Article 1 In order to strengthen the management of special maintenance funds for residential buildings, ensure the maintenance and normal use of residential buildings, facilities and equipment, and safeguard the legitimate rights and interests of owners, these Measures are formulated in accordance with relevant laws, regulations and rules, combined with the actual situation of this Municipality.

Article 2 The term "residential special maintenance funds" as mentioned in these Measures refers to the funds earmarked for the maintenance, renewal and transformation of residential parts and facilities after the expiration of the warranty period.

Article 3 These Measures shall apply to the deposit, use, management and supervision of maintenance funds for commercial housing (including affordable housing and resettlement houses) and after-sale public housing within the urban area of this Municipality.

Article 4 Maintenance funds shall be managed in a territorial way, and the principles of special account storage, earmarking, owner's decision-making and government supervision shall be adhered to.

Article 5 The Municipal Housing Security and Real Estate Management Bureau shall, jointly with the Municipal Finance Bureau, be responsible for guiding and supervising the management of maintenance funds in this Municipality. The daily management of the deposit and use of maintenance funds shall be carried out by the specialized agencies entrusted by the Municipal Housing Security and Real Estate Administration (hereinafter referred to as the maintenance fund management agencies). Article 6 The owners of the following properties shall deposit maintenance funds in accordance with the provisions of these Measures:

(a) residence, except that it is jointly owned by the owners and does not use parts and facilities with other properties;

(2) Non-residential buildings in residential quarters or non-residential buildings connected with single residential structures outside residential quarters.

If the property listed in the first paragraph of the preceding paragraph belongs to the sale of public housing, the selling unit shall deposit maintenance funds in accordance with the provisions of these measures.

Seventh commercial residential and non-residential owners should deposit maintenance funds according to their own property construction area. The down payment standard is: 20 yuan per square meter for villas, 60 yuan per square meter for multi-storey houses without elevators, and kloc-0/20 yuan per square meter for houses with elevators. Article 11 If the balance of the maintenance funds deposited by the owners of commercial residential and non-residential houses is less than 30% of the first deposit amount stipulated in these Measures, the house owners shall renew the payment in time, and the balance of the maintenance funds after renewal shall not be less than the first deposit amount stipulated in these Measures. If the owners' meeting has been established, the continuation work shall be organized and implemented by the owners' committee. If the public housing units that sell houses have not yet withdrawn or have not fully withdrawn the maintenance funds, they shall pay them in accordance with the relevant policies and regulations when selling public housing. Article 14 The maintenance fund deposited by the owner belongs to the owner.

Maintenance funds extracted from public housing sales funds belong to public housing sales units.

Article 15 Before the establishment of the owners' meeting or before the owners' meeting decides to implement the owner's independent management, the maintenance funds deposited by the owners of commercial houses and non-residential houses shall be managed by the maintenance fund management institution, and commercial banks shall be entrusted to manage the special account for the maintenance funds of commercial houses in accordance with the regulations, and a special account for the maintenance funds of commercial houses shall be opened in the special account management bank. The maintenance fund account opened shall be set up in the property management area as a unit, and a sub-account shall be set up according to the house number; If the property management area is not demarcated, an account shall be set up in units of buildings, and a sub-account shall be set up according to the house number.

Article 16 After the establishment of the owners' congress, the owners' committee may convene the owners' congress under the supervision of the local subdistrict office, and discuss and decide whether to authorize the owners' committee to be responsible for the daily management of the maintenance funds deposited by the owners within the property management area in accordance with the following procedures and relevant regulations:

(a) under the guidance of the district real estate management department, formulate the fund management and accounting system, and define the account management unit, management personnel and entrusted funds;

(two) publicity fund management system, accounting system, management of funds and other matters;

(three) with the consent of the owners whose exclusive part accounts for more than two-thirds of the total area of the building and more than two-thirds of the total number of people.

Owners who fail to deposit maintenance funds in accordance with the regulations must pay them before voting.

Article 17 After discussion and decision by the owners' meeting, the owners' committee is authorized to be responsible for the daily management of maintenance funds, and the owners' committee shall apply for the transfer of maintenance funds according to the following procedures:

(a) with the resolution of the owners' meeting, open a special account for the maintenance funds of the owners' meeting in the bank entrusted by the maintenance fund management institution.

(II) When there is an emergency that endangers the use safety of the house, sign an authorization agreement with the bank, the maintenance fund management institution and the district real estate management department, and if the relevant responsible person fails to implement the maintenance, renewal and transformation in time according to the regulations, it is agreed that the district real estate management department will organize the maintenance and pay the corresponding expenses from the maintenance fund.

(3) With the application for the transfer of maintenance funds, the resolution of the owners' meeting, the authorization agreement, the supervision certificate of the neighborhood office on the convening and voting of the owners' meeting, the account opening procedures, and the original maintenance fund bill deposited by the owners, go to the maintenance fund management institution to handle the filing and fund transfer procedures of the special account for the maintenance funds of the owners' meeting.

The maintenance fund management institution shall, within 30 days from the date of receiving the application for the transfer of maintenance funds and other materials, notify the owners' congress to open an account in the special account for maintenance funds, transfer the book balance of maintenance funds deposited by the owners within the property management area to the special account for maintenance funds of the owners' congress, and hand over the relevant detailed accounts to the owners' committee.

Eighteenth owners' meeting maintenance fund account shall be settled by transfer payment, and shall not withdraw cash, and accept the supervision of maintenance fund management institutions.

Article 19 Maintenance fund management institutions are responsible for the daily management of after-sale public housing maintenance funds, entrust commercial banks to manage special accounts for after-sale public housing maintenance funds in accordance with regulations, open special accounts for after-sale public housing maintenance funds in special account management banks, set up accounts by units selling houses, and set up sub-accounts by buildings.

After the sale of public housing, a detailed account of maintenance funds shall be established according to the building, and the deposited maintenance funds shall be transferred to the special account opened by the maintenance fund management institution.

Twentieth maintenance funds from the date of deposit in the special account for maintenance funds, according to the relevant provisions of the people's Bank of China, the interest transferred to the maintenance fund management department.

(1) The parts, facilities and equipment shared by all owners in the residential area shall be borne by all owners in proportion to their respective construction areas.

(2) The parts, facilities and equipment used by the owners in a single house shall be borne by all the owners of the house in proportion to their respective construction areas.

(3) The parts, facilities and equipment used by the owners in a unit shall be borne by the owners in the unit in proportion to their respective construction areas. The parts, facilities and equipment used by the owner of the house on one side of the unit shall be borne by the owner of the house on that side in proportion to their respective construction areas.

(4) The maintenance of the common parts of the adjacent owners shall be undertaken by the adjacent owners according to the proportion of their respective housing construction areas.

Twenty-fifth maintenance funds shall be used in accordance with the following procedures:

If the realty service enterprise is not hired, the relevant owners, owners' committees (or residents' committees) shall entrust the relevant units or district real estate management departments to set up convenient service stations for house maintenance in each district, and formulate maintenance, renewal and transformation plans.

(II) The maintenance, renewal and transformation scheme shall be approved in writing by interested owners and tenants who account for more than two thirds of the delivered housing area, and the realty service enterprise or relevant units and the owners' committee shall handle the application or filing procedures for the allocation of maintenance funds to the maintenance fund management institution with relevant information.

(3) After the maintenance fund management institution is approved, it shall notify the special account management bank to allocate 70% of the project budget funds to the realty service enterprise or relevant units; If the owners' congress opens a special account for maintenance funds, the owners' committee shall notify the bank that opened the special account.

(four) after the completion of the project, the acceptance report shall be signed and the final accounts of the project shall be audited.

(5) After verifying the acceptance report and audit certificate, the maintenance fund management institution shall notify the special account management bank to allocate the remaining funds after deducting the quality deposit agreed in the contract; If the owners' congress opens a special account for maintenance funds, the owners' committee shall notify the bank that opened the special account.

Twenty-sixth relevant owners, owners' committees (or residents' committees) entrust relevant units to organize the implementation of supervision, appraisal, cost audit, management services and other expenses in the process of maintenance and renovation.

Twenty-seventh serious damage to the roof waterproof, elevator failure, fire system failure and other emergencies that endanger the safety of the house, and need to be repaired, updated and transformed immediately, the use of maintenance funds shall be handled in accordance with the following procedures:

(a) before the maintenance funds are handed over to the owners' congress for independent management, the realty service enterprise or the owners or the relevant units entrusted by the owners' committee will report the maintenance project description and maintenance plan verified by the residents' committee to the maintenance fund management institution for approval, and then organize maintenance.

(II) After the maintenance fund is transferred to the maintenance fund account of the owners' congress, the owners' committee will report the maintenance project description and maintenance plan verified by the residents' committee to the maintenance fund management institution for the record, and immediately organize maintenance.

(III) After the project is completed and accepted, the realty service enterprise, the owners' committee or related industries shall preside over the final accounts of the project and the project acceptance certificate, and go through the maintenance fund transfer formalities with the maintenance fund management institution.

Article 28. In the property area where the maintenance fund management system has been established, there is an emergency that endangers the safety of housing use, and the relevant responsible person fails to implement maintenance, renewal and transformation in accordance with the regulations, the district real estate management department will organize maintenance on behalf of the relevant owners or after-sales public housing maintenance funds. Article 29 In a property management area, other non-residential properties such as garages (including special garages and parking spaces in garages) with separate ownership registration according to law shall establish a special maintenance fund management system in accordance with the provisions of these Measures.

For the sales of newly-built independent non-residential properties, a special maintenance fund management system shall be established with reference to the provisions of these Measures.
