According to Article 2 of the State Council's "Regulations on Property Management", "Property management as mentioned in these regulations refers to the activities of the owners to maintain, conserve and manage the houses, supporting facilities, equipment and related sites in the property management area by hiring property service enterprises, and to maintain environmental sanitation and related order"; Twenty-fourth "residential property construction units, property services companies should be selected through bidding". According to the above regulations, some * * * residential quarters (or owners * * * properties) need property services, and the construction unit of the newly-built quarters is the initial owner. Before the government authorities allowed him to sell the house, the construction unit was the only owner. According to the second paragraph of Article 72 of the Property Law, "When the owner transfers the residential and business premises in the building, some of them will enjoy * * * * *. In order to safeguard the legitimate rights and interests of owners and property service enterprises, the state stipulates in Article 27 of the Property Management Regulations that "the owners shall not dispose of the ownership or use right of the parts and facilities of the property"; Article 28 stipulates that "when a property service enterprise undertakes a property, it shall inspect the parts and facilities of the property".
In order to implement the property management regulations, the Pre-Property Service Contract (Model Text) (J.J. [2004] 155) standardized the contents of the pre-property service contract and defined the rights and obligations of the parties. In order to strengthen the guidance and supervision of the early property management activities, Article 10 of the Property Acceptance Measures stipulates that "the construction unit shall complete the acceptance of the * * * parts and facilities of the property with the selected property service enterprise before the property is delivered for use 15"; The realty service enterprise shall go through the filing formalities with the administrative department in accordance with the provisions of Article 29, and both parties shall "inform the owners in writing of the property undertaking inspection and filing in accordance with the provisions of Article 30"; The administrative department shall promptly handle the complaints of the owners and order them to make corrections within a time limit.
In order to safeguard the legitimate rights and interests of owners, the state has formulated a series of laws and administrative regulations, standardized the business activities of construction units and property service enterprises, and defined the obligations and responsibilities of both parties.
