Specification for installation of community cameras

Legal analysis: There is no provision for installing cameras in residential areas. Cameras are not a mandatory installation project, but for the sake of safety management, residential properties use cameras instead of manual inspections, and at the same time, they can trace back past events in the monitored area. There are no other regulations except that the public security department requires that the surveillance video data be kept for not less than 7 days. However, when the property service company takes over the community, if there is monitoring equipment in the community planning or there is already monitoring equipment, and it is described in the property contract, then the property service company should maintain and use the camera well; If this equipment is not installed in the community and there is no such agreement in the property contract, then the property service enterprise will normally provide the prescribed order service according to the contract, and then the owner should pay the property management fee. If there is no monitoring equipment, the owner can ask the property management company to install it, but the cost needs to be borne by the owner, and the future maintenance cost will also be added to the management fee, which may rise.

Article 937 A realty service contract is a contract in which a realty service provider provides realty services such as maintenance of buildings and their ancillary facilities, management and maintenance of environmental sanitation and related order within the realty service area to the owner, and the owner pays the realty fee.

Property service providers include property service enterprises and other managers.

Article 938 The contents of a realty service contract generally include service items, service quality, service fee standards and collection methods, use of maintenance funds, management and use of service places, service term, service handover and other terms.

The public service commitment made by the property service provider in favor of the owner is an integral part of the property service contract.

The realty service contract shall be in written form.
