What procedures do you need to change the property company in the community?

Procedures required for changing residential property companies:

1. First, it is determined that it is the will of most owners to replace the property company, and the number of households has exceeded two-thirds, so that the property can be replaced smoothly;

2. If two thirds of the owners agree to change the property, they can send their representatives to the person in charge of the property company for consultation. If the property company is unwilling to stop the property contract, it will quit its management;

3. The owner's representative shall apply to the neighborhood committee to change the property with the owner's signed consent and evidence of property breach. The owner shall cooperate with the neighborhood committee to handle relevant formalities. If the property does not agree, it will go through legal procedures;

4. In the case of sufficient evidence, the court will support the owner, cancel the property contract of the property company according to law, and let the property company do a good job of handover and evacuate the site within a time limit;

5. If there is no industry committee in the community, the owners may entrust the neighborhood committee or other organizations to organize new property bidding, hire other property companies, or directly invite their property companies for management.

Legal basis: Article 5 of the Bidding Law of People's Republic of China (PRC).

Bidding activities should follow the principles of openness, fairness, impartiality and good faith. Seventh bidding activities and their parties shall accept supervision according to law. The relevant administrative supervision departments shall supervise the bidding activities according to law, and investigate and deal with illegal acts in bidding activities according to law. The administrative supervision of bidding activities and the specific functions and powers of relevant departments shall be stipulated by the State Council.
