Interim Measures for the Administration of Bidding Agency Service Charges

Tenth bidding agency services to implement the "whoever entrusts the payment". The bidding agent service fee paid by the project bidding client can be included in the pre-project cost. The bidding agency service fee paid by the client for the bidding of goods and services shall be charged according to the provisions of the financial department.

Article 11 After collecting agency fees and selling bidding documents according to regulations, a bidding agency shall not require the tenderee to provide accommodation, transportation and other services. Or charge other fees for free.

Article 12 Where the bidding agency business exceeds the requirements stipulated in Article 3 of these Measures, the bidding agency may negotiate with the bidding client to determine the service fee for increasing the workload.

Thirteenth bidding agency service charges disputes, in accordance with the "People's Republic of China (PRC) Price Law", "People's Republic of China (PRC) Contract Law" and other relevant laws and regulations.

Fourteenth government departments at all levels or their authorized or entrusted units shall perform their supervisory functions in accordance with the provisions of the State Council on the division of bidding management functions, and require the bidding parties to perform procedures such as examination and approval and filing, and shall not charge fees.

In violation of the provisions of the preceding paragraph, those who set up charging items, set charging standards and collect management fees without authorization shall be punished by the competent pricing department of the government.

Fifteenth bidding agencies in violation of the provisions of these measures, by the competent price department of the government according to the "People's Republic of China (PRC) price law" and "regulations on administrative penalties for price violations" to be investigated.
