Regulations of Wuxi Municipality on the Administration of City Appearance and Environmental Sanitation

Chapter I General Provisions Article 1 In order to strengthen the management of city appearance and environmental sanitation and build a clean, beautiful and civilized livable city, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the urbanized areas within the administrative area of this Municipality. The scope of urbanized areas shall be announced by the municipal and county-level municipal people's governments. Article 3 The management of city appearance and environmental sanitation adheres to the combination of professional management and mass supervision, administrative management and market mechanism operation, and implements the principles of unified leadership, graded responsibility, territorial management, public participation and social supervision. Article 4 People's governments at all levels shall strengthen their leadership over the management of city appearance and environmental sanitation, incorporate the cause of city appearance and environmental sanitation into the national economic and social development plan, establish and improve a diversified investment mechanism based on public finance, and ensure the needs of the development of city appearance and environmental sanitation. Article 5 The Urban Management Committee established by the municipal, county-level and district people's governments is a deliberative and coordinating body, and is responsible for organizing, coordinating and guiding major issues of urban management.

The composition and procedure system of the city management committee shall be decided by the people's government at the same level. Sixth city, county-level city, district urban management administrative departments in accordance with the division of responsibilities, in charge of the administrative area of the city appearance and environmental sanitation management.

The administrative law enforcement department of city management is specifically responsible for the administrative law enforcement of city appearance and environmental sanitation. The power of relatively centralized administrative punishment shall be implemented in accordance with the relevant provisions of the state, province and city.

Environmental sanitation management institutions shall be responsible for the daily management of environmental sanitation in accordance with their statutory duties. Seventh planning, construction, public security, industry and commerce, municipal gardens, land resources, housing security and real estate management, environmental protection, health, transportation and other administrative departments. Should be in accordance with their respective responsibilities, coordinate the management of city appearance and environmental sanitation. Eighth city appearance and environmental sanitation work to implement digital management, establish a unified urban management information system, realize resource integration and information sharing, and improve the efficiency of urban management. Ninth any unit or individual has the right to enjoy a clean and beautiful urban environment, and has the right to discourage and report acts that undermine the city appearance and environmental sanitation.

Encourage units and individuals to participate in public welfare activities of city appearance and environmental sanitation.

People's governments at all levels shall commend and reward units and individuals that have made remarkable achievements in the work of city appearance and environmental sanitation. Chapter II System of Area of Responsibility for City Appearance and Environmental Sanitation Article 10 The system of area of responsibility shall be implemented in the work of city appearance and environmental sanitation.

The area of responsibility refers to the land use right and management scope of buildings, structures and other facilities and places owned, used or managed by units and individuals. Article 11 The owners of buildings, structures or other facilities and places are the persons responsible for city appearance and environmental sanitation. Where the owner, user and manager have an agreement on management responsibilities, such agreement shall prevail.

The responsible person of the city appearance and environmental sanitation responsibility area shall be determined in accordance with the following provisions:

(a) streets, residential areas, by the town people's government or street offices to implement property management, by the property service enterprises;

(two) roads, bridges, underpasses, public squares, public green spaces, public waters, public toilets and other urban public areas, the municipal, county-level cities and district people's governments shall determine the competent departments according to law;

(three) rivers, lakes and other waters and coastline, by the city, county-level city, District People's government to determine the competent authorities responsible for;

(four) roads, railways, airports, subways, light rails, tunnels, stations, docks, parking lots, bus stops and their management scope shall be the responsibility of the business management units;

(five) culture, sports, entertainment, sightseeing and other public places, by the management unit is responsible for;

(six) commodity trading markets, exhibition and sales places, shopping malls, hotels, restaurants and other places, by the management unit;

(seven) organs, organizations, military units, schools, hospitals and other units as well as the management areas of factories and mines, which are responsible for;

(eight) the construction site of the construction project shall be the responsibility of the construction unit, and the land for the construction project that has not yet started shall be the responsibility of the construction unit;

(nine) the public areas in scenic spots, bonded areas, science and technology parks, independent industrial zones and economic development zones shall be in charge of the management units.

In addition to the provisions of the preceding paragraph, if the person responsible for city appearance and environmental sanitation is not clear, it shall be determined by the local administrative department of city management; If the person responsible for the administrative boundary is unclear or controversial, it shall be determined by the municipal administrative department of urban management. Twelfth county-level city and district people's governments shall sign a letter of responsibility for city appearance and environmental sanitation with the person responsible for city appearance and environmental sanitation, and supervise its performance.

The person responsible for city appearance and environmental sanitation shall perform the following duties:

(a) to keep the city clean and tidy, and shall not stop, set up stalls, set up, post, graffiti, hang and pile up without authorization;

(two) keep the environment clean and tidy, and regularly clean according to the division of responsibilities;

(three) timely clean up the garbage, no exposed garbage, sewage, stains, to prevent the breeding of mosquitoes and flies;

(four) set up environmental sanitation facilities in accordance with the provisions, and keep them clean and in good condition;

(five) the provisions on the administration of city appearance and environmental sanitation and other responsibilities stipulated in the letter of responsibility.

The person in charge of city appearance and environmental sanitation may entrust the city appearance and environmental sanitation operation service unit to undertake the specific work in the area of responsibility.
