Regulations of Lanzhou Municipality on Property Management (2020)
The term "property management" as mentioned in these Regulations refers to the activities of the owners to maintain, conserve and manage the buildings, structures and their supporting facilities, equipment and related sites within the property management area through self-management or entrusting property service providers to make joint decisions, and to maintain environmental sanitation and related order. Property service providers include property service enterprises and other property managers. Article 3 Property management in this Municipality follows the principles of owner autonomy, professional service, community guidance and government supervision. Article 4 The municipal and district (county) people's governments shall strengthen the organization and leadership of property management within their respective administrative areas, incorporate property management into the development planning of modern service industry and the community governance system, encourage the adoption of new technologies and methods to improve the level of property service, and promote the standardization and marketization of property service management. Lanzhou New District Administrative Committee and Lanzhou High-tech Industrial Development Zone Administrative Committee shall do a good job in organizing and leading the property management within their respective jurisdictions.
Neighborhood offices and township (town) people's governments are responsible for guiding and coordinating the establishment of the owners' congress and the election of the owners' committee, as well as the daily activities of the owners' congress and the owners' committee, mediating disputes over property service management, and cooperating with the administrative departments of housing and urban and rural construction to supervise and manage property service management activities.
Community residents' committees (villagers' committees) shall assist and cooperate with neighborhood offices and township (town) people's governments to guide and supervise the owners' assembly, owners' committees, property management committees and property service providers. Article 5 Establish a consultative governance mechanism for property management under the guidance of Party building, and support owners, owners' committees, property management committees and property service providers to carry out property management activities according to law.
Encourage and support owners' committees, property management committees and property service providers to establish trade unions, youth organizations and women's organizations in accordance with relevant laws and regulations, and give play to the role of group organizations in property management. Sixth city, district (county) housing and urban and rural construction administrative departments responsible for the supervision and management of property services management activities within their respective administrative areas.
The municipal administrative department of housing and urban and rural construction shall perform the following duties:
(a) to formulate policies related to the management of property services in this Municipality and organize their implementation;
(two) to guide and supervise the district (county) housing and urban and rural construction administrative departments to carry out the supervision and management of property service management;
(three) to guide and supervise the collection, management and use of special residential maintenance funds in this Municipality;
(four) to establish and improve the training system for members of the owners' committee and the property management committee;
(five) to formulate temporary management regulations, management regulations, rules of procedure of the owners' congress, property service contracts and other model texts and related standards;
(six) the establishment of the city's unified property service management credit information, owners of electronic decision-making and other information systems;
(seven) to guide industry associations to formulate self-discipline norms and supervise their implementation;
(eight) to perform other duties of supervision and management in the management of property services.
District (county) housing and urban and rural construction administrative departments shall perform the following duties:
(a) the implementation of property services management related laws and regulations, policies and systems;
(two) to supervise and manage the property service providers within their jurisdiction to abide by laws and regulations and property service contracts, and to disclose all kinds of matters and expenses that must be disclosed according to law;
(three) to guide and supervise the collection, management and use of residential special maintenance funds within the jurisdiction;
(four) to organize the training of members of the owners' committee and the property management committee within their respective jurisdictions;
(five) to guide the street offices and township (town) people's governments to implement property service management;
(six) to perform other duties of supervision and management in the management of property services. Article 7 The development and reform department is responsible for formulating the government-guided prices for the charging items and standards of property services within the property area.
The administrative department in charge of urban management and law enforcement is responsible for unauthorized construction in the property area, failure to clean up dog feces in time, failure to investigate and deal with garbage sorting and catching stray dogs according to regulations.
The public security organs are responsible for investigating and dealing with illegal activities such as raising dogs, barking and disturbing people, noise pollution of living environment, throwing objects at high altitude, etc. within the property management area.
The market supervision department is responsible for the property service charges and elevator safety supervision in the property area, and investigates and deals with the act of changing the house into a business house in violation of the provisions of Article 65 of these regulations.
The forestry department is responsible for investigating and dealing with illegal acts that damage trees and green spaces in the property area.
The water administrative department is responsible for investigating and dealing with the illegal acts of water supply in the property area.
The health department is responsible for the health supervision and inspection of drinking water in the property area and the investigation and punishment of corresponding illegal acts.
The Ministry of Ecology and Environment is responsible for investigating and dealing with illegal acts of boiler smoke and oil fume pollution in the property area.
The emergency management department is responsible for investigating and dealing with illegal acts of storing dangerous goods in the property area and obstructing fire safety.
In addition to the responsibilities specified in the above paragraphs of this article, the government departments listed in the above paragraphs shall also be responsible for other relevant supervision and management of property management activities according to their respective responsibilities.
Natural resources, civil air defense and other relevant departments shall be responsible for the supervision and management of property management activities in accordance with their respective responsibilities.
