Article 1 Daily Maintenance of Elevator

Party A and Party B agree that Party B shall provide routine maintenance and emergency maintenance services listed in the Elevator Maintenance and Quantity List (see Annex I) for the elevators used and managed by Party A..

Article 2 Daily maintenance contents

Party B shall complete the semi-monthly, monthly, quarterly, semi-annual and annual maintenance items in accordance with the Elevator Daily Maintenance Rules (DB1/418), and make maintenance records (see Annex II).

Article 3 Daily maintenance standards

After routine maintenance, the elevator shall comply with the relevant provisions of the Maintenance Code for Elevators (gb/t 18775), the Safety Code for Elevator Manufacture and Installation (gb 7588) and the Safety Code for the Manufacture and Installation of Escalators and Moving Sidewalks (gb 16899).

In addition to the above standards, Party A shall also meet the following requirements:

Article 10 Rights and obligations of Party A

(1) rights

1. has the right to supervise Party B's performance of the maintenance obligations agreed in the contract, and issue failure notices or suggestions.

2. Have the right to ask Party B to ensure the normal operation of the elevator. If Party B's maintenance fails to meet the maintenance standards or requirements agreed in the contract, Party A has the right to refuse to sign the maintenance records.

(2) Obligations

1. A complete safety technical file shall be established for each elevator for Party B's inquiry. Before signing this contract, Party B shall provide the following materials or copies:

(3) Electrical schematic diagram;

(5) Installation instructions;

6. Unless Party B can't solve the problem, non-Party B's personnel shall not engage in elevator maintenance work without Party B's written permission.

7. Party B shall be provided with the working environment required for maintenance.

8. An application for regular inspection shall be submitted to the elevator inspection and testing institution 1 month before the expiration of the elevator safety inspection.

Article 11 Rights and obligations of Party B

(1) rights

1. has the right to request Party A to provide the working environment and relevant materials required for maintenance.

2. Party B has the right to refuse Party A's request that affects the safe operation of the elevator.

(2) Obligations

1, it shall have the license issued by the corresponding special equipment safety supervision and management department.

2, after receiving the fault notice, should immediately rushed to the scene for processing; When the elevator is trapped, it should arrive at the scene within minutes (the longest time is not more than 30 minutes).

5. Make reasonable suggestions to Party A every month, and report to Party A in writing the operation of the maintenance elevator, the use of spare parts, the replacement of wearing parts and the replacement and maintenance requirements of the elevator.

6. Be responsible for the safe operation of the maintained elevator and ensure the integrity of the whole machine and equipment parts.

7, establish a return visit system (including employee service attitude, maintenance quality, whether to implement maintenance according to regulations, etc.). ).

8. Cooperate with elevator inspection and testing institutions to inspect elevators regularly and participate in elevator safety management activities.

9. Elevator drawings and related materials shall be properly kept and handed over to Party A after the termination of the contract.

10. Subcontracting in any form is not allowed.

Article 12 Liability for breach of contract

(1) If one party fails to perform its obligations as agreed, thus causing direct losses to the other party, it shall be liable for compensation.

(2) If one party cannot continue to perform the contract, it shall notify the other party in time, and the responsible party shall bear the losses caused by the termination of the contract.

(3) If Party A fails to pay the fees within the agreed time limit without justifiable reasons, it shall pay% of the overdue fine to Party B for each day overdue.

(IV) Where Party A allows non-Party B personnel to engage in elevator maintenance in violation of the agreement, it shall abide by the following provisions.

Standard payment of liquidated damages.

(5) If personal injury or equipment is damaged or lost due to the use and management of the elevator, Party A shall bear all the responsibilities by itself.

(VI) If Party B's maintenance work does not meet the maintenance standards or the requirements stipulated in the contract, Party B shall rework and pay liquidated damages according to the standards.

(VII) Party B shall bear all responsibilities for personal injury or death or equipment damage or loss caused by maintenance.

(VIII) If the elevator fails to pass the inspection due to maintenance, Party B shall also bear the reinspection expenses of the elevator.

Article 13 Termination of the Contract

(1) Both parties can terminate the contract through consultation.

(2) If either party breaches the contract seriously, the other party may terminate the contract. In addition, neither party may unilaterally terminate the contract.

Article 14 dispute settlement method

Any dispute arising from the performance of this contract shall be settled by both parties through consultation or apply to the relevant departments for mediation. If no settlement can be reached through negotiation, it shall be settled in the following ways (choose one):

Article 15 Other agreements

(1) In case of general maintenance, major maintenance or renovation, or Party A requires Party B to provide value-added services beyond those stipulated in this contract, both parties shall sign a written agreement separately.

(2) Maintenance records are the basis for recording elevator operation, maintenance and maintenance. Each elevator shall establish an independent maintenance record. The maintenance records are made in duplicate, one for each party, and the retention period is 4 years. General maintenance, major maintenance, renovation agreement and emergency maintenance records shall be kept together with the maintenance records. Article 16 Supplementary Provisions
