Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly, the Regulations of Jiangsu Province on the Protection of the Rights and Interests of the Elderly and other laws and regulations, combined with the actual situation of this Municipality, in order to standardize the operation and management of the old-age care institutions, safeguard the legitimate rights and interests of the elderly and the old-age care institutions, and promote the healthy development of the old-age care cause. Article 2 These Regulations shall apply to the planning and construction, termination of establishment, support for development, service standardization, operation and related management of pension institutions within the administrative area of this Municipality. Article 3 The term "old-age care institutions" as mentioned in these Regulations refers to institutions that provide centralized diet, daily life and nursing services for the elderly. Article 4 The municipal, county-level city and district people's governments shall, according to the social and economic development and the social needs of the elderly, incorporate the development of old-age care institutions into the national economic and social development plan, study and formulate supporting policies for the optimal development of old-age care institutions, ensure capital investment, and promote the coordinated development of the old-age care service industry and the economy and society.

People's governments at all levels shall provide basic old-age service guarantee for the elderly who have no ability to work, no source of income, no fixed supporter or supporter, legal supporter or supporter. Fifth city, county-level city and district civil affairs departments are responsible for the guidance, supervision and management of the old-age care institutions within their respective administrative areas.

Development and reform, urban and rural planning, construction, land and resources, public security, human resources and social security, health, finance, price and other relevant departments shall, according to their respective responsibilities, do a good job in the development, supervision and management of pension institutions. Sixth to encourage social forces to set up pension institutions.

People's governments at all levels should strengthen the opening of social capital, give full play to the role of market mechanism, and constantly innovate management and operation modes through public construction, private operation, cooperative operation and entrusted management. Article 7 Pension institutions may establish or join relevant trade associations.

Relevant industry associations should strengthen the industry self-discipline and integrity construction of old-age care institutions, formulate or participate in the formulation of industry technology and service standards, provide information, training and consulting services for old-age care institutions, assist in establishing nursing grades for the elderly and a third-party evaluation mechanism for old-age care institutions, mediate disputes arising from the operation and service of old-age care institutions, and safeguard the legitimate rights and interests of the elderly and old-age care institutions. Article 8 Citizens, legal persons and other organizations are encouraged to donate or provide voluntary services to pension institutions. Article 9 Citizens, legal persons or other organizations that have made remarkable achievements in the service and management of old-age care institutions shall be rewarded by people's governments at all levels. Chapter II Planning and Construction Article 10 The municipal and county-level civil affairs departments shall, jointly with the departments of development and reform, urban and rural planning, land and resources, formulate a special plan for the layout of old-age service facilities, rationally arrange old-age care institutions, and determine supporting construction standards for old-age care institutions according to the overall plans for national economic and social development, urban planning and land use, population, public service resources and demand for old-age care services within their respective jurisdictions.

The special plan for the layout of old-age service facilities shall be implemented after being approved by the people's government at the same level. Eleventh new residential areas in accordance with the special planning of the layout of old-age service facilities need to build old-age care institutions, the construction unit should be in accordance with the construction requirements and standards, synchronous construction of old-age care institutions, and in accordance with the provisions of the delivery.

If the housing for the old-age care institutions in the built residential areas does not meet the planning requirements and standards, the people's governments of county-level cities, districts and towns and sub-district offices shall organize the construction.

Article 12 The municipal and county-level municipal people's governments shall incorporate the land for the construction of old-age service facilities such as old-age care institutions into the overall land use plan and annual plan to ensure the demand for land.

Non-profit pension institutions can use state-owned allocated land or rural collective construction land according to law; The construction land of for-profit pension institutions is obtained by leasing, transferring and other paid ways with reference to the transfer price of industrial land in similar lots.

Encourage idle land for the construction of other public facilities to be adjusted into land for the construction of old-age care institutions according to law.

The land for the construction of old-age care institutions shall not be changed without legal procedures. Chapter III Establishment, Alteration and Termination Article 13 The establishment of an old-age care institution shall meet the conditions stipulated by laws and regulations and the special plan for the layout of old-age care facilities, and shall go through the licensing and registration procedures according to law. Fourteenth municipal civil affairs department is responsible for the implementation of the license for the establishment of old-age care institutions with residences in urban areas, and may also entrust the district civil affairs department to implement the license.

The civil affairs department of the county-level city is responsible for the implementation of the establishment license of the old-age care institution with residence within its administrative area.

Overseas organizations and individuals, or joint ventures or cooperation with domestic organizations and individuals to establish pension institutions, shall apply to the Provincial Civil Affairs Department for the establishment permit. Fifteenth to apply for the establishment of an old-age care institution, the following materials shall be submitted:

(1) An application for establishment;

(two) the qualification documents of the applicant, the proposed legal representative or the principal responsible person;

(3) The name, articles of association and management system of the institution that meets the registration requirements;

(four) the completion acceptance certificate of the construction project, the acceptance report or review opinion of the health and epidemic prevention and environmental protection department, and the fire design review and fire acceptance opinion of the construction project issued by the public security fire department or the fire record certificate;

(five) the certificate of ownership of the service place or the house lease contract;

(six) other materials as prescribed by laws and regulations.

The civil affairs department shall publish the catalogue and demonstration text of the materials applying for the establishment license in the service window and the government website.
