Can the administrative department entrust property management to illegal buildings?

The administrative department cannot override the law and secretly instruct the property company to build illegal buildings.

Within the framework of China's legal system, there are penalties for illegal acts of government departments, but it is very difficult to implement them. Illegal construction violates China's urban and rural planning law, and the main unit is the local planning bureau.

Because the main body of illegal construction is the property company, the administrative department makes suggestions behind it, and there is no direct evidence to prove that the government administrative department directly participates in illegal construction. If things cause a bad social impact, the government administrative department will not take responsibility, and the property company will become a scapegoat to take responsibility.

Unless the administrative department has a written power of attorney for the property management company, and the property management company has issued a power of attorney, the illegal acts of the administrative department can be settled, the relevant personnel can deal with them, and the responsibility of the leaders can be investigated.

Under normal circumstances, property companies will take the initiative to be scapegoats, otherwise there is no way for property companies to undertake this business. Since the illegal construction is done by the property company, the property company has no right to assist the Planning Bureau in administrative law enforcement, and the local neighborhood committee should assist the Planning Bureau in administrative punishment of the illegal construction of the property company.
