My house has been painted. Should property management be responsible?

Generally, property management is not responsible for acts suspected of intentionally destroying public and private property, unless it can be proved that the property put the suspect into the community because of its own negligence, and the property knew it when it painted the door and did not stop it. In this case, the property will bear part of the civil liability.

Intentionally destroying public or private property, with a small amount and minor circumstances, is a general illegal act, and should be detained or given a warning, fined or ordered to compensate for losses in accordance with the provisions of the Law on Public Security Administration Punishment.

Article 49 of the Law on Public Security Administration Punishment: Anyone who steals, swindles, robs, robs, extorts or intentionally damages public or private property shall be detained for more than five days and less than ten days, and may also be fined less than 500 yuan; If the circumstances are serious, he shall be detained for more than 10 and less than 15, and may also be fined less than 1000 yuan.

Article 275 of the Criminal Law: Whoever intentionally destroys public or private property in a large amount or has other serious circumstances shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or a fine for the crime of intentionally destroying property; If the amount is huge or there are other particularly serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years.

Intentional destruction of public or private property, suspected of one of the following circumstances, should be filed for prosecution:

(1) Causing losses of more than 5,000 yuan to public or private property;

(2) destroying public or private property for more than three times;

(3) Gathering three or more people to openly destroy public or private property;

(4) Other serious circumstances.
