Measures of Harbin Municipality on the Administration of Urban Construction Waste

Article 1 In order to strengthen the management of urban construction waste and ensure the cleanliness of urban appearance and environmental sanitation, these Measures are formulated in accordance with the relevant provisions of the Regulations of the State Council Municipality on the Administration of Urban Appearance and Environmental Sanitation and the Regulations of Shi Bin City of Halfar Municipality on the Administration of Urban Appearance and Environmental Sanitation, combined with the actual situation of this Municipality. Article 2 The term "construction waste" as mentioned in these Measures refers to wastes such as waste soil and materials generated by construction units, demolition units and construction units (hereinafter referred to as construction waste generating units) in the process of building, rebuilding, expanding and dismantling various buildings, structures and pipe networks, as well as in the process of decorating houses by units and individuals. Article 3 These Measures shall apply to the disposal activities such as the discharge, transportation, transit, backfilling, consumption and utilization of construction waste within the urban planning area of this Municipality. Article 4 The management of construction waste shall follow the principles of reduction, recycling and harmless disposal, and whoever produces it shall bear the responsibility for disposal. Encourage the comprehensive utilization of construction waste, and advocate units and individuals to give priority to the comprehensive utilization of construction waste products. Fifth city appearance and environmental sanitation administrative department (hereinafter referred to as the city appearance and environmental sanitation department), responsible for the management of urban construction waste, and is responsible for the organization and implementation of these measures.

District city appearance and environmental sanitation administrative department (hereinafter referred to as the district city appearance and environmental sanitation department), in accordance with the division of responsibilities, is responsible for the management of construction waste within its jurisdiction.

The administrative law enforcement department (hereinafter referred to as the administrative law enforcement department of urban management) that centrally exercises the power of administrative punishment of urban management is responsible for the implementation of the administrative punishment prescribed in these Measures.

Construction, planning, land resources, environmental protection, real estate and housing, finance, price, transportation, public security, quality and technical supervision and other administrative departments and sub-district offices shall, according to their respective responsibilities, do a good job in the management of construction waste. Article 6 The discharge, transportation and consumption of construction waste shall be subject to the administrative licensing system in accordance with the relevant provisions of the state; Without permission, no unit shall discharge, transport and consume construction waste without authorization.

Units that produce construction waste shall, 5 days before the commencement of the project, submit an application for the discharge of construction waste to the city appearance and environmental sanitation department with the construction waste disposal plan and relevant approval documents, and can only discharge it after obtaining the "Construction Waste Disposal Certificate" after approval.

Units engaged in the transportation of construction waste shall submit an application for the transportation of construction waste to the municipal city appearance and environmental sanitation department on the strength of vehicle driving license, road transportation license, proof of vehicle sealing and other related materials, and can only transport construction waste after obtaining the construction waste disposal certificate (one vehicle and one license) after approval.

Units that set up construction waste disposal sites shall apply to the city appearance and environmental sanitation department with relevant approval documents and obtain the construction waste disposal certificate before engaging in construction waste disposal activities.

After receiving the application, the competent department of city appearance and environmental sanitation shall complete the examination and issue the license within 3 working days; If it is not issued, it shall inform the reasons. Seventh units that produce construction waste shall report the "Closed Transportation Scheme for Construction Waste" to the construction administrative department for the record when handling the project commencement procedures; Belonging to the demolition project, it shall be filed with the demolition management department. The administrative department in charge of construction and demolition shall supervise the implementation of the "Closed Transport Scheme for Construction Waste". Eighth units that produce construction waste shall contract or subcontract the transportation of construction waste to units that are approved to engage in construction waste transportation, and sign a contract or subcontract. The construction waste transportation contract or subcontract shall stipulate that the transportation unit must transport the construction waste in a sealed manner, and shall not leave it scattered along the way or dump it at the designated place. The construction waste generating unit shall supervise the transportation unit to perform the contract, and if it still fails to make corrections after being prompted, it may terminate the contract. ? The unit that produces construction waste shall file the contract or subcontract with the construction administrative department where the project is located in accordance with the regulations; Belonging to the demolition project, it shall be filed with the demolition management department where the project is located. Ninth units that produce construction waste shall comply with the following provisions:

(a) timely removal of construction waste, keep the site and the surrounding environment clean and tidy;

(two) in accordance with the relevant provisions of the enclosure, so that the construction entrance hardened pavement;

(3) Clean up the residual garbage outside the carriage to avoid scattering along the way;

(four) equipped with corresponding washing facilities, the transport vehicle tires washed clean, before leaving the site. Article 10 Units and individuals that carry out property management on the construction waste generated by house decoration shall temporarily pile it up at the place designated by the property management enterprise, and take measures of sealing and covering, and timely remove it within 2 days; If property management is not implemented, it shall be temporarily piled up at the place designated by the sub-district office, and measures shall be taken to enclose and cover it, and it shall be removed in time within 2 days. ? Property management enterprises and sub-district offices shall, under the premise of not affecting the city appearance and environmental sanitation and the smooth flow of streets and roads, delimit temporary dumping sites for construction waste within their jurisdiction, and urge the units and individuals that produce construction waste to remove them in time.

Construction waste generated by house decoration can be removed with compensation by entrusting street offices and property management enterprises to contact units and individuals engaged in construction waste transportation, or can be removed by themselves according to the situation.

Construction waste generated by decoration should be cleaned and removed by bagged transportation or closed transportation, and dumped at the designated place. Vehicles carrying bagged construction waste shall not apply for construction waste disposal certificates. When transporting, it should be tied firmly and covered tightly to prevent it from falling on the way.
