Regulations of Shanghai Municipality on Regional Administration of Civil Airports (20 1 1 Revision)

Chapter I General Provisions Article 1 In order to strengthen the administration of civil airport areas in this Municipality, promote the construction and development of civil airport areas, ensure the safe operation of civil airports, and safeguard the legitimate rights and interests of stationed units, passengers and cargo owners, these Regulations are formulated in accordance with the Civil Aviation Law of People's Republic of China (PRC), the Regulations on the Administration of Civil Airports and other relevant laws and administrative regulations, and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the civil airport areas under the jurisdiction of this Municipality (hereinafter referred to as airport areas) and related airport planning and control, clearance protection, electromagnetic environment protection, noise impact and other management activities.

Civil aviation industry management shall be implemented in accordance with laws, administrative regulations and relevant state regulations. Article 3 The airport areas mentioned in these Regulations include Pudong International Airport and Hongqiao International Airport. The scope of the airport area includes the area within the airport enclosure facilities such as rivers, fences and fences, as well as the urban terminal area outside the airport enclosure facilities and the traffic supporting area of Hongqiao International Airport determined by the Municipal People's Government.

The resident units mentioned in these Regulations refer to the organs, organizations, enterprises, institutions and other organizations within the airport area.

The airport control area as mentioned in these Regulations refers to the area where access is restricted according to aviation safety needs, including waiting isolation area, baggage sorting and loading and unloading area, aircraft activity area, aircraft maintenance area and cargo storage area. Article 4 The municipal administrative department of communications and ports shall be responsible for the relevant management of airport areas and organize the implementation of these Regulations.

Shanghai Airport (Group) Co., Ltd. (hereinafter referred to as the airport management agency) is responsible for the construction, safety and operation of the airport, and carries out administrative punishment according to the authorization of these regulations.

The administrative departments of development and reform, traffic construction, land planning, housing, public security, industry and commerce administration, greening, environmental protection, meteorology, health, ports, radio and other port inspection agencies (including customs, frontier inspection agencies and entry-exit inspection and quarantine agencies) of this Municipality shall, according to their respective functions and duties, cooperate in the implementation of these Regulations. Article 5 The management of airport areas shall follow the principles of unity, safety, high efficiency and standardization. Chapter II Management of Planning and Construction Article 6 The airport management agency shall be responsible for organizing relevant units on site to prepare and revise the overall airport plan. Airport management agencies shall solicit opinions from the municipal administrative departments of construction, transportation and port when compiling and revising the overall airport planning. The overall airport planning shall be comprehensively balanced by the municipal planning and land management department, and shall be incorporated into the corresponding urban and rural planning of this Municipality after being approved in accordance with the procedures prescribed by the state and this Municipality.

The part of the regulatory detailed planning involving the airport area shall be organized by the airport management agency, compiled and revised by the municipal planning and land management department, and implemented after being approved by the municipal planning and land management department in accordance with the procedures prescribed by the state and this Municipality.

The overall airport planning should be based on the comprehensive transportation system planning of this Municipality, and be connected with other special transportation planning.

The overall airport planning shall meet the requirements of the national technical specifications for airport clearance protection, electromagnetic environment protection and flight safety.

Land use and construction in the airport area must conform to the overall planning of the airport and the urban and rural planning of this Municipality. Article 7 The land in the airport area shall be used for compensation in accordance with the relevant provisions of the state and this Municipality.

If it is really necessary to change the land use of the airport area, it shall submit a written application to the administrative department of land planning, which shall solicit the opinions of the municipal administrative department of transportation and port and the airport management agency and examine and approve according to law.

Need to change the nature of the use of buildings in the airport area, in accordance with the provisions of the state and the city's property management laws and regulations, the housing administrative department shall solicit the opinions of the regional civil aviation administrative agencies, the municipal traffic port administrative departments and the airport administrative agencies when making the examination and approval. Eighth in the airport area, new construction, renovation and expansion projects, the construction unit shall submit a written application to the planning and land management department. The administrative department of land planning shall solicit the opinions of the municipal administrative department of transportation and port and the airport management institution when reviewing the design scheme of the construction project. Article 9 The airport management institution shall organize the relevant resident units to cooperate with the relevant district greening and city appearance administrative departments to prepare the implementation plan for outdoor advertising facilities in the airport area. The implementation plan of outdoor advertising facilities in the airport area shall be implemented after being approved by the municipal administrative department of greening and city appearance according to law.

Where outdoor advertising facilities are set up in the airport area, a written application shall be submitted to the relevant district greening and city appearance administrative department, which shall solicit the opinions of the municipal traffic and port administrative department and the airport management institution, and examine and approve them according to law. Article 10 Land users in airport areas shall be responsible for the construction, maintenance and repair of roads, environmental protection, environmental sanitation, greening and other public facilities in the land they use.

Airport border facilities are set up and maintained by airport management agencies. Eleventh planning and land administrative departments shall determine the regional scope of airport development that needs planning control.

When examining and approving new construction, renovation and expansion projects in areas where airport development needs planning control, the land planning and management department shall solicit the opinions of the municipal traffic and port management department and the airport management agency.
