Can the property management company raise the property fee at will?

Property companies are not allowed to raise property fees at will.

The standard of property management fee shall be subject to the agreement in the property management contract or the commercial housing sales contract. Developers and property management companies are not allowed to raise prices unilaterally unless the government adjusts prices.

Both parties shall implement the property management fee according to the standards agreed in the property management contract. If one party changes it without authorization, it shall bear the liability for breach of contract: it can be mediated by the price department or settled through arbitration or litigation.

"Measures for the Administration of Property Service Charges" Article 21 The government price department in conjunction with the real estate administrative department shall strengthen supervision over the service contents, standards, charging items and standards of property management enterprises.

Property management companies that violate price laws, regulations and rules shall be punished by the competent price department of the government according to the Price Law of People's Republic of China (PRC) and the Provisions on Administrative Penalties for Price Violations.
