Measures of Wuhan Municipality on Controlling and Investigating Illegal Construction (revised 20 12)

Chapter I General Provisions Article 1 In order to strengthen the management of urban and rural planning, stop and investigate illegal construction in time, and create a good urban environment, these measures are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Regulations on Urban and Rural Planning of Hubei Province, the Regulations on Urban Planning of Wuhan City and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the following areas of this Municipality:

(1) Jiang 'an District, Jianghan District, Qiaokou District, Hanyang District, Wuchang District, Qingshan District, Hongshan District, Wuhan East Lake New Technology Development Zone, Wuhan Economic and Technological Development Zone, East Lake Eco-tourism Scenic Area and Wuhan Chemical Industry Zone;

(2) Built-up areas and urban development areas in Caidian, Jiangxia, Dongxihu, Hannan, Huangpi, Xinzhou and other areas approved by the Municipal People's Government.

The term "illegal construction" as mentioned in these Measures refers to the buildings, structures or other facilities that have not obtained the construction project planning permit or have not been built in accordance with the provisions of the construction project planning permit. Article 3 This Municipality implements performance target management for the control and investigation of illegal construction, and the performance appraisal measures shall be formulated separately.

District People's governments and Wuhan East Lake New Technology Development Zone, Wuhan Economic and Technological Development Zone, East Lake Eco-tourism Scenic Area, Wuhan Chemical Industry Zone Management Committee (hereinafter referred to as the District People's Government and the Administrative Committee), and relevant departments directly under the municipal government shall formulate and improve the target management responsibility system, and decompose and implement the performance appraisal targets issued by the city. Article 4 The municipal and district people's governments shall establish a coordination mechanism for controlling and investigating illegal construction, regularly study and report the comprehensive management of illegal construction, and coordinate and deal with outstanding problems in investigating illegal construction. The coordination office is located in the urban management and law enforcement department of the city and district, and is specifically responsible for organizing, coordinating, assessing, controlling and investigating illegal construction work. Article 5 The supervision and management of illegal construction in this Municipality shall, in accordance with the principle of "district first, who is in charge and who is responsible", focus on key points, control the source, deal with them quickly, cooperate with each other, pursue responsibility according to law, and implement comprehensive management and long-term management. Sixth District People's governments and administrative committees are responsible for organizing the implementation of these measures within the jurisdiction and management scope.

Urban management, land planning, housing security and housing management, urban and rural construction, water supply, transportation, gardens, public security, supervision and other departments shall, according to their respective functions and duties, do a good job in controlling and investigating illegal construction in accordance with the law, and cooperate with the District People's Government and the Administrative Committee to investigate and deal with illegal construction.

The agencies of the relevant departments of the Municipal People's Government shall fully cooperate with the local people's government and the Administrative Committee, and do a good job in controlling and investigating illegal construction within the scope of their duties.

Radio, television, newspapers and other news organizations shall cooperate with relevant departments to control and investigate illegal construction. Chapter II Division of Responsibilities Article 7 The District People's Government and the Administrative Committee are the main bodies responsible for controlling and investigating illegal construction within their respective jurisdictions and administrative areas, and comprehensively organize and lead the work of controlling and investigating illegal construction within their respective jurisdictions and administrative areas. The main responsibilities are:

(a) clear street offices, township people's governments (hereinafter referred to as streets and towns) and their relevant departments to control and investigate the responsibility of illegal construction, and determine the work objectives of controlling and investigating illegal construction within the jurisdiction and management scope;

(two) to urge the streets, towns and relevant departments to formulate specific investigation and control measures and carry out investigation and control work; For the illegal construction found, instruct the relevant departments to take relevant measures such as sealing up and dismantling according to law;

(three) to deal with the problems that affect social stability and social security caused by the investigation and punishment of illegal construction;

(four) publicity and education on planning, land management and other laws, regulations and policies for units and residents within the jurisdiction and management scope;

(five) to complete the performance appraisal target of controlling and investigating illegal construction issued by the city. Article 8 The urban management law enforcement department is responsible for investigating and dealing with buildings, structures or other facilities that are newly built or rebuilt without obtaining the construction project planning permit or not in accordance with the provisions of the construction project planning permit, or temporarily built without approval or in accordance with the approved contents after acceptance.

The water department is responsible for investigating and dealing with illegal construction within the management scope of river dikes and lake waterlines.

The transportation department is responsible for investigating and dealing with illegal construction in the building control areas on both sides of the highway. Article 9 The planning department shall be responsible for verifying and identifying illegal construction that violates the provisions of the planning permit for construction projects, and put forward handling opinions.

The garden department is responsible for investigating and dealing with the illegal occupation of urban parks, unit green spaces, green squares and other green spaces according to law.

Housing security housing management department is responsible for investigating and handling illegal acts in the identification of dangerous houses according to law, urging property service enterprises to discourage illegal construction of property communities, and reporting to urban management law enforcement departments in a timely manner.

Urban and rural construction departments shall be responsible for investigating and dealing with illegal acts of participating in illegal construction without construction qualification and violating the management of construction qualification according to law.

The public security department is responsible for maintaining the order of dismantling illegal construction sites according to law, and promptly stopping and investigating illegal and criminal acts that hinder the staff of state organs from performing their duties according to law.

Departments of industry and commerce, health, culture and environmental protection. When issuing relevant permits and licenses, it should be strictly examined and checked. Those who use illegal buildings to carry out business and cannot provide proof of the use of legal business premises shall not issue relevant permits and licenses.

Water supply, power supply, gas supply and other enterprises shall strictly examine the application for water, electricity and gas installation in accordance with the conditions stipulated by the industry. If they cannot provide planning permits, they shall not go through the installation procedures.
