As long as the overdue property fee exceeds the payment time agreed between the property owner and the property owner, and the property owner still fails to pay the property fee after the property is called, the owner may apply for prosecution. The specific reasons are as follows:

1. During the period when the owner defaults on the property management fee, the late payment fee will continue to be generated. The statute of limitations for suing the owner for defaulting on property management fees is 3 years, so the property can sue the owner for defaulting on property management fees within 3 years;

2. In the face of default in property fees, the property has the right to file a civil lawsuit:

(1) The lawsuit for unpaid property fees is a civil dispute after all, and the court can mediate. As long as the defendant agrees to pay the property fee owed immediately in court, the judge will do the plaintiff's job and let the plaintiff withdraw the lawsuit;

(2) If the defendant's life is difficult, the judge will make a conciliation statement to pay the property fees owed by installments. If the defendant does not obey the mediation, then the judge can only fully support the plaintiff's claim.
