Neighborhood offices and township (town) people's governments shall organize and guide the owners within their respective jurisdictions to set up owners' congresses and elect owners' committees, supervise the owners' congresses and owners' committees to perform their duties according to law, coordinate the relationship between property management and community management and community service, and mediate property management disputes.
Neighborhood (village) committees shall assist neighborhood offices and township (town) people's governments to do a good job in property management. Article 5 Establish and improve the community governance structure with the participation of residents' (village) committees, owners' committees, property service enterprises and owners under the leadership of the party organization in residential areas, and promote the innovation of property management. Article 6 Establish and improve the people's mediation mechanism for property management disputes, strengthen the effective connection between people's mediation and administrative mediation, arbitration and judicial trial, and properly resolve contradictions and disputes in property management. Article 7 Property management associations shall strengthen the self-discipline management of the industry, assist the property management administrative departments to carry out relevant credit information management, organize skills training, mediate disputes among property service enterprises, and promote the healthy development of the industry.
Encourage property service enterprises to join the property management association. Article 8 Promote the establishment of a third-party evaluation mechanism for property services. Property management administrative departments, neighborhood (village) committees, construction units, owners' congresses and owners' committees, and property service enterprises may entrust third-party property service assessment agencies to undertake property project inspection, property service cost calculation, property service quality evaluation and other activities. Chapter II Property Management Areas and Related Allocation Article 9 The division of property management areas shall be conducive to the implementation of property management. On the basis of the land use scope determined in the construction land planning permit, the factors such as facilities and equipment used by the property, building scale, community construction, number of owners, natural boundaries and so on are comprehensively considered.
The use of property supporting facilities and equipment shall be divided into a property management area; If the supporting facilities and equipment can be used independently, they can be divided into different property management areas. If it affects the use of facilities and equipment such as fire fighting, hedging, gas and elevators, it shall not be divided into different property management areas. The ownership of property management houses belongs to all owners in accordance with the law and is used exclusively for property management services. No unit or individual may transfer, mortgage or change its use without authorization. The office space of the owners' committee is arranged from the property management office space, with a minimum construction area of 20 square meters.
Urban and rural planning departments shall indicate the location and construction area of property management houses in the attached drawings when issuing construction project planning permits. Twelfth new residential property management area of water supply, power supply, gas supply, heating, communications, cable television and other end users of household metering or end users before the home port of professional operating facilities, equipment and related pipelines shall comply with national technical standards and norms, the cost shall be borne by the construction unit.
When the construction unit organizes the completion acceptance, it shall notify the professional business unit to participate; After the completion and acceptance, the professional operating facilities, equipment and related pipelines in the property management area shall be handed over to the professional business unit for management, and relevant certification materials shall be provided. Professional business units shall be responsible for maintenance, conservation and renewal according to law.
Before the implementation of these regulations, the household meters of water supply, power supply, heating and other end users in the residential property management area built before the implementation of these regulations, or the professional operating facilities and equipment and related pipelines before the end users' accounts are divided, shall be handed over to the professional business units in a planned way. Specific transfer measures shall be formulated by the Municipal People's government.
