I. General requirements

According to the actual needs of the construction and development of economic functional zones at all levels in our city, and in accordance with the requirements of "special management in special areas", the municipal and county-level economic management authority that allows entrusted management by laws and regulations, is conducive to improving the administrative efficiency of economic functional zones and conforms to the functional orientation of economic functional zones is given to the corresponding economic functional zones respectively. All economic functional zones shall exercise unified leadership, unified planning and unified management over the affairs within the scope of authorization. Second, the basic principles

(1) The content is reasonable. According to the overall authority scope of each economic functional zone, the specific empowerment content is set scientifically and reasonably according to local conditions to ensure the smooth and efficient operation of power and meet the actual needs of economic functional zones.

(2) The procedure is legal. Economic management authority is generally entrusted. Involving administrative examination and approval matters, the relevant functional departments of the city, district (city) and the corresponding administrative agencies of economic functional zones shall, in accordance with the requirements of the People's Republic of China (PRC) Administrative Licensing Law and other relevant laws and regulations, sign an entrustment agreement and make an announcement.

(3) the rights and responsibilities are consistent. City, district (city) relevant functional departments should clarify the specific content of empowerment, ensure that empowerment is in place, and assume corresponding guidance and supervision responsibilities. In accordance with the principle of "who is in charge, who is responsible", the management institutions of economic functional zones are fully responsible for matters within the scope of entrustment. Administrative reconsideration and administrative litigation cases arising from administrative management shall be specifically responsible for legal affairs such as giving evidence and appearing in court by the administrative organs of economic functional zones; The administrative compensation for administrative management shall be borne by the financial department of the economic functional zone.

(4) Efficient and convenient. All economic functional zones should constantly optimize the examination and approval service process, improve the examination and approval service mechanism, gradually establish a centralized and unified examination and approval service model, and strive to achieve "one-stop service, one-stop completion, one window to the outside world." Third, the scope of authority

(a) the economic management authority of Hongdao Economic Zone (High-tech Industrial Development Zone) and other economic functional zones. Endow Hongdao Economic Zone (High-tech Industrial Development Zone), West Coast Economic New Zone, Blue Silicon Valley Core Zone and other existing economic functional zones with the following economic management rights, except for the overall coordination and comprehensive balance of the whole city and special provisions of the state:

1. Economic management right of fixed assets investment project approval, enterprise investment project filing and technical transformation project filing within the authority;

2 on land development, use, transfer, expropriation and pre-sale of commercial housing, housing ownership registration, property management and other land and real estate economic management rights;

3. Economic management rights in site selection, land use planning and construction project planning of construction projects;

Economic management rights of construction projects from construction permit to completion acceptance filing, real estate project development, urban greening construction and management, outdoor advertising, fire safety, civil air defense projects and facilities, seismic fortification, lightning protection device design and completion acceptance;

5 of the municipal infrastructure construction, occupation and excavation of urban roads, urban drainage, water supply, gas, heating and other municipal public facilities economic management rights;

6. Economic management rights of marine fisheries such as sea area use, marine coastal engineering construction, water surface (tidal flat) breeding, aquatic fry production, and offshore fishery projects;

7. Economic management rights in environmental protection such as environmental impact assessment and completion acceptance of construction projects, environmental protection in trial production of construction projects, and cleaner production audit and acceptance of key enterprises;

8. Economic management rights in health, such as health examination and completion acceptance of construction project design and the issuance of health permits within the prescribed scope;

9 on water resources management, soil and water conservation, water conservancy projects and facilities management and other water conservancy economic management rights;

10. Economic management rights of forest land requisition and occupation, forest harvesting, transportation, management and forest seed production and management;

1 1. Economic management rights for high-tech enterprises, scientific and technological projects, scientific and technological achievements, scientific and technological awards, patents and intellectual property affairs;

12. Economic management rights in Sino-foreign joint ventures, Sino-foreign cooperation, establishment of wholly foreign-owned enterprises, confirmation of foreign investment projects encouraged by the state, foreign labor cooperation, foreign economic and technological exhibitions, etc.;

13. Economic management rights in specific regulatory areas such as state-owned assets, allocation and use of financial funds for government investment projects, government procurement, production safety, food and drugs, prices and statistics;

14. Economic management rights in human resources and social security such as talent introduction, talent market, enterprise employment, labor contract, vocational training and vocational skill appraisal;

15. Business aspects such as the economic management right and business behavior registration of market entities, annual inspection of registered enterprises, and advertising management;

16. Economic management rights of quality and technical supervision, such as organization code registration, food entrusted processing filing, and enterprise product implementation standards filing;

17. Other economic management rights granted by the municipal government.

(two) the economic management authority of Jiaonan Economic Development Zone and other economic functional zones. Give county-level economic management authority to Jiaonan Economic Development Zone, Jiaozhou Economic Development Zone, Jimo Economic Development Zone, Jimo High-tech Industrial Development Zone, Pingdu Economic Development Zone, Laixi Economic Development Zone, Huanhai Economic Development Zone, Qingdao Chengyang Industrial Park and Qingdao Lingang Economic Development Zone. The scope and specific content of the authority shall be determined and implemented by the relevant district and municipal governments according to local actual conditions.

Municipalities may refer to this decision and entrust the relevant county-level economic management rights to their central towns.

(three) the economic management authority of other economic functional areas. Whether the newly established economic functional zones at all levels in the future enjoy the same municipal or county economic management authority as the existing economic functional zones shall be decided by the Municipal People's Government.
