1. If a road traffic accident is caused by the fault of one party, it shall take full responsibility;

2. If a road traffic accident occurs due to the fault of two or more parties, they shall bear the primary responsibility, equal responsibility and secondary responsibility respectively according to the role played by their actions in the accident and the severity of the fault;

3. Neither party is at fault for causing the road traffic accident. If it is a traffic accident, neither party is responsible. If one party intentionally causes a road traffic accident, the other party shall not bear the responsibility.

Second, the compensation items and calculation methods for traffic accident injuries:

1, medical expenses. The expenses necessary for the hospital to treat the traffic accident trauma of the parties concerned shall be calculated and paid according to the evidence. After the case is closed, if it is still necessary to continue treatment, it shall be paid according to the expenses required for treatment.

2. Lost time. If the party concerned has a fixed income, it shall be calculated according to the fixed income that I have reduced due to missing work; If the income exceeds the average living expenses of the traffic accident place by more than 3 times, it shall be calculated by 3 times.

3. Hospitalization food allowance. For the disabled in hospital, the food subsidy shall be compensated according to the actual hospitalization days. The calculation standard is calculated according to the food subsidy standard for the staff of state organs in the place where the traffic accident occurred.

4. Nursing expenses. If the injured need personal care during hospitalization, they should have a hospital certificate and compensate for the nursing expenses. The calculation method of nursing expenses is: if the nursing staff has income, it shall be calculated according to the provisions of lost time; No income, according to the average living expenses of traffic accidents. The "no income" mentioned here means that my source of life mainly or completely depends on the supply of others, or I still have a small amount of income but it is not enough to maintain a normal life.

Legal basis: Article 1 179 of the Civil Law of People's Republic of China (PRC) infringes on others and causes personal injury, it shall compensate the reasonable expenses of treatment and rehabilitation such as medical expenses, nursing expenses, transportation expenses, nutrition expenses, hospital food subsidies, and the reduced income due to absenteeism.
