Regulations of Hubei Province on the Administration of Property Services
The term "property services" as mentioned in these Regulations refers to the activities of the owners themselves or hiring property service enterprises to repair, conserve and manage the houses and their supporting facilities, equipment and related sites within the property area, and maintain environmental sanitation and related order. Article 3 People's governments at or above the county level shall incorporate property services into modern service industry development planning, community construction planning and social governance system, establish a comprehensive coordination mechanism and target responsibility system for property services, improve incentive policies and measures, and promote the development of property services and the construction of harmonious communities. Article 4 The real estate administrative departments of the people's governments at or above the county level shall be responsible for the supervision and management of property service activities within their respective administrative areas, and perform the following duties according to law:
(1) To supervise and manage the qualifications and service quality of property service enterprises;
(two) to carry out credit evaluation of property service enterprises;
(three) business guidance, training, supervision and management of property service enterprises and their employees and owners' committees;
(four) to supervise and manage the use and maintenance of the property;
(five) to guide and supervise the property inspection and property service enterprises to withdraw from the handover activities;
(six) to supervise and manage the deposit and use of property maintenance funds and residential special maintenance funds;
(seven) the establishment and maintenance of property services and management of electronic information platform;
(eight) handling complaints in property service activities;
(nine) other duties as prescribed by laws and regulations.
The administrative departments of urban and rural planning, construction, land and resources, public security, civil affairs, environmental protection, urban management, industrial and commercial administration, quality and technical supervision and price of the people's governments at or above the county level shall, according to their respective functions and duties, do a good job in the supervision and management of property services. Article 5 Sub-district offices and Township People's governments shall, under the guidance and supervision of Party organizations and civil affairs departments at the same level, organize and guide owners within their respective jurisdictions to set up owners' congresses and elect owners' committees according to law, supervise owners' congresses and owners' committees to perform their duties according to law, coordinate the relationship between property services and community management and community services, and mediate disputes over property services; Neighborhood (village) committees shall assist neighborhood offices and township people's governments in doing a good job in property services.
Property service and management should be included in the assessment content of spiritual civilization construction at the grassroots level. Sixth street offices and Township People's governments shall establish a joint meeting system for property services.
The joint meeting shall be convened by the sub-district offices and township people's governments, with the participation of real estate, public security, civil affairs, urban management and other administrative departments, neighborhood (village) committees, owners' committees, property service enterprises, professional business units and other parties, so as to specifically solve the problems that need to be coordinated in property service and management activities. Article 7 The realty service industry association shall strengthen the self-discipline management of the industry, formulate the standards and grades of realty service, establish and improve the self-discipline system of realty service enterprises and their employees, and improve the level of realty service. Chapter II Planning and Construction of Property Areas Article 8 The division of property areas shall follow the principles of giving priority to planning, improving functions, enjoying resources and benefiting the people.
The administrative department of urban and rural planning shall solicit the opinions of the administrative department of real estate on the division of property areas when reviewing the project planning and design scheme. Ninth the construction unit shall, according to the red line map determined by the construction project land planning permit, combined with facilities and equipment, community construction and other factors.
Property supporting facilities and equipment shall be divided into a property area; If the area is too large to be divided into one property area, it is not easy to manage or has been divided into several natural blocks, and its supporting facilities and equipment can be used separately, it can be divided into different property areas. Article 10 A construction unit shall, before obtaining a pre-sale permit or selling an existing house, apply to the real estate administrative department for filing the division of property areas. The real estate administrative department shall solicit the opinions of the administrative department of urban and rural planning, street offices, township people's governments, neighborhood (village) committees and other units, and approve and give a reply within 20 days from the date of accepting the filing application.
The construction unit shall publicize the detailed distribution map of the property area in a prominent position in the approved property area, as well as the facilities and equipment configuration and construction standards belonging to all owners, and make it clear in the house sales contract. Eleventh has been put into use but has not yet divided the property area or need to adjust the property area, by the real estate administrative departments to seek the opinions of the administrative departments of urban and rural planning, street offices, township people's governments, neighborhood (village) committees and related owners, to determine the property area.
The adjustment of the property area shall be approved by the owners whose exclusive parts account for more than half of the total construction area and more than half of the total number of people.
