Interim Measures for the Administration of Urban Affordable Housing Construction

Chapter I General Provisions

Article 1 In order to establish and improve the urban affordable housing system and ensure the basic housing needs of urban low-income families, these measures are formulated in accordance with the spirit of the Opinions of the Municipal Party Committee and the Municipal Government on Further Solving the Housing Difficulties of Urban Low-income Families and the actual situation of our city.

Article 2 The term "affordable housing" as mentioned in these Measures refers to the policy housing provided by the government, which limits the area and sales price of Xing Tao and is built according to reasonable standards, and is oriented to urban low-income families with housing difficulties.

The term "urban low-income families with housing difficulties" as mentioned in these Measures refers to families whose family income and housing conditions meet the requirements of the competent department of affordable housing in this Municipality.

Article 3 The affordable housing system is an integral part of the policy system to solve the housing difficulties of urban low-income families. The object of affordable housing supply should be connected with the object of low-rent housing security. The construction, supply, use, supervision and management of affordable housing shall abide by these measures.

Article 4 The development of affordable housing should be guided by the overall urban planning, led by the government and participated by the society.

Article 5 The Urban Construction Bureau is the competent department of affordable housing in this Municipality, and is responsible for the guidance, supervision and management of affordable housing in this Municipality.

Municipal Development and Reform Bureau, Planning Bureau, Supervision Bureau, Finance Bureau, Land and Resources Bureau, Construction Bureau, Local Taxation Bureau and other departments are responsible for the work related to affordable housing according to the division of responsibilities.

Article 6 The Urban Construction Bureau shall, in the development plan and annual plan for solving the housing difficulties of urban low-income families, specify the construction scale, project layout and land use arrangement of affordable housing, incorporate them into the national economic and social development plan and housing construction plan at the corresponding level, and announce them to the public in a timely manner.

Chapter II Construction Management

Seventh City Urban Construction Bureau, as the competent department, is responsible for the research, policy formulation, plan implementation, organization and coordination, construction management and other work of affordable housing; City Housing Management Center is responsible for the daily work of housing security application, acceptance, review and supervision.

Article 8 The Municipal Planning Bureau shall be responsible for formulating the overall layout and specific site selection of residential buildings, handling the licensing procedures for residential project planning, and examining and approving the design. The Municipal Bureau of Land and Resources is responsible for the examination and approval of construction land, and the Municipal Development and Reform Bureau is responsible for the examination and approval of projects.

Ninth city construction engineering department is responsible for organizing the planning and design work. Planning and design should strictly adhere to the principles of moderate standards, complete functions, economy and convenience, energy saving and environmental protection, optimize design and quota design, and actively promote the application of advanced, mature and applicable new technologies, new processes, new materials and new equipment; The construction area of newly-built affordable housing in Xing Tao shall be controlled within 60 square meters.

Chapter III Price Management

Thirteenth affordable housing prices should be based on the principle of guaranteed profit. The sales benchmark price and floating range shall be determined and announced to the public by the Municipal Development and Reform Bureau in conjunction with the Municipal Urban Construction Bureau, the Finance Bureau and the Construction Engineering Department in accordance with the relevant provisions on the price management of affordable housing and on the basis of comprehensive consideration of construction management costs and profits.

Fourteenth affordable housing sales should be clearly marked. The sales price shall not exceed the published benchmark price and floating range, and shall not charge unspecified fees in addition to the marked price. The competent price department shall supervise and manage according to law.

Fifteenth affordable housing charge card system, the relevant departments to collect fees, must fill in the payment registration card issued by the competent price department.

Sixteenth affordable housing purchase area in principle shall not exceed the approved area, the purchase area within the approved area, according to the approved price; If the purchase area exceeds the approved area, it will not enjoy the government's preferential treatment, and the buyer will purchase it at the market price and make up the difference.

Chapter IV Sales Management

Article 17 The sales scope of affordable housing is: affordable housing is sold to qualified buyers in this city, and eligible applicants can only buy one set of affordable housing.

Applicants are divided into family applicants and single applicants. Family applicants refer to families composed of husband and wife, and divorced or widowed single-parent families with children; Single applicants refer to unmarried people who have reached the age of 35, and divorced or widowed people who have no children.

Affordable housing should be given priority to households without housing, households in danger of housing and urban housing demolition sales.

Eighteenth urban low-income families to apply for the purchase of affordable housing must meet the following conditions:

(a) with permanent residence in cities and towns for more than 5 years;

(two) the family income conforms to the income standard of low-income families designated by the municipal government;

(three) no housing or the current per capita housing area is less than 15 square meters;

The family income standard and housing difficulty standard of the affordable housing supply object are determined by the municipal government according to the factors such as commodity housing price, household disposable income, living standard, family demographic structure, etc., and are subject to dynamic management and announced to the public on a regular basis.

Nineteenth affordable housing purchase procedures are:

Chapter V After-sales Management

Twentieth affordable housing to implement the project quality warranty system. The construction unit shall issue a residential quality guarantee and a residential instruction manual to the buyer. Quality defects caused by investigation, design, construction, materials and other reasons during the warranty period shall be repaired by the development and construction unit (or property management company) and the expenses required for maintenance shall be borne by the responsible party according to regulations.

Article 21 After the affordable housing is delivered for use, a property company shall be selected through bidding, and standardized management shall be carried out in accordance with the Measures for the Administration of New Urban Residential Areas and the Measures for the Administration of Residential Areas in Jiaonan City by the Ministry of Construction. Residential quarters are fully enclosed, and intelligent security guards provide 24-hour service. Property management companies are responsible for the facilities maintenance, sanitation, greening and environmental management of residential quarters.

The account management and community management of affordable housing are specifically responsible by the relevant departments.

Chapter VI Transaction Management

Twenty-second after the purchase of affordable housing, ownership registration shall be handled in accordance with the provisions. City housing, land registration departments in the registration of ownership, should indicate that it is affordable housing, and respectively indicate the purchase price of affordable housing and the area purchased at the price of affordable housing.

Twenty-third affordable housing buyers have limited property rights.

If the purchase of affordable housing is less than 10 years, direct listing and trading are not allowed. If the purchaser really needs to transfer affordable housing for special reasons, the government will repurchase it according to the original price and considering factors such as depreciation and price level.

In the year of purchasing affordable housing 10, if the purchaser transfers affordable housing on the market, he shall pay the relevant price such as land income to the government according to a certain proportion of the price difference between ordinary commodity housing and affordable housing in the same lot at that time, and the specific payment proportion shall be determined by the municipal government, and the government may give priority to repurchase; Property buyers can also obtain full property rights after paying the relevant price such as land income to the government according to the standards set by the government.

The above terms shall be stated in the purchase contract of affordable housing, and the relevant liability for breach of contract shall be clarified.

Twenty-fourth affordable housing purchased by individuals shall not change the design purpose determined by the property certificate, and shall not be used for rental or other purposes.

Chapter VII Fund Management

Article 25 The construction public works department shall set up a special bank account for the construction cost of affordable housing in Jiaonan (hereinafter referred to as the "special account"), and all kinds of deposits paid by contractors and the house purchase money paid by residents in installments shall be deposited into the "special account".

Twenty-sixth municipal construction office is responsible for allocating funds by stages according to the progress of the project and the requirements of the contract to ensure the timely disbursement of funds.

Article 27 the part that exceeds the purchase price of affordable housing shall be paid by the development and construction unit to the municipal construction department, turned over to the municipal finance, stored in a special account and earmarked for the city's housing security expenditure.

Chapter VIII Preferential Policies

Twenty-ninth affordable housing construction projects are exempt from various administrative fees and government funds such as urban infrastructure supporting fees.

Chapter IX Supervision and Administration

Thirty-first Municipal Supervision Bureau shall, jointly with the relevant municipal departments, strengthen the investigation and punishment of violations of discipline and law in the construction and trading of affordable housing.

(two) unauthorized increase in the sales price of affordable housing and other price violations, the Municipal Development and Reform Bureau shall be punished according to law.

(three) do not meet the conditions of the family to buy affordable housing, the purchase of housing for construction, the Municipal Urban Construction Bureau in consideration of depreciation and other factors, the deadline to buy at the original price; If it cannot be purchased, the Urban Construction Bureau shall instruct it to pay the price difference between similar ordinary commodity housing and affordable housing in the same lot, and punish the relevant responsible units and responsible persons according to law.

Article 32 For individuals who resort to deceit, conceal family income and housing conditions, and cheat to buy affordable housing, the Municipal Urban Construction Bureau shall recover the purchased housing at the original price within a time limit and consider depreciation and other factors, and shall be held accountable according to law and relevant regulations. If a false certificate is issued, the relevant responsible person shall be investigated for responsibility according to law.

Article 33 If the staff of the relevant departments of affordable housing construction and management abuse their powers, neglect their duties or engage in malpractices for selfish ends in the process of affordable housing construction and management, they shall be investigated for responsibility according to law and discipline; Those suspected of committing a crime shall be transferred to judicial organs for handling.

Thirty-fourth any unit or individual has the right to report and accuse acts in violation of the provisions of these measures.

Chapter X Supplementary Provisions

Article 35 These Measures shall come into force as of the date of promulgation and shall be valid for 3 years.

Thirty-sixth these Measures shall be interpreted by the Municipal Urban Construction Bureau in conjunction with the Municipal Construction Engineering Department.
