place. Eighth advocate and encourage the establishment of smoke-free units.

Smoking control should be regarded as one of the conditions for the selection of civilized units in this city. Article 9 Volunteer organizations, other social organizations and individuals are encouraged to participate in or support smoking control through various forms. Article 10 The week of May 3 1 every year is the city-wide publicity week on smoking control, focusing on the publicity activities on the health hazards of tobacco smoke.

Advocate the sellers of tobacco products to stop selling cigarettes for one day and smokers to stop smoking for one day on May 3rd1.

Public media such as radio, television, newspapers, and the Internet should publicize the harmful effects of tobacco smoke on health. Eleventh indoor public places, public transport and outdoor areas of the following public places are completely prohibited from smoking:

(1) Outdoor areas of nurseries, child welfare institutions, primary and secondary schools, children's parks, activity centers, education and training institutions and other public places. Among them, minors are the main activity groups;

(two) outdoor areas of maternal and child health care institutions and medical and health care institutions that mainly provide medical services for pregnant women and children;

(3) Outdoor audience seats in sports and fitness venues and venue areas;

(four) other outdoor places where smoking is prohibited as stipulated by laws and regulations.

Smoking rooms or smoking areas shall not be set up in places where smoking is prohibited as stipulated in the preceding paragraph. Operators and managers of no-smoking places may, according to their needs, set up smoking places at appropriate positions around no-smoking areas. Twelfth outdoor areas of the following public places can be set up smoking spots, and smoking outside the smoking spots is prohibited:

(1) Outdoor areas of pension institutions and other social welfare institutions other than child welfare institutions;

(2) Outdoor areas outside medical and health institutions that mainly provide medical services for pregnant women and children;

(3) Outdoor areas of scenic spots, cultural relics protection units, amusement parks and other parks except children's parks;

(four) other outdoor controlled smoking places that can set up smoking spots as stipulated by laws and regulations.
