If the owner rents the house to others, the real user of the property is the renter. According to Article 42 of the Property Management Regulations, if the owner and the property user agree that the property user will pay the property service fee, the owner shall bear joint and several liability for payment. Therefore, when renting a house, if the lessee and lessor stipulate in the lease contract that the property fee shall be paid by the lessee, then the lessee shall pay the property fee.
However, according to the relevant management regulations of the property management company, the contract must be confirmed in writing by the property management company, that is to say, the lessor has transferred its creditor's rights and debts with the property management company to the lessee, and the lessee needs to fulfill this part of rights and obligations in the process of leasing.
