Measures of Dongguan Municipality on Property Management

Chapter I General Provisions Article 1 In order to further standardize the property management activities in this Municipality, safeguard the legitimate rights and interests of all parties involved in property management, and create a harmonious, safe, civilized and tidy living and working environment, these Measures are formulated in accordance with the Property Law of People's Republic of China (PRC), the Regulations on Property Management, the Regulations on Property Management of Guangdong Province and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the property management activities within the administrative area of this Municipality.

The term "property management" as mentioned in these Measures refers to the activities of the owners to maintain, conserve and manage the houses, supporting facilities, equipment and related sites by hiring property service enterprises, and to maintain the environmental sanitation and related order in the property management area. Article 3 The Municipal People's Government shall strengthen the organization and leadership of property management, and incorporate property services into the development planning, community construction and community management system of modern service industry; Establish and improve the socialized and market-oriented property management mechanism, and encourage the adoption of new technologies and methods to improve the property management and service level. Article 4 The municipal administrative department of property management shall be responsible for the supervision and management of property management activities within the administrative area of this Municipality, organize the implementation of relevant laws, regulations and rules on property management, study and formulate relevant policies on property management, coordinate and solve property management disputes within the administrative area of this Municipality, and guide the park management committee, the town people's government (street offices) and the municipal property management industry association to do a good job in property management. Fifth Park Management Committee and Town People's Government (street offices) shall perform the following duties under the guidance of the municipal property management administrative department:

(a) to guide and supervise the establishment of the owners' congress and the election and general change of the owners' committee;

(two) to do a good job of filing and filing the owners' committee;

(three) to guide and supervise the owners' congress and the owners' committee to carry out their daily activities according to law;

(four) to coordinate the relationship between property management and village and community construction, and to coordinate and handle all kinds of property management disputes within the jurisdiction;

(five) other duties as prescribed by laws, regulations and rules. Article 6 The public security organ shall do a good job in the supervision and management of public security and fire safety in the property management area, supervise and inspect the property service enterprises to perform their duties of public security and fire safety, implement their responsibilities of fire safety, and investigate and deal with the behavior of raising animals in the property management area that interferes with others' lives and hinders traffic according to law.

The municipal administrative department of urban and rural planning shall do a good job in the examination and supervision of public facilities planning in the property management area, and shall specify the location and area of the property service room when approving the construction project planning permit.

The municipal price administrative department shall do a good job in the supervision and management of property service charges, standardize the behavior of property service charges, and accept price policy consultation and complaints.

The comprehensive administrative department of city management shall investigate and deal with the illegal construction of buildings and structures in the property management area according to law.

The municipal water administrative department shall do a good job in the construction of water supply, water saving and secondary water supply projects and the management and maintenance of facilities within the property management area.

The Municipal People's Air Defense Office shall do a good job in the maintenance, supervision and management of civil air defense works, civil air defense communication and alarm facilities and related functional buildings within the property management area.

Other relevant administrative departments shall, within their respective functions and powers, do a good job in property management in accordance with the provisions of laws, regulations and these measures. Article 7 Villagers' committees and residents' committees shall assist and cooperate with the municipal administrative department of property management, the administrative committee of the park and the town people's government (street offices) to carry out property management-related work, determine specific liaison officers to be responsible for liaison work and participate in solving property management disputes. Eighth park management committee, the town people's government (street offices) shall, jointly with the municipal administrative department of property management, establish a joint meeting system of property management. The joint meeting was organized and convened by the local park management committee and the town people's government (street offices), with the participation of property management, urban comprehensive management, civil affairs, housing and urban and rural construction, judicial administration, public security, letters and visits, villagers' committees, residents' committees, owners' committees, property service enterprises and other relevant departments. To coordinate and deal with the problems arising from major property management disputes such as the election of owners' committees, the re-election and handover of property service enterprises within their respective jurisdictions.

The same property management area across the park, town (street), the joint meeting by the municipal property management administrative department in conjunction with the territorial park management committee, the town people's government (street offices) * * * with the organization convened.

Involving the coordination of water supply, power supply, gas supply, environmental sanitation and other matters within the property management area, it shall notify the relevant professional business units to participate. Article 9 The municipal property management industry association shall strengthen the self-discipline management of the industry, formulate the code of conduct for the property service industry, organize professional training for employees in the property service industry, improve the service level of the industry, mediate disputes and disputes within the industry, and safeguard the legitimate rights and interests of property service enterprises. Chapter II Owners, Owners' Congress and Owners' Committee Article 10 Owners shall enjoy the following rights in property management activities:

(a) to accept the services provided by the realty service enterprise in accordance with the realty service contract;

(three) to elect the owners' representatives and members of the owners' committee and enjoy the right to be elected;

(four) to participate in the owners' meeting and exercise the right to vote;

(five) proposed to convene a meeting of the owners' congress, and put forward suggestions on matters related to property management;

(six) to supervise the daily work of the owners' committee;

(seven) to supervise the realty service enterprise to perform the realty service contract in accordance with the agreement;

(eight) to exercise the right to know and supervise the use of * * * parts of the property, * * facilities and equipment and residential special maintenance funds;

(nine) other rights stipulated by laws, regulations and rules.
