Article 1 In order to ensure the resettlement of ex-soldiers, these Provisions are formulated in accordance with the Military Service Law of People's Republic of China (PRC), the Regulations on the Resettlement of Ex-conscripts and other relevant laws and regulations, combined with the actual situation of this province.

Article 2 The term "retired soldiers" as mentioned in these Provisions refers to the conscripts and volunteers retired from active service by the China People's Liberation Army and the Chinese People's Armed Police Force and placed in this province, that is, non-commissioned officers.

Article 3 The resettlement of retired soldiers must follow the principles of where they come from, where they go back, and where they are in their proper places.

The resettlement of retired soldiers in cities and towns is carried out through multiple channels, combining employment placement, supporting employment and encouraging self-employment.

The local people's governments shall give employment support to demobilized soldiers in cities and towns and demobilized conscripts in rural areas for self-employment.

Article 4 The people's governments at or above the county level shall strengthen the leadership over the resettlement of retired soldiers to ensure the completion of the resettlement task.

The people's governments at or above the county level shall be responsible for organizing and implementing the resettlement of retired soldiers within their respective administrative areas. The agency is located in the civil affairs department.

The resettlement plan must be approved by the people's government at the next higher level. The resettlement plan for retired soldiers issued by the provincial people's government in conjunction with relevant departments shall be approved by the provincial people's government.

Article 9 State organs, organizations, enterprises and institutions shall give priority to recruiting full-time armed cadres and security guards from retired soldiers.

Tenth disabled and meritorious retired soldiers should be given priority.

Units that receive disabled retired soldiers shall be deemed to have completed the resettlement plan for two people for each person they receive. The employing unit shall arrange work within its capacity for disabled retired soldiers, and their wages, insurance, welfare and other benefits shall be implemented in accordance with the provisions of the state on disability in the line of duty, and they shall not be dismissed or laid off for reasons other than their own.

The people's governments at all levels shall, in accordance with the relevant provisions of the state and the province, guarantee the funds needed for the housing construction of retired soldiers with special and first-class disabilities.

The source of resettlement security fund is:

(a) special funds for the placement of retired soldiers arranged by the central finance and people's governments at all levels;

(two) the transfer and resettlement fees paid by the employer;

(4) Other funds as prescribed by laws and regulations.

The above items (2), (3) and (4) shall be stored in special accounts for special purposes.

Sixteenth organs, organizations, enterprises and institutions that have the task of resettling retired soldiers may apply in writing to the people's government that issued the resettlement task for the paid transfer of the resettlement task. After the transfer of resettlement funds is approved and paid according to regulations, the resettlement tasks will be reduced accordingly.

Units that receive retired soldiers beyond the plan shall be compensated by the people's government that issued the resettlement plan according to the regulations.

Seventeenth people's governments at the county level may, according to local conditions, hold a meeting of supply and demand for the resettlement of retired soldiers, and implement the meeting of supply and demand, two-way selection and guarantee resettlement.

Units with the task of resettling retired soldiers shall enter the site with a letter of introduction according to the resettlement plan issued by the people's government; Retired soldiers enter the market to choose jobs with their retirement certificates.

The talents and labor market approved by the personnel, labor and social security departments at all levels shall provide services for the employment and resettlement of retired soldiers, and give preferential treatment such as fee reduction and exemption.

Article 18. Ex-soldiers who meet the working conditions for distribution and require self-employment shall submit a written application within 3 months after reporting for duty, and be given a one-time compensation from the resettlement security fund according to the regulations after being examined and approved by the resettlement agency of the local people's government at the county level. Twenty-first people's governments at all levels and relevant departments shall give assistance to retired soldiers engaged in agricultural production in terms of production services, technical guidance, agricultural materials supply and acquisition of agricultural and sideline products; It is necessary to provide conditions for retired soldiers with expertise, help establish economic entities, and support the development of tertiary industry, planting and aquaculture.

Twenty-second people's governments at all levels shall, according to the actual needs, carry out the service of dual-use talents for retired soldiers, and incorporate the development and use of dual-use talents into the local economic construction and strengthen the construction plan of rural grassroots organizations.

The establishment of an economic entity with retired soldiers as the main body and self-financing can enjoy the relevant preferential treatment of the state and the province with the proof of the resettlement agency of retired soldiers of the provincial people's government.

Units that refuse to accept the placement of retired soldiers shall bear the wages of the personnel to be placed during their work according to the average monthly salary of their employees in the previous year from the month when the letter of introduction for the placement of retired soldiers is issued.

Twenty-sixth national staff in the resettlement of retired soldiers, dereliction of duty, abuse of power, corruption, shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 27 The specific measures for the administration of the transfer and compensation of resettlement funds as stipulated in Articles 16 and 18 of these Provisions shall be formulated by the resettlement institution of retired soldiers of the provincial people's government jointly with the provincial finance department.

Article 28 These Provisions shall come into force as of the date of promulgation.
