Regulations of Suzhou Municipality on Property Management of Residential Areas (202 1 Revision)

Chapter I General Provisions Article 1 In order to standardize the property management activities in residential areas, safeguard the legitimate rights and interests of all parties involved in property management, create a good living environment, promote the construction of harmonious communities and carry forward the socialist core values, these Regulations are formulated in accordance with the Civil Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and the Regulations on Property Management of Jiangsu Province, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the property management of residential areas and their supervision and management activities within the administrative area of this Municipality. Article 3 Property management shall follow the principle of combining party building with leadership, government organization, owner autonomy and professional services.

Property management should meet the requirements of saving resources, protecting the ecological environment, highlighting the culture in the south of the Yangtze River, and advocating new civilized practices, and must not violate public order and good customs, and must not harm the public interests and the legitimate rights and interests of others. Article 4 The people's governments of cities and counties (districts) shall strengthen the organization and leadership of property management, incorporate property services into the development planning and social governance system of modern service industry, and formulate and implement supporting policies; Establish a joint meeting system, improve the law enforcement and supervision system, and solve major problems in property management as a whole; Establish and improve a professional, socialized and market-oriented property management mechanism, encourage the adoption of new technologies and methods, promote the application of scientific and technological means such as Internet, Internet of Things and artificial intelligence in property management and services, and improve the level of property management and services.

County-level city (District) people's government shall provide full-time property management personnel for the town people's government (street offices) to implement the work funds.

City and county-level city (District) people's governments shall regularly supervise and inspect the implementation of these regulations and report to the Standing Committee of the people's congress at the same level. Fifth property management administrative departments responsible for the supervision and management of property management activities within their respective administrative areas, perform the following duties:

(a) to formulate policies, norms and organize the implementation of property management;

(two) to establish and improve the classification training system of property management, and organize the publicity and business training of laws, regulations and policies related to property management;

(three) to strengthen the supervision and management of property service providers, urge them to improve the quality of property services, and carry out administrative law enforcement of property management according to law;

(four) to guide and supervise the collection, management and use of residential special maintenance funds;

(five) to guide and supervise the property service industry associations to carry out industry self-discipline and service work;

(six) to perform other duties of supervision and management of property management.

The municipal administrative department of property management shall establish an information platform for property management supervision services and an electronic voting system for owners' decision-making; Formulate the rules of procedure of the owners' congress, the working rules of the owners' committee, the temporary management statute, the management statute and the preliminary property service contract and other model texts.

County-level cities (districts) property management administrative departments are responsible for guiding and assisting the town people's government (street offices) and neighborhood (village) committees to carry out property management-related work.

Departments and institutions such as development and reform, public security, civil affairs, finance, housing and urban and rural construction, natural resources and planning, ecological environment, landscaping, urban management, transportation, water affairs, emergency management, market supervision and management, fire rescue, etc. shall be responsible for the supervision and management of property management activities and carry out administrative law enforcement according to law. Sixth Town People's Government (street offices) is responsible for the guidance, coordination and supervision of property management within its jurisdiction, and performs the following duties:

(a) to organize, guide and supervise the establishment of the owners' congress, the election of the owners' committee and the general election within their respective jurisdictions, and handle the relevant filing procedures;

(two) to guide and supervise the owners' congress and the owners' committee to perform their duties according to law;

(three) to guide and supervise the property service providers to perform their obligations according to law;

(four) to provide legal advisory services for property management, mediation and handling of property management disputes, and coordination of property management parties;

(five) the establishment of property emergency service guarantee mechanism;

(six) to cooperate with the county-level city (District) property management administrative departments to guide and supervise the property inspection, property management project transfer and takeover within their respective jurisdictions;

(seven) other duties as prescribed by laws and regulations.

The Town People's Government (street office) is responsible for implementing the emergency measures and other management measures taken by the county-level city (district) people's government according to law, guiding the property service providers and the owners' committee to carry out the response work, and giving material and financial support.

Neighborhood (village) committees shall give guidance and help to the establishment of the owners' congress and the election of the owners' committee, and cooperate with the town people's government (street offices) to do a good job in property management.

Establish and improve the governance structure of residential areas led by community (village) party organizations, with the participation of neighborhood committees, owners' committees, property service providers and owners, and promote the innovation of property management and the deep integration of property management and grassroots social governance. Article 7 The realty service industry association shall strengthen the self-discipline management of the industry, standardize the practice behavior, monitor and regularly publish the cost information and pricing rules of realty service projects, mediate disputes in the realty service industry, maintain the market order of fair competition, and promote honest management; Strengthen the training of employees in property service enterprises, improve the level of property service and safeguard the legitimate rights and interests of property service enterprises.
