Chapter IV of Wuhan Property Management Regulations
Institutions engaged in property service consulting, consultancy, agency, certification and other business activities within the administrative area of this Municipality and foreign enterprises engaged in property service activities shall file with the Municipal Housing Authority. The city implements the responsibility system of property service project manager, and the person in charge of property service within the property management area shall be a qualified property service project manager.
The realty service enterprise shall, in accordance with the provisions, employ corresponding professional service personnel to engage in relevant professional services. The city implements a reporting system for major matters of property services. One of the following circumstances occurs in the property management area, the property service enterprise shall report to the relevant competent departments and professional business units in a timely manner in accordance with the relevant provisions:
(a) fire, flood, explosion or natural disasters, causing personal injury or endangering the safety of buildings;
(two) there are hidden dangers in the building and its ancillary facilities and equipment, which are difficult to eliminate within eight hours, seriously endangering the safety of the owners, property users and buildings;
(three) the property service personnel leave the property management area, resulting in the interruption of property services, which seriously affects the normal life of owners and property users;
(four) the occurrence of mass incidents;
(five) the owners and property users have a major casualty accident;
(six) other hidden dangers or events that seriously affect the normal life of owners and property users. City real estate departments should strengthen the supervision and inspection of the quality of property services, organize the assessment of the quality of property services, and announce the assessment results to the public. The owner's evaluation of the quality of property service is the main basis for evaluating the quality level of property service. The owners' evaluation methods for the quality of property services shall be formulated separately by the municipal real estate department.
The district housing management department shall, jointly with the sub-district offices and township (town) people's governments, establish credit files of property service enterprises and provide inquiry services to the society. The realty service contract is signed by the owners' committee and the realty service enterprise selected by the owners' congress. The following contents in the contract shall be submitted to the meeting of the owners' congress for voting in advance, except that the owners' congress has authorized the owners' committee to decide:
(1) Property services;
(two) the quality of property services and service fees;
(three) security matters within the property management area;
(4) Term of the contract;
(5) Liability for breach of contract. The realty service enterprise shall perform the following realty services in accordance with the contract:
(a) the use, management and maintenance of * * * parts and * * * facilities and equipment in the property management area;
(two) the maintenance of public greening;
(3) Maintaining the environmental sanitation of public areas;
(4) Order maintenance and security coordination in public areas;
(five) the obligation to inform, discourage and report the prohibited acts in the use of the property;
(six) accounting management of property maintenance, renovation and renovation costs;
(seven) keeping property service files and property files;
(8) Other property services. The property service fees and vehicle parking service fees for ordinary houses, affordable housing and low-rent housing are subject to government-guided prices, while other properties are subject to market-adjusted prices. The formulation and adjustment of government-guided prices for property service charges and vehicle parking service charges shall take the form of symposiums, demonstration meetings and hearings, and listen to opinions widely.
Where the government-guided price is implemented, the municipal price department shall, jointly with the municipal housing management department, formulate the corresponding benchmark price according to the property type, service content, service quality level and price index changes, determine the floating range of no more than 20% of the benchmark price, and announce it to the public. The specific charging standard is agreed by the owner and the realty service enterprise in the realty service contract according to the benchmark price and floating range. The owner shall pay the property service fee on time in accordance with the property service contract.
In violation of the property service contract, the owners fail to pay the property service fee within the time limit, and the owners' committee shall urge them to pay it within a time limit; The realty service enterprise may also bring a lawsuit or apply for arbitration to the people's court according to law. The realty service enterprise shall, in accordance with the relevant provisions, handle the transfer procedures of property files, property service files, owners' lists and other materials with the development and construction unit or the owners' committee.
The realty service enterprise shall, within thirty days from the date of handling the transfer formalities, file with the District Housing Authority with relevant information. The owners' committee shall, 60 days before the expiration of the realty service contract, organize a meeting of the owners' general assembly to vote on whether to renew the appointment of the realty service enterprise. If both parties renew the contract, they shall re-sign the property service contract; If the contract is not renewed and management needs to be entrusted, the owners' meeting shall promptly hire other property service enterprises or other managers according to law.
Before the owners' congress selects a realty service enterprise, it shall convene a meeting of the owners' congress to vote on the main contents of the selection method, the specific implementer and the realty service contract.
If the term of the realty service contract expires and the owners' meeting fails to make a decision on hiring or renewing employment, the original realty service enterprise may continue to provide services in accordance with the original contract, and the realty service contract will be automatically extended until the owners' meeting makes a decision on hiring or renewing employment. Under any of the following circumstances, the realty service enterprise shall withdraw from the realty service within the realty management area, and shall not refuse to withdraw on the grounds that the disputes over creditor's rights and debts in the realty service have not been resolved and the phased work has not been completed:
(1) The property service contract is dissolved in accordance with the law and the contract;
(two) in addition to the provisions of the third paragraph of article fifty-fifth, the property service contract has not been renewed;
(three) other circumstances stipulated by laws, regulations and rules that the realty service enterprise shall not continue to engage in realty service activities. When a realty service enterprise withdraws from the realty service in the realty management area, it shall perform the following obligations at the same time as going through the withdrawal procedures:
(a) the transfer of custody of property files, property service files and other information and property service fees, the implementation of the remuneration system, it should also be handed over to the financial files during the service period;
(two) the avoidance of property service personnel in the property management area;
(3) Reimbursement of related expenses for advance receipt and collection;
(four) other obligations stipulated by laws, regulations and rules.
