Should I pay the property fee if the property contract is invalid?

Legal subjectivity:

Don't pay the property fee without signing the property contract. The owners' committee has not signed a written property service contract with the property company, but the owners actually accept the property service, and the owners shall pay the corresponding fees to the property company according to the actual service price. According to the first and second paragraphs of Article 944 of the General Principles of Civil Law, the owner shall pay the property fee to the property service provider as agreed. If the property service provider has provided services in accordance with the agreement and relevant regulations, the owner shall not refuse to pay the property fee on the grounds that he has not accepted or does not need to accept the relevant property services. If the owner fails to pay the property fee within the time limit in violation of the agreement, the property service provider may urge him to pay it within a reasonable period of time; If the payment is not made within a reasonable period, the property service provider may bring a lawsuit or apply for arbitration.

Legal objectivity:

After the expiration of Article 948 of the General Principles of Civil Law of People's Republic of China (PRC), if the owner fails to make a decision to renew or hire other property service providers according to law, and the property service providers continue to provide property services, the original property service contract will remain valid, but the service period will be indefinite. Both parties may terminate the indefinite property service contract at any time, but shall notify the other party in writing 60 days in advance.
