Article 16 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government authorized by the State Council or the State Council may decide that an administrative organ shall exercise the power of administrative punishment of relevant administrative organs, but the power of administrative punishment that restricts personal freedom can only be exercised by public security organs.

The entrusting administrative organ is responsible for supervising the administrative punishment behavior of the entrusted organization and bearing legal responsibility for the consequences of this behavior.

The entrusted organization implements administrative punishment in the name of the entrusted administrative organ within the scope of entrustment; No other organization or individual may be entrusted to implement administrative punishment.

Article 19 An entrusted organization must meet the following conditions:

Institutions established according to law to manage public affairs;

(2) Having staff who are familiar with relevant laws, regulations, rules and business;

(3) If technical inspection or technical appraisal is needed for illegal acts, corresponding technical inspection or technical appraisal may be organized.
