The Regulations of Shenzhen Special Economic Zone on Property Management was adopted at the 14th meeting of the Standing Committee of the Fourth Shenzhen Municipal People's Congress on September 25th, 2007, which consists of eight chapters 127. Details are as follows:

In order to standardize the property management activities of Shenzhen Special Economic Zone (hereinafter referred to as the Special Zone), safeguard the legitimate rights and interests of owners and property service enterprises, and create a safe, comfortable, civilized and harmonious working and living environment, these Regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and the actual conditions of the Special Zone.

Property management should follow the principle of combining owner autonomy, professional services and government supervision.

Property management shall abide by the provisions of laws and regulations, and shall not harm the public interests or the legitimate rights and interests of others.

Article 4

The municipal government property management administrative department (hereinafter referred to as the municipal competent department) shall be responsible for the supervision and management of property management and perform the following duties:

(a) to organize the implementation of these regulations and other laws and regulations on property management, and to implement the provisions of the state on property management;

(two) to study and formulate policies and measures related to property management;

(three) to guide and coordinate the district government property management administrative department (hereinafter referred to as the district competent department) and other relevant administrative departments, street offices, industry associations, etc. Carry out property management related work according to law;

(four) other duties as stipulated in these regulations.

The district competent department is responsible for the supervision and management of property management within its jurisdiction, and accepts the business guidance of the municipal competent department.

Other relevant departments of the municipal and district governments shall, in accordance with their respective duties, do a good job in property management according to law.

Article 5

Under the guidance of the district competent department, the sub-district office is responsible for organizing and coordinating the establishment of the owners' congress and the election of the owners' committee, and guiding and supervising the daily activities of the owners' congress and the owners' committee.

Community workstations assist street offices to carry out property management-related work. Sub-district offices may entrust community workstations to handle property management-related affairs.

Article 6

Shenzhen Property Management Association (hereinafter referred to as the Municipal Property Management Association) is a self-regulatory organization of the property service industry, which should actively regulate the business behavior of the industry, safeguard the legitimate rights and interests of its members and promote the healthy development of the industry; Responsible for formulating property service standards and supervising their implementation, promoting property service enterprises to operate in good faith according to law, organizing business training for employees in the property service industry, and mediating internal disputes in the industry.

Article 7

Establish a joint meeting system of property management to coordinate and handle major issues of property management. Specific measures shall be formulated by the municipal government.

Article 8

The owner of the property is the owner.

Owners enjoy the rights and obligations stipulated by laws and regulations in property management.

Article 9

The property management area shall set up the owners' meeting according to law and elect the owners' committee. A property management area establishes an owners' meeting. If the number of owners is small, and it is decided not to set up the owners' meeting with the unanimous consent of all owners, all owners shall perform the duties of the owners' meeting and the owners' committee.

The owners' congress shall exercise its functions and powers through the meetings of the owners' congress and the owners' committee.

Article 10

Meetings of owners' congress are divided into regular meetings and temporary meetings.

The meeting of the owners' congress shall be organized by the owners' committee in accordance with the rules of procedure of the owners' congress. When the owners' meeting is held, the community workstation where the property is located shall be invited to attend.

Article 11

In any of the following circumstances, the owners' committee shall convene an interim meeting of the owners' congress in time:

(a) more than twenty percent of the owners proposed;

(two) the occurrence of major emergencies need to be dealt with in a timely manner;

(three) other circumstances stipulated in this Ordinance and the rules of procedure of the owners' congress.

If the owners propose to convene a meeting of the owners' congress, the owners' committee shall verify the identity of the proposer.

Article 12

If the owners' committee fails to convene a meeting of the owners' congress as required, the owners may request the local street office to order it to be held within a time limit; Fails to convene, convened by the street office.

Article 13

The convener of the meeting of the owners' congress shall announce the topics, time, place, methods and voting matters of the meeting fifteen days before the meeting is held, and send a copy to all owners.

Article 14

The meeting of the owners' congress is only valid when the voting rights of the owners attending the meeting exceed half of the property management area and the number of owners attending the meeting exceeds half of all owners.

The attendance mentioned in the preceding paragraph means that the owner signs the meeting attendance form for confirmation; Convene a meeting of the owners' general meeting in written form or at the same time, including the owners signing the voting votes or electoral votes, and returning the voting votes or electoral votes in accordance with regulations.

The voting rights of the owners are calculated according to the construction area of the property owned by the owners. The construction area of the property is calculated by one vote per square meter, and less than one square meter is calculated by rounding.

Article 15

Owners can vote by themselves or entrust others to vote.

Where a person entrusts others to vote, a written power of attorney shall be issued, indicating the entrusted matters and the number of voters. When voting, the client shall present the power of attorney and the identity certificates of the client and himself.

Independent property units registered with more than two owners, to determine their own voters.

Article 16

The meeting of the owners' congress shall vote by secret ballot.

An independent property unit has a ballot or an election ticket, and each ballot or an election ticket shall indicate the number of voting rights of the property unit.

Article 17

The decision made by the owners' meeting shall be agreed by more than half of the voting rights held by the owners present at the meeting and more than half of the owners present at the meeting.

The decision of the owners' congress to use and update the special property maintenance funds within the property management area (hereinafter referred to as the special property maintenance funds), to rebuild and rebuild buildings and their ancillary facilities shall be approved by more than two-thirds of the voting rights held by the owners attending the meeting and more than two-thirds of the owners attending the meeting.

Article 18

Decisions made by the owners' congress according to law are binding on all owners in the property management area.

The owners' committee shall, within three days after the owners' meeting makes a decision, publish the decision in writing within the property management area, and send a copy to all owners.

Article 19

In case of any of the following circumstances in the property management area, the first owners' meeting shall be held, the owners' meeting shall be established, the owners' committee shall be elected, and the rules of procedure of the owners' meeting shall be formulated through the management statute. :

(a) the construction area of the property that has been sold and delivered for use has reached more than 50% of the total construction area of the property;

(2) The first property has been sold and delivered for two years.

Within sixty days after the property management area meets the conditions mentioned in the preceding paragraph, the construction unit or the property service enterprise shall inform the neighborhood office where the property is located in writing; The owner may also inform the neighborhood office where the property is located in writing.

Street offices shall, within one month after receiving the written notice, be responsible for verifying, organizing and coordinating the establishment of the preparatory group for the first owners' meeting (hereinafter referred to as the preparatory group).
