Organic Law of People's Republic of China (PRC) Urban Residents Committee
Article 1 This Law is formulated in accordance with the Constitution for the purpose of strengthening the construction of urban residents' committees, allowing urban residents to manage their own affairs according to law, promoting the development of socialist democracy at the grassroots level in cities, and promoting the construction of socialist material civilization and spiritual civilization in cities.
Article 2 A residents' committee is a grass-roots mass self-governing organization for self-management, self-education and self-service of residents.
The people's governments of cities not divided into districts or municipal districts or their agencies shall give guidance, support and help to the work of residents' committees. Residents' committees shall assist the people's governments of cities not divided into districts or municipal districts or their agencies in their work.
Article 3 The tasks of the residents committee are:
(a) to publicize the Constitution, laws, regulations and national policies, safeguard the legitimate rights and interests of residents, educate residents to perform their obligations according to law, take good care of public property, and carry out various forms of socialist spiritual civilization construction activities;
(two) to handle the public affairs and public welfare undertakings of the residents in this residential area;
(3) Mediation of civil disputes;
(4) Assisting in maintaining public order;
(five) to assist the people's government or its agencies to do a good job in public health, family planning, special care and relief, youth education and other work related to the interests of residents;
(six) to reflect the opinions, demands and suggestions of residents to the people's government or its agencies.
Article 4 Residents' committees shall carry out community service activities for the convenience and benefit of the people, and may set up related service undertakings.
The residents' committee manages the property of the residents' committee, and no department or unit may infringe upon the property ownership of the residents' committee.
Article 5 Residents' committees in multi-ethnic areas shall educate residents to help each other, respect each other and strengthen national unity.
Article 6 Residents' committees shall be set up in units of 100 to 700 households according to the living conditions of residents and the principle of facilitating residents' autonomy.
The establishment, cancellation and scale adjustment of residents' committees shall be decided by the people's governments of cities not divided into districts and municipal districts.
Article 7 A residents' committee consists of a chairman, vice-chairmen and five to nine members. In areas where many ethnic groups live, there should be fewer ethnic members in residents' committees.
Article 8 The chairman, vice-chairmen and members of a residents' committee shall be elected by all residents or representatives from each household who have the right to vote in this area. According to the residents' opinions, two or three representatives may be elected by each residents' group. The term of office of the residents' committee is three years, and members may be re-elected.
Residents aged 18 have the right to vote and stand for election, regardless of nationality, race, sex, occupation, family background, religious belief, education level, property status and length of residence; However, except those who are deprived of political rights according to law.
Article 9 The residents' meeting shall be composed of residents over the age of 18.
Residents' meetings can be attended by residents over the age of 18 or by representatives from each household, or by two or three representatives elected by each residents' group.
A residents' meeting can only be held when more than half of all residents and households over the age of 18 or representatives elected by residents' groups are present. The decision of the meeting shall be adopted by more than half of the participants.
Article 10 The residents' committee shall be responsible for the residents' meeting and report its work.
The residents' meeting shall be convened and presided over by the residents' committee. More than one-fifth of the residents 18 years old, more than one-fifth of the households or more than one-third of the residents' groups proposed that a residents' meeting should be held. Important issues involving the interests of all residents, the residents committee must be submitted to the residents' meeting for discussion and decision.
The residents' assembly has the right to replace and by-elect the members of the residents' committee.
Eleventh residents' committees decide issues and implement the principle that the minority is subordinate to the majority.
In carrying out its work, the residents' committee shall adopt democratic methods and shall not force orders.
Article 12 Members of residents' committees shall abide by the Constitution, laws, regulations and national policies, be fair in handling affairs, and be enthusiastic in serving residents.
Thirteenth residents' committees shall set up people's mediation, public security and public health committees according to needs. Members of residents' committees may concurrently serve as members of subordinate committees. A residents' committee with a small number of residents may not set up a subordinate committee, and the members of the residents' committee shall be responsible for the relevant work.
Fourteenth residents' committees may set up a number of residents' groups, and the leaders shall be elected by the residents' groups.
Article 15 The residents' convention shall be discussed and formulated by the residents' meeting, and submitted to the people's government of a city not divided into districts or a municipal district or its dispatched office for the record, and the residents' committee shall supervise the implementation. Residents shall abide by the resolutions of the residents' meeting and the residents' convention.
The contents of the residents' convention shall not conflict with the Constitution, laws, regulations and national policies.
Article 16 The expenses required by residents' committees to handle public welfare undertakings in their residential areas may be raised from residents on a voluntary basis, or from the beneficiary units in their residential areas through discussion and decision by residents' meetings, but they must be approved by the beneficiary units; Income and expenditure accounts shall be published in a timely manner and subject to the supervision of residents.
Article 17 The working funds and sources of residents' committees and the scope, standards and sources of living allowances for members of residents' committees shall be stipulated and distributed by the people's governments of cities not divided into districts or municipal districts or the people's governments at higher levels; With the consent of the residents' meeting, appropriate subsidies can be given from the economic income of the residents' Committee.
The office space of the residents' committee shall be solved by the local people's government as a whole.
Article 18 Persons deprived of political rights according to law shall be incorporated into residents' groups, and the residents' committees shall supervise and educate them.
Article 19 State organs, organizations, military units, enterprises and institutions shall not participate in local residents' committees, but shall support the work of local residents' committees.
When the local residents' committees discuss issues related to these units and need them to attend the meeting, they shall send representatives to attend and abide by the relevant decisions of the residents' committees and residents' conventions.
The employees of the units listed in the preceding paragraph, their families, military personnel and their dependents participate in the residents' committees in the areas where their families live in concentrated communities. In areas where their families live, families' committees can be set up separately to undertake the work of the residents' committees and work under the guidance of the people's governments of cities and municipal districts not divided into districts or their dispatched offices and their own units. The working expenses of the family members' committee and the living allowance and office space of the members of the family members' committee shall be solved by the subordinate units.
Article 20 The relevant departments of the people's governments of cities and municipal districts shall obtain the consent of the people's governments of cities and municipal districts or other organs and make unified arrangements for the work that needs the assistance of the residents' committees or their subordinate committees. The relevant departments of the people's governments of cities and municipal districts may give professional guidance to the relevant sub-committees of residents' committees.
Article 21 This Law shall apply to the residents' committees established in the places where the people's governments of townships, nationality townships and towns are located.
Article 22 The standing committees of the people's congresses of provinces, autonomous regions and municipalities directly under the Central Government may formulate measures for implementation in accordance with this Law.
Article 23 This Law shall come into force as of June 65438+June 65438+10/October +0. 1954 65438+February 3 1 NPC Standing Committee's Organizational Regulations shall be abolished at the same time.
The State Council's Property Management Regulations, which came into effect on September 1 2003, stipulated the "owners' committee" in high-level normative legal documents such as administrative regulations for the first time, thus formally establishing the owners' committee system in China at the legislative level. Article 15 of the Property Management Regulations stipulates that the owners' committee is the executive body of the owners' congress and performs the following duties:
(a) to convene a meeting of the owners' congress and report on the implementation of property management;
(two) on behalf of the owners and property management companies selected by the owners' congress to sign a property service contract;
(three) timely understand the opinions and suggestions of the owners and property users, and supervise and assist the property management enterprises to perform the property service contract;
(four) to supervise the implementation of the owners' convention;
(five) other duties entrusted by the owners' congress.
It is stated in the Property Management Regulations that the owners' committee is the executive body of the owners' congress.
