Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners and property service enterprises, create a good living and working environment, and promote the construction of harmonious communities, these Measures are formulated in accordance with the provisions of the Property Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the use, maintenance, service, supervision and management of properties within the administrative area of this Municipality. Article 3 The term "property" as mentioned in these Measures refers to houses built according to law and their supporting facilities, equipment and related sites.

The term "property management" as mentioned in these Measures refers to the activities of the owners to maintain, conserve and manage the property and maintain the environmental sanitation and related order in the property management area by hiring property service enterprises. As agreed in the property service contract, Article 4 property management should adhere to the principle of combining owner autonomy with professional services, territorial management with industry management, and realize the unity of social, economic and environmental benefits. Advocate owners to choose property service enterprises through an open, fair and just market competition mechanism. Article 5 The people's governments of cities and counties (cities, districts) shall incorporate property management services into the development planning and target assessment system of modern service industries, establish and improve a socialized, professional and market-oriented property management mechanism, and include property management funds in the financial budget. Article 6 The people's governments of cities and counties (cities, districts) shall set up security funds for the management of residential quarters to support the infrastructure construction and property management of old residential quarters. Article 7 Establish the credit mechanism of property service enterprises, improve the credit service system, establish the credit management concept, establish and improve the credit files of property service enterprises, and promote the healthy development of the property service industry. Chapter II Management Responsibilities Article 8 The administrative department of housing and urban and rural construction of the Municipal People's Government (hereinafter referred to as the real estate administrative department) is responsible for the supervision and management of property management activities within its administrative area, and its main responsibilities are:

(a) to be responsible for the qualification management of the property service enterprises in this Municipality;

(two) responsible for the collection and use of residential special maintenance funds;

(3) Organizing the training of property management practitioners;

(four) the establishment of property management expert database;

(five) the establishment of property service enterprise credit files, supervision and inspection of property management activities;

(six) to guide the county (city, district) real estate administrative departments to supervise and manage the property management activities. Ninth counties (cities, districts) real estate administrative departments responsible for the supervision and management of property management activities within their respective administrative areas, its main responsibilities are:

(a) the implementation of property management laws, regulations, rules and relevant policies;

(two) to guide the neighborhood offices (Township People's governments) and neighborhood committees to participate in property management;

(three) responsible for the bidding and filing of residential property projects and the approval of the agreement to hire property service enterprises;

(four) responsible for the guidance, supervision and filing of the owners' congress and the owners' committee;

(five) to supervise the allocation and use of property service houses, as well as the property inspection and filing of property service enterprises;

(six) responsible for the collection and use of residential special maintenance funds;

(seven) to convene a joint meeting of property management, responsible for coordinating the handling of property disputes and complaints. Tenth city and county (city, district) people's government of the following relevant departments according to their respective responsibilities to do a good job in property management related work:

(1) The public security organ is responsible for handling the illegal acts in the process of the convening of the owners' meeting, the election of the owners' committee and the handover of property, and investigating and dealing with the acts of damaging, misappropriating, dismantling or stopping fire control facilities and equipment without authorization, or occupying, blocking or sealing fire truck passages, evacuation passages, safety exits and other violations of fire control laws and regulations;

(two) the civil affairs department is responsible for coordinating the guidance and supervision of the neighborhood (village) committees to the owners' committees, and assisting the owners' committees and property service enterprises to do a good job in property management;

(3) The human resources and social security department is responsible for guiding the employment of the realty service enterprise, and supervising the employees of the realty service enterprise to sign labor contracts and pay social insurance;

(four) the real estate administrative department is responsible for urging the construction unit to do a good job in the warranty of houses and facilities during the warranty period;

(five) the planning department is responsible for the review of the design scheme of the construction project, and determine the construction index of public facilities in the property management area according to the prescribed standards;

(six) the public utilities department is responsible for investigating and handling the problems that the water supply, gas supply, heating and other units have not fulfilled their maintenance responsibilities according to law;

(seven) the civil air defense department is responsible for guiding and supervising the maintenance and management of civil air defense projects and facilities within the property management area;

(eight) the price department is responsible for the supervision of property service charges, regulate the charging behavior of property service enterprises, and investigate and deal with arbitrary charges and price increases in property management according to law;

(nine) the market supervision and management department is responsible for investigating the illegal acts of changing residential buildings into business buildings without obtaining a business license;

(ten) the quality supervision department is responsible for the safety supervision of elevators, mechanical parking equipment, boilers, pressure vessels and other special equipment in the property management area, and investigate and deal with illegal acts in the installation, renovation, maintenance and use of special equipment according to law.

Building buildings and structures in the property management area without the permission of the planning department, opening doors (windows) on non-load-bearing external walls, destroying the facade of houses, occupying green spaces, destroying greening and greening facilities and other illegal acts. , shall be investigated and dealt with by the relevant administrative law enforcement departments in accordance with their respective responsibilities.

Water supply, power supply, heating, gas supply, communication, cable television and other units shall, in accordance with the provisions of the entrustment contract, undertake the maintenance responsibility of professional operating facilities and equipment and related pipelines in the property area according to their respective responsibilities.
