How not to pay the property management fee

Legal analysis: Generally speaking, property management fees should be paid. If the house has not been delivered because of quality problems, the property fee will be paid by the developer and the house will be rented. The lease contract indicates that the property fee shall be paid by the tenant, and the property company fails to fulfill the service responsibility of the contract. All owners can refuse to pay the property fee, but they need strong evidence. The property company has not signed a contract with the owner, and the service quality provided by the property company can not meet the standard agreed in the contract, so they can refuse to pay the property fee.

Legal basis: Article 40 of the Regulations on Property Management should follow the principles of reasonableness, openness, and adaptation of fees and service levels, and distinguish the nature and characteristics of different properties. Owners and property service enterprises shall, according to the measures for charging property services formulated by the competent price department of the State Council in conjunction with the competent construction administrative department of the State Council, stipulate in the property service contract.
