Does the county-level housing management office have the right to manage property enterprises?

Provisions on the right to operate property enterprises are as follows:

1 Article 5 of the Regulations on Property Management stipulates that "the real estate administrative departments of local people's governments at or above the county level shall be responsible for the supervision and management of property management activities within their respective administrative areas". Article 4 of the Measures for the Administration of Property Service Charges stipulates that "the price departments of local people's governments at or above the county level shall be responsible for the supervision and administration of property service charges within their respective administrative areas jointly with the real estate administrative departments at the same level". Article 5 of the Measures for Undertaking Property Inspection stipulates that "the real estate administrative departments of local people's governments at or above the county level shall be responsible for guiding and supervising the property undertaking inspection activities within their respective administrative areas".

2. Article 8 of the Guiding Rules for Owners' Congress and Owners' Committee stipulates that "in the property management area, when the delivered exclusive part area exceeds 50% of the total construction area, the construction unit shall, in accordance with the requirements of the district/county real estate administrative department or subdistrict office or township people's government where the property is located, submit the following documents and materials in time for preparing for the first meeting of the owners' congress; (2) A list of the area of houses and buildings; (3) List of owners; (four) the general plan of building planning; (five) the delivery certificate of the facilities and equipment used in * * * *; (six) the property service room configuration certificate; (7) Other relevant documents.

3. Notice of the Ministry of Housing and Urban-Rural Development and other departments on strengthening and improving residential property management (Jian Gui [2020] 10) stipulates (1) Insist on and strengthen the Party's leadership over property management. Promote the establishment of party organizations by owners' committees and property service enterprises. Establish a cooperative operation mechanism of community neighborhood committees, owners' committees and property service enterprises under the guidance of party building, fully mobilize the enthusiasm of residents to participate, and form a joint force of community governance.
