Article 2 These Measures shall apply to the construction activities within the administrative area of this Municipality and the management of construction activities on the construction site of construction projects.

The construction activities mentioned in these Measures include the new construction, renovation, expansion and demolition of housing construction and municipal infrastructure projects, except for emergency rescue and disaster relief projects.

Where there are other provisions in laws and regulations on the construction activities of water conservancy, railways, highways, landscaping, telecommunications and other professional projects, those provisions shall prevail.

Article 3 The municipal construction administrative department shall be responsible for the supervision and management of the construction site in this Municipality, and the district and county construction administrative departments shall be responsible for the supervision and management of the construction site within their respective jurisdictions.

The comprehensive law enforcement department of urban management is responsible for the administrative law enforcement work related to dust pollution and construction noise pollution in construction sites.

Planning, transportation, municipal appearance, public security, production safety, environmental protection, quality supervision, water affairs and other departments shall supervise and manage the construction site according to their respective responsibilities.

Article 4 The supervision and management of farmers' self-built low-rise residential construction activities shall be managed by township people's governments and subdistrict offices with reference to these measures, and the construction administrative department shall be responsible for providing technical guidance to farmers' self-built low-rise residential construction activities.

Fifth construction administrative departments and relevant departments shall strengthen the supervision and management of the construction site, establish the supervision and inspection system of the construction site, and organize the activities of creating green and safe construction sites.

Construction units, construction units and supervision units shall, according to the requirements of construction site management, do a good job in construction site management in accordance with the main responsibilities of all parties.

Article 6 Any unit or individual has the right to report illegal acts on the construction site. Construction administrative departments and relevant departments shall establish a reporting system, and investigate and handle reports in a timely manner according to their duties. Article 8 The construction unit shall strengthen the management of the construction site and perform the following duties:

Article 9 The construction unit is responsible for the safety management of the construction site. In the case of general contracting and subcontracting of construction projects, the general contractor is responsible for the unified management of the construction site, and the subcontractors are responsible for the management of the construction site within the scope of subcontracting. For professional projects directly contracted by the construction unit, the professional contractor shall accept the on-site management of the general contractor, and the construction unit, the professional contractor and the general contractor shall sign a construction site management agreement to clarify the responsibilities of all parties.

The general contractor shall be responsible for the accidents caused by the general contractor's illegal command; Subcontractors or professional contractors do not obey the management of the general contractor, causing accidents, and the subcontractors or professional contractors shall bear the main responsibility.

Tenth the main person in charge of the construction unit is fully responsible for the safety production of the construction unit. The project leader of the construction unit is responsible for the safety production at the construction site and performs the duties of site management.

The construction unit shall, in accordance with the provisions, set up safety production management institutions or equip full-time safety production management personnel at the construction site.

The supervision unit shall verify the qualification of the construction unit, the safety production license and the qualification certificate of special operators, and review the safety technical measures and special construction schemes in the construction organization design according to law.

Twelfth management personnel and construction personnel entering the construction site shall meet the requirements of post management and skill operation, hold relevant certificates in accordance with regulations, and receive safety production training. Without training, you may not work at your post.

Thirteenth construction units shall carry out construction in strict accordance with the construction safety operation rules and standards, construction scheme and design requirements, and establish and improve the management system of fire and electricity in accordance with the provisions of this Municipality on fire safety management of construction sites.

If it is necessary to carry out high-altitude operation and hot work during construction, the construction unit shall carry out the operation in accordance with the provisions of this Municipality and national standards, and shall stop the operation when the wind exceeds Grade 5.

Article 14 The construction unit shall establish a management system for production safety and environmental protection on the construction site, publicize it on the construction site, formulate emergency plans and organize emergency drills regularly.

Fifteenth construction units shall, in accordance with the provisions of the preparation of construction organization design documents, and in accordance with the construction organization design documents for construction. Construction organization design documents should include safety production and green construction site management measures.

The construction unit shall prepare the demolition construction plan and carry out the construction according to the demolition construction plan.

Sixteenth the construction unit shall, before the construction project, provide the construction unit with relevant information about underground pipelines, adjacent buildings, structures and underground projects. When the construction unit needs to inquire about the relevant information from the relevant departments or units due to the construction project, the relevant departments or units shall provide it in time.

Before the construction of a construction project, the construction unit shall, jointly with the underground pipeline ownership unit, formulate a special pipeline protection scheme to ensure the safety of underground pipelines, adjacent buildings, structures, underground projects and special working environments. During the construction process, the construction unit shall take corresponding protective measures for the underground pipeline. If the pipeline safety or construction safety cannot be guaranteed, the construction unit shall change the pipeline or take other measures in conjunction with the underground pipeline ownership unit.

Seventeenth dangerous division subdivisional work before construction, the construction unit shall, in accordance with the provisions of the preparation of special construction plan and organize the implementation according to the plan; To meet the scale standards prescribed by the state, the special construction plan shall be demonstrated by experts.

In accordance with the provisions of the need for acceptance, the construction unit shall organize acceptance, acceptance, before entering the next process.

Eighteenth general contracting units are responsible for the unified management of large construction machinery entering the construction site, and audit the relevant enterprise qualifications, personnel qualifications, test reports and special programs according to law.

Units that provide large-scale construction machinery should carry out daily maintenance on the equipment entering the construction site, check it according to regulations, check it at least once a month, and make records. Large-scale construction machinery shall carry out construction operations in accordance with the requirements of operation standards and regulations, and no unit may command in violation of regulations.

Nineteenth construction hoisting machinery leasing units shall file with the municipal administrative department of construction, and submit the following materials:

(two) the registration number of construction hoisting machinery and equipment;

(three) the construction crane driver special operation qualification certificate;

(4) Having a site for equipment maintenance and storage that meets the operational requirements;

The municipal administrative department of construction shall establish a credit information management platform for the leasing unit of construction hoisting machinery in this Municipality, publicize the filing situation of the leasing unit and its credit information, and implement dynamic management.

The construction unit should choose the construction hoisting machinery of the leasing unit with good leasing credit during the construction.

Article 20 When an accident occurs on the construction site, the construction unit shall take emergency measures to reduce casualties and property losses, and report to the relevant departments in a timely manner in accordance with regulations.

When cultural relics, paleontological fossils, explosives and radioactive pollution sources are found on the construction site, the construction unit shall protect the site and report to the relevant departments in a timely manner in accordance with regulations. Twenty-first construction units shall, in accordance with the provisions of the state and this Municipality on the management of green construction, do a good job in saving land, water, energy, materials and protecting the environment.

Twenty-second new construction, renovation and expansion projects strictly limit the construction precipitation. If it is really necessary to carry out precipitation, the construction unit shall organize expert argumentation and review in accordance with the regulations, obtain the drainage permit, and pay the groundwater resource fee according to law.

Twenty-third construction sites shall take the following measures in accordance with the requirements of green construction regulations:

(1) Before the construction project starts, the construction unit shall set up enclosures around the construction site according to the standards, and the construction unit shall maintain the enclosures. If the municipal infrastructure project cannot be fenced due to special circumstances, warning signs shall be set at the dangerous parts of the project and protective measures shall be taken.

(two) the construction unit should harden the main roads and templates, materials and tools on the construction site, and other sites should be covered or afforested; Earthwork should be piled up in a centralized way, and measures such as covering or curing should be taken. The construction unit shall afforest the vacant land that will not be developed temporarily.

(three) the construction unit shall do a good job of sprinkling water on the construction site to reduce dust, and the demolition work shall be carried out simultaneously.

(four) the construction unit shall store or closely cover the building materials that may produce dust pollution in the warehouse; Measures should be taken to prevent leakage and pollution in oil storage.

Twenty-fourth construction site entrances and exits should be equipped with vehicle washing facilities. Sedimentation tanks should be set up at the vehicle washing place and the front desk of the mixer, and the sewage from washing the mixer and transport vehicles should be comprehensively recycled, or discharged into public drainage facilities, rivers, reservoirs, lakes and channels after reaching the standard after sedimentation treatment.

Article 25 A closed garbage station shall be set up on the construction site to store the construction garbage, and a closed special garbage passage shall be set up or containers shall be used to lift and clean the construction garbage. It is strictly forbidden to throw it at will. The disposal and transportation of construction waste on the construction site shall be handled in accordance with the relevant provisions of this Municipality on waste management.

Prohibit government investment in construction projects and construction projects within the prescribed area of this Municipality from mixing mortar on site; Among them, bulk ready-mixed mortar should be used for masonry, plastering and ground engineering mortar.

Twenty-seventh in the area where noise-sensitive buildings are concentrated, construction operations that produce environmental noise pollution may not be carried out at night. If it is really necessary to carry out construction from 22: 00 to 6: 00 the next day due to the continuous operation of key projects or production processes, the construction unit shall apply to the district or county construction administrative department where the construction project is located before construction, and the night construction can be carried out only after approval, and the construction period will be announced. Without approval or beyond the approval period, the construction unit shall not carry out night construction.

Twenty-eighth night construction, the construction unit shall, in conjunction with the construction unit, do a good job of the surrounding residents, and take effective measures to prevent noise pollution and reduce the impact on the lives of the surrounding residents.

If the noise generated by night construction exceeds the prescribed standard, the construction unit shall give economic compensation to the residents in the affected area. The specific compensation measures shall be formulated by the construction administrative department in conjunction with the development and reform, environmental protection and other departments, and the compensation measures shall include the scope of compensation, the determination principles of compensation standards, and the ways of dispute relief.

The construction unit shall entrust an environmental protection monitoring agency to determine the influence range of construction noise at night, and determine the number of households that should be compensated in conjunction with the relevant residents' committees or property service units. The construction unit shall sign a compensation agreement with the residents.

Twenty-ninth all kinds of living facilities on the construction site should meet the requirements of fire control, ventilation, sanitation and lighting, and use gas safely to prevent fire, gas poisoning, food poisoning and various epidemics.

Hot water boilers, stoves and heating facilities are prohibited from using coal. In violation of the provisions of the second paragraph of Article 15 of these measures, if the demolition construction plan is not prepared or the construction is not carried out in accordance with the demolition construction plan, the construction administrative department shall order it to make corrections and impose a fine of more than 5000 yuan 1000 yuan; If the circumstances are serious and cause serious consequences, a fine of 1 10,000 yuan but not more than 30,000 yuan shall be imposed.

Thirty-third in violation of the provisions of the second paragraph of article sixteenth of these measures, without taking special protective measures, by the construction administrative department in accordance with the "Regulations" management of construction safety; If the pipeline is damaged without relocation or other measures, the construction administrative department shall impose a fine of 6,543.8+0,000 yuan to 50,000 yuan on the construction unit, and if the circumstances are serious, a fine of 50,000 yuan to 6,543.8+0,000 yuan shall be imposed.
