Full text of Jilin Province Property Management Regulations

The Regulations of Jilin Municipality on Property Management (AnnouncementNo. 139 of the Standing Committee of the 13th Jilin Municipal People's Congress) was adopted at the 2nd1meeting of the 13th Jilin Municipal People's Congress on September 22nd, 2005, and approved at the 24th meeting of the Standing Committee of the 10th Jilin Provincial People's Congress on October 24th, 2005. It is hereby promulgated.

Chapter I General Principles

Article 1 In order to standardize property management activities and safeguard the legitimate rights and interests of property owners and property management enterprises, these Regulations are formulated in accordance with the "Regulations on Property Management" of the State Council and relevant laws and regulations, combined with the actual situation of this Municipality.

Article 2 These Regulations shall apply to property management activities within the administrative area of this Municipality.

Third city real estate administrative departments responsible for the supervision and management of the city's property management activities. Responsibilities are:

(a) the implementation of laws, regulations and rules related to property management.

(two) responsible for the qualification management of property management enterprises.

(three) responsible for the guidance and supervision of property management bidding activities.

(four) responsible for guiding, coordinating and supervising the management and use of special maintenance funds for * * * parts and * * * facilities and equipment in the urban areas of this Municipality (hereinafter referred to as special maintenance funds).

(five) responsible for the division of the city's property management area.

(six) to accept complaints about property management and investigate and deal with illegal cases of property management.

Its property management office is responsible for daily work.

Article 4 The administrative departments designated by counties (cities) and district governments shall be responsible for the supervision and management of property management activities within their respective jurisdictions. Responsibilities are:

(a) the implementation of laws, regulations and rules related to property management.

(2) Organizing the first owners' meeting.

(three) to supervise the undertaking, handover and use of the property.

(four) responsible for the owners' meeting, the owners' committee related information and property service contract filing management.

(5) Accepting complaints about property management.

County (city) property management administrative departments shall, in addition to the duties specified in the preceding paragraph, also undertake the guidance and supervision of the bidding activities of property management within their respective jurisdictions, guide, coordinate and supervise the management and use of special maintenance funds, the division of property management areas and the investigation and punishment of illegal cases of property management.

Fifth construction, planning, municipal utilities, environmental protection, public security, urban management and law enforcement departments and neighborhood offices (township governments) should do a good job in property management according to their respective responsibilities.

Sixth new residential areas must implement property management.

The original residential property shall be subject to property management, and according to the wishes of the owners, property management enterprises or franchise companies may be entrusted to implement special services.

Non-residential property should gradually implement property management.

Chapter II Owners and Owners' Congress

Article 7 The owner of the house is the owner; All the owners of a property management area form the owners' meeting; The owners' congress elects the owners' committee, which is the executive body of the owners' congress.

The rights, obligations and responsibilities of the owners, the owners' congress and the owners' committee shall be implemented in accordance with the relevant provisions of the Regulations of the State Council Municipality on Property Management.

Eighth owners occupancy rate reached more than 50% of the total construction area of the property management area, the county (city), district property management administrative departments shall timely organize the first owners' meeting.

Article 9 The owners' congress shall decide by voting.

The voting rights of residential property owners are calculated by sets, and each set of houses has one vote.

The voting right of non-residential property is calculated according to the construction area. 100 square meters or less has 1 ticket, and every time it exceeds 100 square meters, it is counted as 1 ticket.

Tenth residential areas without property management, with the written consent of more than two thirds of the owners, can implement property management or special services.

Chapter III Property Management Enterprises

Eleventh property management companies to obtain the qualification certificate, engaged in property management activities within the scope of the qualification level approved.

Twelfth property management enterprise managers to obtain the national vocational qualification certificate, can engage in property management activities.

Thirteenth property management enterprises shall enjoy the following rights:

(a) to collect property service fees in accordance with the provisions of the property service contract.

(two) according to the entrustment of the owners, to provide services other than those stipulated in the property service contract, and collect relevant fees.

(3) Choose a franchise company to undertake special services.

Article 14 A property management enterprise shall perform the following obligations:

(1) Providing services according to the service contents and standards agreed in the property service contract. Special invoices should be used when collecting property service fees.

(two) to announce the payment and use of property service fees by owners every six months.

(three) to listen to the opinions and suggestions of the owners, the owners' congress and the owners' committee on the relevant property management activities, and accept supervision.

(4) On behalf of the owner, ask the owner to stop the infringement, restore to the original state, and compensate for the losses caused by the damage to the parts and facilities of the property.

(five) in a timely manner to stop violations of public security, fire protection, environmental protection, decoration and other provisions of the act, and report to the relevant departments.

(six) the establishment of property * * * parts, * * facilities and equipment use, public * * * order, environmental sanitation maintenance, emergency handling and other aspects of the rules and regulations.

(seven) to establish and improve the internal financial revenue and expenditure, property maintenance ledger, archives and other internal management systems of property management enterprises.
