Article 22 The installation, modification and maintenance of elevators must be carried out by the elevator manufacturing unit or its entrusted unit that has obtained the corresponding license in accordance with this Law. Where an elevator manufacturing unit entrusts other units to install, renovate and maintain elevators, it shall conduct safety guidance and monitoring on their installation, renovation and maintenance, and conduct calibration and debugging according to the requirements of safety technical specifications. Elevator manufacturing units are responsible for the safety performance of elevators.

Section 4 Use

Thirty-second users of special equipment should use the special equipment that has obtained the production license and passed the inspection.

It is forbidden to use special equipment that has been explicitly eliminated and scrapped by the state.

Thirty-third units using special equipment shall, before the special equipment is put into use or within thirty days after it is put into use, go through the use registration with the department responsible for the safety supervision and management of special equipment and obtain the use registration certificate. The registration mark shall be placed in a prominent position of special equipment.

Thirty-fourth special equipment users should establish post responsibility, hidden danger management, emergency rescue and other safety management systems, and formulate operating procedures to ensure the safe operation of special equipment.

Thirty-fifth users of special equipment shall establish special equipment safety technical files. Safety technical archives shall include the following contents:

(1) Design documents, product quality certificates, installation and maintenance instructions, supervision and inspection certificates and other relevant technical data and documents of special equipment;

(2) Records of regular inspection and self-inspection of special equipment;

(3) Daily use records of special equipment;

(4) Maintenance records of special equipment and its affiliated instruments and meters;

(5) Records of operation failures and accidents of special equipment.

Thirty-sixth elevators, passenger ropeways, large recreational facilities and other special equipment to provide services to the public, its operation and use units shall be responsible for the safety of the use of special equipment, set up special equipment safety management institutions or equipped with full-time special equipment safety management personnel; Other special equipment users shall set up special equipment safety management institutions or equip full-time and part-time special equipment safety management personnel according to the situation.

Thirty-seventh the use of special equipment should have a prescribed safe distance and safety protection measures.

Buildings and ancillary facilities related to the safety of special equipment shall comply with the provisions of relevant laws and administrative regulations.

Article 38 Special equipment belongs to * * *, and the owner of * * may entrust the realty service unit or other managers to manage the special equipment, and the trustee shall perform the obligations of users of special equipment as stipulated in this Law and bear corresponding responsibilities. * * * If no one entrusts it, the * * * person or the actual manager shall perform the management obligations and bear corresponding responsibilities.

Thirty-ninth users of special equipment should carry out regular maintenance and self-inspection of the special equipment they use, and make records.

Units using special equipment shall regularly inspect and maintain the safety accessories and safety protection devices of the special equipment they use, and make records.

Fortieth users of special equipment shall, in accordance with the requirements of safety technical specifications, put forward periodic inspection requirements to the special equipment inspection agency one month before the expiration of the inspection period.

After receiving the requirements of regular inspection, the special equipment inspection institution shall conduct safety performance inspection in time according to the requirements of safety technical specifications. Users of special equipment shall place periodic inspection marks in a prominent position of special equipment.

Special equipment without regular inspection or unqualified inspection shall not continue to be used.

Forty-first special equipment safety management personnel should regularly check the use of special equipment, and deal with problems immediately; In case of emergency, you can decide to stop using special equipment and report to the relevant person in charge of the unit in time.

When the operators of special equipment find hidden dangers of accidents or other unsafe factors during the operation, they shall immediately report to the safety management personnel of special equipment and the relevant person in charge of the unit. When the operation of special equipment is abnormal, the operators of special equipment shall take effective measures to ensure safety in accordance with the operating procedures.

Forty-second special equipment failure or abnormal situation, the use of special equipment units should conduct a comprehensive inspection, eliminate the hidden dangers of accidents, can continue to use.

Article 43 Before passenger ropeways and large amusement facilities are put into daily use, the operating unit shall conduct trial operation and daily safety inspection, and check and confirm the safety accessories and safety protection devices.

The operating units of elevators, passenger ropeways and large-scale amusement facilities shall put the safety instructions, safety precautions and warning signs of elevators, passenger ropeways and large-scale amusement facilities in a prominent position that passengers can easily pay attention to.

When the public rides or operates elevators, passenger ropeways and large amusement facilities, they shall abide by the requirements of safety instructions and safety precautions and obey the management and command of relevant staff; In case of abnormal operation, evacuate in an orderly manner according to safety guidelines.

Forty-fourth boiler users should treat boiler water (medium) according to the requirements of safety technical specifications, and accept regular inspection by special equipment inspection institutions.

Engaged in boiler cleaning, shall be carried out in accordance with the requirements of safety technical specifications, and accept the supervision and inspection of special equipment inspection agencies.

Article 45 The maintenance of elevators shall be carried out by the elevator manufacturing unit or the installation, renovation and maintenance unit licensed according to this Law.

The elevator maintenance unit shall strictly implement the requirements of safety technical specifications in maintenance, ensure the safety performance of the elevator to be maintained, and be responsible for implementing on-site safety protection measures to ensure construction safety.

The maintenance unit of the elevator shall be responsible for the safety performance of the elevator it maintains; After receiving the failure notice, you should immediately rush to the scene and take necessary emergency rescue measures.

Article 46 After the elevator is put into use, the elevator manufacturing unit shall make a follow-up investigation and understanding of the safe operation of the elevators it manufactures, put forward improvement suggestions and provide necessary technical assistance for the problems existing in the maintenance and safe operation of the elevator maintenance unit or the user unit; When it is found that there are serious hidden dangers in the elevator, it shall promptly inform the elevator user and report to the department responsible for the safety supervision and management of special equipment. The elevator manufacturing unit shall make a record of the investigation and understanding.

Forty-seventh special equipment renovation, repair, in accordance with the provisions of the need to change the registration of use, it should be changed after the registration, can continue to use.

Article 48 If there are serious hidden dangers of accidents in special equipment, which has no value for renovation or repair, or meets other scrapping conditions stipulated in safety technical specifications, users of special equipment shall fulfill their scrapping obligations according to law, take necessary measures to eliminate the use function of special equipment, and go through the cancellation procedures of the use registration certificate with the original registered department responsible for safety supervision and management of special equipment.

If the special equipment that exceeds the scrapping conditions specified in the preceding paragraph can continue to be used after reaching the designed service life, it shall pass the inspection or safety assessment in accordance with the requirements of safety technical specifications and change the use registration certificate before it can continue to be used. If it is allowed to continue to be used, measures such as strengthening inspection, testing and maintenance should be taken to ensure the safety of use.

Eighty-third in violation of the provisions of this law, the use of special equipment units have one of the following acts, shall be ordered to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be ordered to stop using relevant special equipment and be fined between 10,000 yuan and 100,000 yuan:

(a) failing to register the use of special equipment in accordance with the provisions;

(2) Failing to establish the safety technical archives of special equipment or the safety technical archives do not meet the specified requirements, or failing to set the use registration marks and regular inspection marks according to law;

(3) Failing to carry out regular maintenance and self-inspection on the special equipment used by it, or failing to carry out regular inspection and maintenance on the safety accessories and safety protection devices of the special equipment used by it, and making records;

(four) failing to declare and accept the inspection in time according to the requirements of safety technical specifications;

(five) boiler water (medium) is not treated in accordance with the requirements of safety technical specifications;

(six) the special emergency plan for special equipment accidents has not been formulated.

Article 84 In violation of the provisions of this Law, a user of special equipment commits any of the following acts, and shall be ordered to stop using relevant special equipment, and be fined between 30,000 yuan and 300,000 yuan:

(a) the use of unlicensed production, without inspection or unqualified inspection, or the state explicitly eliminated, has been scrapped special equipment;

(two) special equipment failure or abnormal situation, without a comprehensive inspection, eliminate the hidden dangers of accidents, continue to use;

(3) The special equipment has serious hidden dangers of accidents, has no value of transformation or repair, or meets other scrapping conditions stipulated in safety technical specifications, fails to fulfill the scrapping obligations according to law, and goes through the cancellation procedures of the use registration certificate.

Article 85 If, in violation of the provisions of this Law, a mobile pressure vessel or gas cylinder filling unit commits any of the following acts, it shall be ordered to make corrections and be fined between 20,000 yuan and 200,000 yuan; If the circumstances are serious, the filling license shall be revoked:

(a) failing to implement the inspection and recording system before and after filling in accordance with the provisions;

(two) filling mobile pressure vessels and gas cylinders that do not meet the requirements of safety technical specifications.

Anyone who, in violation of the provisions of this Law, engages in the filling activities of mobile pressure vessels and gas cylinders without permission shall be banned, the illegally filled gas cylinders shall be confiscated and a fine of not less than 100,000 yuan but not more than 500,000 yuan shall be imposed; If there are illegal gains, the illegal gains shall be confiscated.

Eighty-sixth in violation of the provisions of this law, the production, operation and use of special equipment units in any of the following circumstances, shall be ordered to make corrections within a time limit; If no correction is made within the time limit, it shall be ordered to stop using relevant special equipment or suspend production for rectification, and a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed:

(a) not equipped with special equipment safety management personnel, testing personnel and operating personnel with corresponding qualifications;

(two) the use of personnel who have not obtained the corresponding qualifications to engage in the safety management, testing and operation of special equipment;

(3) Failing to provide safety education and skills training to the safety management personnel, testing personnel and operating personnel of special equipment.

Article 87 In violation of the provisions of this Law, the operating and using units of elevators, passenger ropeways and large amusement facilities shall be ordered to make corrections within a time limit in any of the following circumstances; If it fails to make corrections within the time limit, it shall be ordered to stop using relevant special equipment or suspend production and business for rectification, and a fine of more than 20,000 yuan10,000 yuan shall be imposed:

(a) there is no special equipment safety management organization or full-time special equipment safety management personnel;

(two) before the passenger ropeway and large amusement facilities are put into use every day, the trial operation and routine safety inspection are not carried out, and the safety accessories and safety protection devices are not checked and confirmed;

(3) Failing to place the safety instructions, safety precautions and warning signs of elevators, passenger ropeways and large amusement facilities in a prominent position that passengers can easily pay attention to.

Article 88 Whoever, in violation of the provisions of this Law, engages in elevator maintenance without permission shall be ordered to stop the illegal act and be fined between 10,000 yuan and 100,000 yuan; If there are illegal gains, the illegal gains shall be confiscated.

If the elevator maintenance unit fails to carry out elevator maintenance in accordance with the provisions of this law and the requirements of safety technical specifications, it shall be punished in accordance with the provisions of the preceding paragraph.

Eighty-ninth special equipment accidents, one of the following circumstances, the unit at more than fifty thousand yuan to two hundred thousand yuan fine; Impose a fine of 1 10,000 yuan but not more than 50,000 yuan on the main responsible person; The main person in charge belongs to the national staff, shall be punished according to law:

(1) Failing to organize rescue immediately after the accident of special equipment, or going AWOL or hiding in the process of accident investigation and handling;

(two) late reporting, false reporting or concealment of special equipment accidents.

Article 90 In the event of an accident, in addition to requiring the responsible unit to bear corresponding responsibilities such as compensation according to law, the responsible unit shall also be fined in accordance with the following provisions:

(a) a general accident, a fine of one hundred thousand yuan and two hundred thousand yuan;

(two) a major accident, a fine of two hundred thousand yuan and five hundred thousand yuan;

(three) a major accident, a fine of five hundred thousand yuan and two million yuan.

Article 91 If the principal responsible person of the unit responsible for an accident fails to perform his duties according to law or has leadership responsibilities, he shall be fined in accordance with the following provisions; Belong to the national staff, shall be punished according to law:

(a) in the event of a general accident, a fine of 30% of the annual income of the previous year shall be imposed;

(two) a major accident, a fine of forty percent of the annual income;

(3) In case of a major accident, a fine of 60% of the previous year's income shall be imposed.
