Qualifications of members of trade committees

The owners' committee is elected by the owners' congress, and the members of the owners' committee are held by the owners. Before the establishment, the developer was responsible for the preliminary property management of the community and had the right to hire a property management company. If the occupancy rate of residential quarters reaches more than 50%, or it has been 2 years since the first owner moved in, the developer or the unit entrusted by it shall promptly inform the residential authorities in the region and hold the first owners' meeting within 6 months. The first owners' committee is composed of property management administrative departments, developers or property management enterprises, and owners' representatives. It recommends the list of candidates for the owners' committee and submits it to the first owners' meeting for election.

In any of the following circumstances, the membership of the owners' committee shall be terminated by the meeting of the owners' general assembly:

1, due to property transfer, loss and other reasons, it no longer belongs to the owner.

2. Being absent from the meeting of the owners' committee for more than three consecutive times.

3, due to illness and other reasons to lose the ability to perform their duties.

4. There are criminal acts.

5. Submit resignation to the owners' meeting in writing.

6. Refusing to perform the obligations of the owner.

7, other reasons should not be served as a member of the owners' committee. Where the membership of the owners' committee is terminated, the archives, seals and other property belonging to the owners' assembly shall be handed over to the owners' committee within 3 days from the date of termination.

What are the responsibilities of the owners' committee?

1. Convene the owners' meeting and report the implementation of property management;

2. Sign a realty service contract with the realty service enterprise selected by the owners' congress on behalf of the owners;

3, timely understand the opinions and suggestions of the owners, property users, supervise and assist the realty service enterprise to perform the realty service contract;

4. Supervise the implementation of management regulations;

5. Other duties assigned by the owners' meeting. At the same time, the owners' committee shall urge the owners who violate the property service contract and fail to pay the property service fee within a time limit.

Article 16 of the Property Management Regulations

The owners' committee shall, within 30 days from the date of election, file with the real estate administrative department of the district or county people's government, the subdistrict office and the Township People's government where the property is located. Members of the owners' committee shall be owners who are enthusiastic about public welfare undertakings, have a strong sense of responsibility and have certain organizational ability. The chairman and deputy directors of the owners' committee are elected from among the members of the owners' committee.

Article 17 The management statute shall stipulate the use, maintenance and management of the property, the interests of the owners, the obligations that the owners shall perform and the responsibilities that they shall bear if they violate the management statute. Management regulations shall respect social morality and shall not violate laws and regulations or harm public interests. Management regulations are binding on all owners.
