Measures for the Administration of Domestic Waste Classification in Haikou City (revised in 2022)

Chapter I General Provisions Article 1 In order to strengthen the classified management of domestic waste, improve the level of reduction, recycling and harmlessness of domestic waste, and promote the construction of ecological civilization and the sustainable development of economy and society, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations on the Administration of Urban Appearance and Environmental Sanitation and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the classified delivery, collection, transportation, disposal and related management activities of domestic garbage within the main urban area of this Municipality. Article 3 The classified management of domestic waste in this Municipality shall follow the principles of government promotion, participation of the whole people, overall planning of urban and rural areas and local conditions. Article 4 The municipal and district people's governments shall incorporate the domestic waste sorting work into the national economic and social development plan, incorporate the funds for domestic waste sorting work into the annual budget, make overall plans for the layout of domestic waste sorting facilities, and give priority to land use and construction. Article 5 The municipal and district people's governments shall strengthen the organization and leadership over the classified management of domestic waste, formulate the objectives and measures for the classified management of domestic waste, establish a joint meeting system for the classified management of domestic waste, and coordinate and solve major problems in the classified management of domestic waste.

Sub-district offices, town people's governments and management agencies in specific areas are responsible for the daily work of classified management of domestic waste within their respective jurisdictions, and guide and urge units and individuals within their respective jurisdictions to fulfill their obligations of classified delivery and collection of domestic waste.

Neighborhood (village) committees shall incorporate the classification of domestic waste into village rules and regulations, and assist neighborhood offices and town people's governments to do a good job in the classification management of domestic waste within their respective jurisdictions. Article 6 The competent administrative department of environmental sanitation is the competent department of domestic waste classification management in this Municipality, responsible for organizing the implementation of these Measures, and conducting guidance, training, assessment and supervision on domestic waste classification.

The competent department of ecological environment administration is responsible for the monitoring of pollutant discharge in places such as centralized domestic waste transfer facilities and terminal treatment facilities, as well as the supervision and management of pollution prevention and control in the process of storage, transportation and disposal of hazardous wastes.

The administrative department of housing and urban and rural construction is responsible for urging the property service enterprises to carry out the classification of domestic waste, and incorporate the classification management of domestic waste into the credit management system of the property service enterprises.

The competent department of commerce is responsible for establishing a recycling system coordinated with the utilization of domestic garbage and rationally arranging recycling outlets of renewable resources.

Development and reform, finance, natural resources and planning, public security, education, agriculture and rural areas, market supervision and management, comprehensive administrative law enforcement and other departments shall, in accordance with their respective responsibilities, do a good job in the classified management of domestic waste. Seventh municipal and district people's governments and relevant departments should strengthen the publicity and education of domestic waste classification, enhance the public awareness of domestic waste classification, and advocate a green lifestyle.

Schools at all levels and preschool education institutions should incorporate the classification of domestic waste into the teaching content, and cultivate the habit of classifying domestic waste for students and preschool children.

Radio stations, television stations, newspapers, internet and other media should carry out public welfare propaganda on the knowledge of domestic waste classification, and conduct public opinion supervision on acts that violate the management of domestic waste classification. Article 8 Trade unions, the Communist Youth League, women's federations, science and technology associations and other organizations shall give full play to their respective advantages, organize the publicity and mobilization of domestic waste classification, and promote the whole society to participate in domestic waste classification activities.

Property management, hotels, restaurants, renewable resources and other related industry associations should carry out publicity and training on domestic waste classification in this industry, and guide and urge member units to participate in domestic waste classification activities. Ninth domestic and foreign organizations and individuals are encouraged to participate in the classified management of domestic waste through public welfare propaganda, voluntary service, donation and investment.

Encourage and support the scientific and technological innovation and transformation and application of domestic waste classification management, and improve the level of domestic waste classification management. Article 10 Units and individuals shall fulfill their obligations of classified management of domestic waste according to law, and have the right to dissuade, complain and report violations of classified management of domestic waste.

The municipal and district people's governments shall commend and reward the units and individuals that have made remarkable achievements in the classified management of domestic waste. Eleventh units and individuals that produce domestic garbage shall pay the domestic garbage disposal fee in accordance with the regulations.

The Municipal People's Government shall, according to the needs of the classified management of domestic waste, gradually establish and improve the charging system for domestic waste treatment according to the principle of "who produces and who pays". Chapter II Planning and Construction Article 12 The municipal administrative department of environmental sanitation shall, in conjunction with the departments of development and reform, natural resources and planning, housing and urban and rural construction, ecological environment, commerce, etc., formulate a classified management plan or implementation plan for domestic waste according to the needs of economic and social development and environmental protection, and incorporate it into the special environmental sanitation plan.

Without legal procedures, the planned land for the construction of domestic waste sorting facilities shall not be changed. Thirteenth environmental sanitation administrative departments shall, in accordance with the planning and relevant standards, organize the construction and allocation of urban public waste sorting facilities and equipment. Fourteenth new construction, renovation and expansion projects should be in accordance with the planning and relevant design specifications supporting the construction of domestic waste sorting facilities, and delivered at the same time with the main project.

The design scheme of the construction project shall include the location, land area and function of the domestic waste sorting facilities.
