Measures of Wuxi Municipality on the Administration of Personal Credit Information Collection

Chapter I General Provisions Article 1 In order to strengthen the collection and application management of personal credit information, protect the safety of personal credit information, and safeguard the national interests, social public interests and the legitimate rights and interests of the respondents, these Measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the collection of personal credit information and related management activities within the administrative area of this Municipality. Article 3 The term "personal credit information" as mentioned in these Measures refers to information formed by natural persons in social and economic activities that can reflect personal credit status.

The collection of personal credit information as mentioned in these Measures refers to the collection, processing, use and correction of personal credit information. Article 4 The collection of personal credit information shall follow the principles of objectivity, fairness and accuracy, and whoever provides it shall be responsible, so as to safeguard the legitimate rights and interests of individuals and protect their privacy according to law. Fifth Municipal Economic and Information Technology Commission is the municipal credit management department, responsible for the guidance, coordination, supervision and management of personal credit information collection in the city.

The relevant departments shall, in accordance with their respective responsibilities, coordinate the collection and management of personal credit information. Article 6 The public credit information center established by the Municipal People's Government (hereinafter referred to as the Municipal Credit Center) is responsible for the construction, maintenance and management of the personal credit basic data management system in this Municipality, and collects personal credit information in accordance with the provisions of these Measures. Article 7 A legally established personal credit information credit reporting agency (hereinafter referred to as the credit reporting agency) shall collect personal credit information through legal channels. Article 8 The municipal personal credit basic data management system (hereinafter referred to as the personal credit data system) is the core platform for the collection, collation, storage, use and realization of services in the whole city, and it is the main carrier for the government to comprehensively manage personal credit information and improve the service level of the public.

The personal credit data system of credit reporting agencies is an important carrier for credit reporting agencies to manage personal credit information. Chapter II Collection and Processing Article 9 Personal credit information includes the following contents:

(1) Personal basic information: name, gender, date of birth, ID number, address, residence, work unit, education and other identity information and professional information;

(2) Personal credit information: information made public by industry authorities or industry associations and formed by individuals, financial institutions and housing provident fund management centers in activities such as loans, credit cards and guarantees;

(3) Personal commercial credit information: personal credit purchase, payment and other information formed between individuals and commercial institutions and public institutions due to commodity transactions and service relationships;

(4) Personal social public credit information: personal information formed by administrative organs, judicial organs and organizations exercising public management functions in the process of exercising their functions and powers;

(5) Other information related to personal credit as prescribed by laws and regulations. Article 10 It is forbidden to collect the following personal information, except those provided by myself voluntarily:

(1) Ethnic, racial, religious and political beliefs;

(2) Information such as body shape, gene, blood type, disease and medical history that may affect the normal life of the investigated person;

(3) Other personal information unrelated to personal credit or prohibited by laws and regulations. Article 11 The Municipal Credit Information Center shall timely collect personal credit information formed by administrative organs, judicial organs, organizations exercising public management functions, public utilities and industry organizations (hereinafter referred to as information providers), and may collect personal credit information held by financial institutions in financial activities by agreed means.

After the personal credit information is generated, the information provider shall provide it to the municipal credit center in a timely, accurate and complete manner. Article 12 The specific scope, time, manner and format of personal information provided by information providers shall be separately determined by the credit management department in conjunction with information providers in accordance with relevant regulations. Thirteenth credit institutions can collect personal credit information in the following ways:

(a) provided by the municipal credit center in an agreed way;

(2) Collecting information from the respondents in an agreed way;

(3) Information publicly reported by the media.

It is forbidden to collect personal credit information by cheating, stealing, coercion, computer network intrusion and other improper means. Fourteenth city credit center shall not process the collected personal credit information, and shall not rate or subjectively evaluate personal credit. Fifteenth credit reporting agencies should make personal credit reports or personal credit evaluation reports according to personal credit information.

The personal credit evaluation report produced by the credit reporting agency shall be based on the evaluation index system and standards to ensure the fairness of the evaluation results. Chapter III Storage and Management Article 16 Personal credit information shall be timely and accurately entered into the personal credit data system for storage and management, and shall not be forged or tampered with. Seventeenth information providers should be responsible for the authenticity of the personal credit information they provide; City credit center and credit institutions are responsible for the authenticity of personal credit information they collect. Eighteenth in addition to criminal records, other bad credit information related to personal credit, such as industry punishment, administrative punishment, administrative punishment, etc. , shall be kept for 7 years from the date of termination of bad credit behavior. Where laws and regulations provide otherwise, such provisions shall prevail.
