Xi building decoration regulations (revised in 2022)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Building Law of People's Republic of China (PRC), the Regulations on the Administration of Building Quality and Safety of Shaanxi Province and other laws and regulations, combined with the actual situation of this Municipality, in order to standardize the building decoration behavior, strengthen the management of building decoration activities, ensure the quality and safety of building decoration projects, and safeguard the public interests and the legitimate rights and interests of the parties involved in building decoration activities. Article 2 These Regulations shall apply to the supervision and management of building decoration activities within the administrative area of this Municipality. Article 3 The term "architectural decoration" as mentioned in these Regulations refers to the activities that the construction unit and the building user use decorative materials or decorations to treat the internal and external surfaces and spaces of the building in order to protect the main structure of the building, improve the use function of the building and beautify the building, including public building decoration and residential decoration. Fourth city housing construction administrative departments responsible for the supervision and management of the city's building decoration activities, the city building decoration management agencies specifically responsible for the daily management.

District and county housing construction administrative departments are responsible for the supervision and management of building decoration activities in this area.

The Town People's Government and the subdistrict offices shall, under the guidance of the administrative department of housing construction, cooperate with the supervision and management of building decoration activities.

Resource planning, ecological environment, market supervision, urban management, emergency, public security and other relevant departments and fire rescue institutions shall, according to their respective responsibilities, do a good job in building decoration management. Fifth building decoration activities follow the principles of qualified quality, safety and practicality, green and low carbon, adhere to civilized construction, and shall not harm the public interests and the legitimate rights and interests of others. Article 6 The design and construction of architectural decoration shall ensure the integrity, seismic performance and structural safety of buildings and structures. Seventh city housing construction administrative departments should strengthen the guidance of building decoration industry associations and promote industry self-discipline.

Building decoration industry associations should strengthen industry self-discipline, formulate and implement industry self-discipline norms according to law, and guide enterprises to operate in good faith. Chapter II General Provisions Article 8 Enterprises engaged in architectural decoration design, construction and supervision shall conduct business activities in accordance with the registered business scope.

Building decoration activities need to have corresponding qualifications according to law, and shall obtain corresponding qualifications.

Construction enterprises, design units and supervision units engaged in architectural decoration activities shall carry out activities within the scope permitted by the qualification grade. Article 9 Personnel engaged in architectural decoration design, construction and supervision shall have professional skills suitable for their work. Those who need to have corresponding qualifications according to law shall obtain corresponding qualifications and engage in architectural decoration activities within the scope of qualification grade.

Building decoration construction enterprises should carry out professional skills training for construction personnel. Special operations personnel should hold relevant certificates. Tenth building facade decoration should comply with the relevant planning of urban landscaping and urban appearance standards.

Where the architectural decoration needs to change the general layout of the approved architectural engineering design scheme, it shall apply to the competent department of resource planning and implement it after approval. Eleventh building decoration design units shall design in accordance with the mandatory standards of engineering construction and the requirements of engineering design depth stipulated by the state, and be responsible for the design quality.

Building decoration construction units shall carry out construction in accordance with the engineering design drawings and construction technical standards, and be responsible for the construction quality. If the construction unit finds errors in the design documents and drawings during the construction, it shall timely put forward opinions and suggestions.

Building decoration supervision units shall conduct project supervision in accordance with laws, regulations and relevant technical standards, design documents and construction project contracts, and bear corresponding supervision responsibilities. Twelfth non building owners to decorate buildings, should obtain the consent of the building owner. Thirteenth construction units or building users and decoration enterprises should sign a written contract, clear the rights and obligations of both parties.

Promote the use of architectural decoration renovation contract demonstration text, the contract demonstration text shall be formulated by the municipal market supervision and management department in conjunction with the municipal housing construction administrative department. Fourteenth building decoration activities before the start, the construction unit or building users should inform the property service enterprises or other managers in advance.

Property service enterprises or other managers shall cooperate with the implementation of supervision and management measures taken by relevant departments according to law. Fifteenth building decoration activities change the main building or load-bearing structure, the construction unit shall entrust the original design unit or design unit with corresponding qualification grade to put forward the design scheme before construction. Construction drawing design documents shall be submitted to the construction drawing review institution for review, and can only be used after passing the review.

Building users are not allowed to change the main body and load-bearing structure of the building without authorization in the process of building decoration. Sixteenth construction, design, construction, supervision units and other units related to the safety production of decoration projects shall, in accordance with the provisions of laws and regulations on safety production, establish and improve the responsibility system for safety production for all employees, implement safety production measures, ensure safety production and assume the responsibility for safety production.
