What are the consequences of not paying the property fee?
According to the Property Management Regulations, the owner must pay the property service fee according to the property service contract. Violation of the property service contract, refusing to pay or refusing to pay the property service fee without justifiable reasons, the owners' committee has the right to urge them to pay within a time limit; If it fails to pay within the time limit, the property management company may bring a suit in a people's court. In this regard, Article 6 of "Several Provisions on Property Service Disputes in the Supreme People's Court" further explains some problems existing in the specific application of the examination. After investigation and written notification, if the owner refuses to pay the property fee or refuses to pay the property fee within a reasonable period of time, the people's court shall support it. Property service enterprises provide services in accordance with the contract and relevant regulations, and the people's court will not support the owners who do not enjoy or accept the relevant property services because of the defense. Therefore, if the owner refuses to pay the fee for any reason, he will bear the liability for breach of contract to the property management company and bear all the adverse consequences caused by it.
Only under the following circumstances, the owner can not pay or underpay the property service fee:
1。 The property management company stipulates in the property management service contract that it will provide services by itself. Without the consent of the owners' committee or owners, the owners or users cannot pay the fees.
2. Article 4 of the Measures for the Administration of Property Service Charges stipulates that the price department in the State Council shall be responsible for the supervision and management of property service charges nationwide in conjunction with the construction administrative department in the State Council. The price departments of local people's governments at or above the county level shall be responsible for the supervision and management of property service charges within their respective administrative areas. The owners may refuse to pay the above-mentioned guidance price for the property service fees charged by the government.
3. The property management company fails to perform the obligations stipulated in the property service contract, and the owner cannot pay or underpay the corresponding property service fee. Property management companies raise the charging standards for property services without authorization, and some owners may not raise the charging standards without authorization. In the property service contract, if the property management enterprise fails to provide the corresponding service, it must first collect the service fee, and the owner cannot pay the corresponding service fee.
4。 The property fails to perform the contract, such as not cleaning the sewer regularly according to the same requirements.
5. The owner raises the property service standard without authorization, and increases some expenses that the owner cannot pay without authorization.
6。 The service quality provided by the property management company can't meet the standard stipulated in the contract.
