Measures of Changsha Municipality on the Administration of Elevator Safety
These Measures are not applicable to the safety management of self-use elevators or self-use elevators. Article 3 The people's governments of cities, districts and counties (cities) shall strengthen their leadership over elevator safety management and establish a coordination mechanism between elevator safety management and major safety issues.
City, county (city) quality and technical supervision department is responsible for the supervision and management of elevator safety within their respective administrative areas.
Safety supervision, housing and urban construction, industry and commerce, planning, price, public security and other competent departments shall, in accordance with their respective responsibilities, do a good job in elevator safety supervision and management.
Neighborhood offices and township (town) people's governments shall assist relevant departments to do a good job in the safety supervision and management of elevators within their respective jurisdictions. Article 4 Elevator production, sale, use, maintenance and inspection institutions shall abide by elevator safety technical specifications and relevant standards, establish and improve elevator safety management system and responsibility system, and ensure the safe operation of elevators. Fifth quality and technical supervision departments should strengthen the publicity and education of elevator safety, popularize elevator safety knowledge, enhance public awareness of elevator safety and improve self-protection ability.
Encourage schools, news media and social organizations to carry out elevator safety publicity and education, and advocate civilized elevator ride. Sixth to encourage the use of advanced scientific and technological means such as the Internet of Things, improve the level of elevator safety management, and enhance the ability of accident prevention and emergency rescue.
Encourage elevator production and maintenance units and elevator use managers to participate in elevator liability insurance. Chapter II Production and Sales of Elevators Article 7 Elevator manufacturing units shall be responsible for the safety performance of elevators. The installation, modification and maintenance of the elevator shall be carried out by the elevator manufacturing unit or the unit entrusted by it to obtain the corresponding license according to law. Where an elevator manufacturing unit entrusts a unit that has obtained the corresponding license according to law to carry out elevator installation, renovation and maintenance, it shall conduct safety guidance and monitoring on its installation, renovation and maintenance, and conduct calibration and debugging according to the requirements of elevator safety technical specifications. Article 8 The elevator installation shall conform to the relevant national, provincial and municipal regulations and standards, ensure that the elevator selection, configuration and power supply requirements are compatible with the building structure and use requirements, and comprehensively consider the functions of first aid, fire fighting and barrier-free.
The number, location, functional layout and other settings of elevators do not meet the relevant provisions and standards of the state, province and city, and the planning department shall not issue the construction project planning permit. Ninth elevator shaft, machine room and other buildings and ancillary facilities related to elevator safety shall meet the requirements of construction quality and elevator safety technical specifications. Tenth elevator installation, renovation and maintenance of the construction unit shall, before the construction, put forward the construction time, construction site, construction content, elevator parameters and elevator use managers and other suggestions. Inform the municipal quality and technical supervision department in writing. Eleventh elevator installation, renovation and maintenance is completed, the installation, renovation and maintenance of the construction unit shall, within thirty days after the acceptance, hand over the relevant technical information and documents to the elevator manager. The elevator use manager shall store it in the elevator safety technical file. Twelfth elevator sellers should establish and implement the system of inspection and acceptance of incoming goods and sales records, and report the elevator product catalogue to the municipal quality and technical supervision department for the record.
It is forbidden to sell elevators produced without permission, elevators that have not been inspected and are unqualified, and elevators that have been eliminated and scrapped by the state. It is forbidden to sell defective elevator spare parts. Chapter III Use and Maintenance of Elevators Article 13 Elevator use managers refer to units or individuals with elevator management rights and obligations.
Elevator use managers are determined as follows:
(1) The owner of the elevator is the elevator use manager. Among them, if it belongs to multiple property owners, the elevator use manager can be clearly defined through consultation; The elevator that has been entrusted by the realty service unit or other managers, and the entrusted realty service unit or other managers are elevator use managers;
(two) after the elevator installation and supervision and inspection, the construction unit has not been handed over, and the construction unit is the elevator use manager;
(three) lease a place equipped with an elevator, and if the lease contract has agreed on the elevator use manager, such agreement shall prevail; If there is no agreement or the agreement is unclear, it shall be determined in accordance with the provisions in items (1) and (2) above. Fourteenth elevator operators shall go through the elevator registration formalities at the municipal quality and technical supervision department in accordance with the regulations.
If the elevator is out of service for more than one year or the period of suspension spans the date of regular inspection, the elevator use manager shall close the elevator, set warning signs, and go through the formalities of suspension at the municipal quality and technical supervision department within 30 days. If the elevator is re-opened, it shall go through the formalities for opening. Fifteenth elevator managers are responsible for the daily management of elevators and perform the following elevator safety management duties:
(a) the establishment of elevator safety management institutions or equipped with a corresponding number of elevator safety management personnel, clear elevator safety management responsibilities;
(two) the establishment of elevator safety technical files;
(3) Keep the elevator emergency alarm device in effective contact with the personnel on duty at any time;
(four) to supervise the renovation, repair and maintenance of elevators and provide necessary conditions;
(5) Setting effective elevator signs at prominent positions of elevator cars or entrances and exits;
(six) put the safety precautions and warning signs for elevator use in a prominent position that passengers can easily pay attention to;
(seven) other safety management responsibilities stipulated by laws, regulations, rules and elevator safety technical specifications.
If the elevator use manager changes, the original use manager shall hand over the complete elevator safety technical files to the new use manager.
