Measures of Guiyang Municipality on Property Management of Urban Residential Areas
The term "property management" as mentioned in these Measures refers to the activities of maintaining, repairing and serving buildings and their equipment, municipal public facilities, greening, sanitation, transportation, public security and environmental appearance in residential areas. Article 3 Property management shall be classified. New residential quarters must be included in the property management, and existing residential quarters can be gradually implemented according to the actual situation. Article 4 Property management in residential areas shall be socialized and specialized in accordance with the principle of combining residents' autonomy with professional services, and specialized management shall be uniformly implemented by property management companies.
Property management companies must serve the owners and users of residential areas and pay attention to social and environmental benefits. Article 5 Guiyang Real Estate Management Bureau is the centralized management department of residential property management in this Municipality, responsible for the qualification examination and certification of property management companies, and guiding and supervising the animal husbandry management in residential areas.
The property management of Yunyan District, Nanming District and Guiyang Economic and Technological Development Zone is directly managed by the Municipal Real Estate Management Bureau.
Huaxi District, Wudang District, Baiyun District, qingzhen city, Kaiyang County, xiuwen county, Xifeng County People's government real estate management departments, responsible for the area of property management.
Construction, urban management, industry and commerce, public security and other relevant administrative departments shall, according to their respective responsibilities, guide and supervise the relevant work in property management.
Neighborhood offices and residents' committees shall give guidance and support to the property management work in this area. Article 6 In residential areas where property management is implemented, a residential area management committee (hereinafter referred to as the management committee) shall be established to handle matters related to property management on behalf of the owners and property users (hereinafter referred to as tenants) and safeguard the legitimate rights and interests of tenants.
The CMC may apply for legal person registration according to law. Seventh residents have the right to participate in the property management of residential areas, and at the same time have the obligation to abide by the residents' convention and maintain public order in residential areas. Chapter II Management of Newly-built Residential Areas Article 8 The newly-built residential areas mentioned in these Measures refer to residential areas formed through unified planning, rational layout, comprehensive development and supporting construction. Article 9 After the comprehensive acceptance of newly-built residential quarters is qualified, before the establishment of the CMC, under the supervision of the real estate management department, the development and construction unit or its entrusted property management company shall be responsible for the property management of residential quarters, and the management expenses shall be borne by the development and construction unit. Article 10 If the occupancy rate of newly-built residential quarters reaches more than 70% after delivery, the real estate management department shall, jointly with the neighborhood offices where the residential quarters are located and the development and construction units, organize the first household meeting, elect the management committee and formulate the household convention. Article 11 The residents' meeting shall exercise the following functions and powers:
(1) Electing and replacing members of the Administrative Committee;
(two) to supervise the work of the CMC;
(three) to listen to and consider the work report of the CMC;
(four) to decide on major issues involving the interests of residents in residential areas;
(five) to formulate and amend the convention on residents of residential quarters;
(six) to change and cancel the inappropriate decisions of the CMC;
(7) adopting the articles of association of the management committee. Article 12 The household convention is a code of conduct for the rights and obligations of all personnel in residential quarters in the use, maintenance and management of property.
The household convention must comply with the provisions of laws, regulations and rules, and shall be reported to the property administrative department for the record within 15 days after its promulgation. Article 13 A family convention shall include the following contents:
(a) the name, location, scope, area and number of households of the community;
(two) the status of public places and public facilities;
(three) the convening procedure of the residents' meeting and the way to decide on major issues in the community;
(four) the rights and obligations of residents to use their houses, public places and community public facilities;
(five) the right of residents to participate in the property management of residential areas;
(six) the residents' right to supervise the CMC and the property management company;
(seven) to pay all kinds of maintenance, conservation and management fees for residential property;
(eight) the code of conduct that residents in residential areas should abide by;
(nine) the responsibility for violating the family convention;
(10) Other related matters. Fourteenth residential residents meeting convened by the management committee, held at least once a year. If more than 20% of the households jointly propose, the CMC shall convene a household meeting in time.
The CMC is responsible for the residents' assembly of residential areas and reports its work. Fifteenth the number of members of the management committee depends on the size of the living area, generally 5- 15. Local police stations and residents' committees may send representatives to participate, but the residents' representatives shall not be less than 70% of the total members of the management committee. Members of the CMC are elected by the residents' congress for a term of three years.
The director and deputy director of the CMC are elected by the CMC from among its members, and the director of the CMC is the resident representative. The CMC may employ an executive secretary to handle daily affairs. The director and executive secretary of the CMC are full-time and can receive appropriate remuneration, and the specific amount will be decided by the residents' congress.
